第368A章 第1条引称
第I部
导言
本规例可引称为《行车隧道(政府)规例》。
第368A章 第2条释义
(1)在本规例中,除文意另有所指外─ (1999年第44号第32条;1999年第49号第3条)
“小型巴士”(light bus) 指许可车辆总重不超逾4公吨、经构造或改装成为只用作运载驾驶人及不超过16名乘客及其个人财物的汽车,但不包括伤残者车辆、电单车、机动三轮车、私家车或的士; (1984年第196号法律公告;1988年第89号第6条)
“三轮车”(tricycle) 指使用踏板驱动的三轮车辆; (1984年第196号法律公告)
“巴士”(bus) 指经构造或改装为运载16名以上乘客及其个人财物的汽车; (1988年第89号第6条)
“公共小巴”(public light bus) 指用作或拟用作出租或取酬用途的小型巴士,但不包括任何私家小巴;
“公共巴士”(public bus) 指用作或拟用作出租或取酬用途的巴士,但不包括任何私家巴士;

“交通标志”(traffic sign) 指向道路使用者传达警告、资料、指示、规定、限制或禁止的标志、物体或设备;
“私家小巴”(private light bus) 指作以下用途或拟作以下用途的小型巴士─
(a)出租或取酬以外的用途;或
(b)不论是否以出租或取酬方式运载乘客,但该等乘客全属─ (1984年第196号法律公告)
(i)一所教育机构的学生、教员及雇员;或
(ii)伤残人士及受雇协助该等伤残人士的人;“私家巴士”(private bus) 指作以下用途或拟作以下用途的巴士─
(a)出租或取酬以外的用途;或

“车辆总重”(gross vehicle weight) 就车辆而言,指由该车辆所有车轮传送到路面的重量总和;如有拖车,亦包括拖车加诸拖曳车辆的任何重量;而车辆的“许可车辆总重”(permitted gross vehicle weight),则指就某一种类车辆而订明的最高车辆总重; (1984年第196号法律公告)
“的士”(taxi) 指根据《道路交通条例》(第374章)登记为的士的汽车; (1982年第75号第114条)
“拖车”(trailer) 指并非由机械驱动,而是由汽车或拟由汽车拖曳的车辆,包括任何半拖车或挂车;
“特别用途车辆”(special purpose vehicle) 指经设计、构造或改装为主要在道路上作并非属运载货物、驾驶人或乘客的用途的汽车; (1984年第196号法律公告)
“货车”(goods vehicle) 指经构造或改装为主要作运载货物之用的汽车或拖车,但不包括机动三轮车或电单车(不论是否附有侧车);
“单车”(bicycle) 指经设计及构造为使用踏板驱动的两轮车辆;
“伤残者车辆”(invalid carriage) 指经特别设计与构造,专供身体上有缺陷或伤残人士使用的汽车;
“道路标记”(road marking) 指放置或装嵌于路面的条、字、标记或设备,以向道路使用者传达警告、资料、规定、限制、禁止或指示;
“机动三轮车”(motor tricycle) 指具有三轮的汽车,但不包括附有侧车的电单车;
“隧道费收费亭”(toll booth) 指建立在隧道行车入口或出口,用作收取隧道费的构筑物。 (1993年第300号法律公告)
(2)尽管第(1)款已有规定,在附表2的适用于海底隧道的隧道费收费表中所述的车辆类别,在《道路交通条例》(第374章)第2条所述的汽车定义及种类适用于该车辆类别的范围内,须按照该等定义及种类解释。 (1999年第44号第32条)

第368A章 第3条订明的标志及道路标记
第II部
交通管制
(1)为规管与管制交通,监督可致使或允许在任何隧道展示─
(a)附表1订明的第1至11号图形以及第14号图形所示类型的任何交通标志; (1986年第212号法律公告;1993年第300号法律公告)
(b)在《道路交通(交通管制)规例》(第374章,附属法例)订明的任何交通标志或道路标记。 (1984年第196号法律公告)(1A)在不损害第(1)款的原则下,监督为规管与管制交通,可致使或允许在海底隧道展示附表1订明的第15至23号图形所示类型的任何交通标志。 (1999年第49号第4条)
(2)监督可更改附表1所订明的交通标志上的任何数字或任何箭嘴的方向,使该交通标志适合隧道的特别环境。
(3)根据第(1)(a)或(1A)款展示的任何交通标志,直至相反证明成立,须推定为合法地如此展示。 (1999年第49号第4条)
(4)交通标志如已根据第(2)款更改,或与附表1所订明的交通标志大小、颜色类型稍有不同,只要该交通标志的整体外观不会因上述情况而有重要破损,则并不因此而妨碍该交通标志被视为该附表所订明的交通标志。
(5)附表1所订明的交通标志的涵义及指示,须与该附表所订明的该交通标志及其有关注释相符。
(6)在任何隧道内的车辆驾驶人须遵守根据第(1)款在隧道展示的下列指示─
(a)附表1所订明的第1至6号图形、第10、11、14及15至23号图形所示类型的任何交通标志; (1993年第300号法律公告;1999年第49号第4条)

第368A章 第3A条灯号
当驾驶人驾车进入海底隧道隧道区或在海底隧道隧道区前进,而在其车辆所行驶的行车之内或之上朝他展示的交通灯号─
(a)如正亮起绿灯,他须沿该行车前进;
(b)如正亮起红灯,他须在安全情况下尽快停车;
(c)如正闪动琥珀灯,他须小心沿该行车前进,并准备按情况所需而停车。

第368A章 第4条临时最高速度限制
(1)除根据第3(1)条指明或根据第3(2)条更改用以订定速度限制的任何交通标志外,监督如认为将会或相当可能会出现暂时性危及公众或损害隧道的情况,可无须通知而随时展示其认为适当的交通标志,订定车辆使用该隧道的临时最高速度限制。
(2)如隧道已订定临时最高速度限制,而有关交通标志亦已根据第(1)款展示,则任何人不得在该隧道内驾驶车辆超逾该最高速度。
第368A章 第5条指导性标志及道路标记
在不损害第3条的原则下,监督可致使或允许在任何隧道展示其认为适当的标志或道路标记,以向使用该隧道的人作出指导或提供资料。
第368A章 第6条车辆进出
除监督或经营人为车辆进出任何隧道而提供与指示的地方外,任何人或车辆均不得经由其他地方进出隧道。

第368A章 第7条隧道的关闭
(1)监督可无须通知而随时关闭隧道或其任何部分或行车,以禁止所有车辆或其指明种类或类别的车辆使用。 (1991年第251号法律公告)
(2)经营人未得监督事先批准,或无合理辩解,不得关闭或局部关闭隧道,以禁止公众使用。 (1991年第251号法律公告)
(3)每当为公共秩序或为使用隧道的人或于隧道内受雇的人的安全起见,又或因任何其他理由,监督觉得关闭或局部关闭隧道以禁止公众使用是合理地需要的或合宜的,监督可指示经营人关闭或局部关闭隧道以禁止公众使用,而经营人须遵从该指示。 (1991年第251号法律公告)
(4)每当未得监督批准或指示而实施关闭,经营人须在切实可行范围内尽快将该关闭一事通知监督。 (1991年第251号法律公告)
第368A章 第8条交通限于在左边行车线行车
除获授权人员另有指示或发出讯号外,以下车辆只可在隧道的左边行车行驶─
(a)巴士;
(b)许可车辆总重超逾5.5公吨的货车; (1984年第196号法律公告)
(c)根据第11A(2)条须有许可或根据第14条须领取许可证的车辆;及 (1999年第49号第6条)
(d)拖曳另一车辆的车辆。
第368A章 第9条一般限制
(1)除非获授权人员有所指示或发出讯号,或除非遵守根据本规例展示的任何交通标志的指示,否则任何人均不得在隧道内─ (1999年第49号第7条)
(a)驾驶任何前灯亮远射光的车辆;
(b)以低于每小时25公里的速度驾驶任何车辆,除非受其他车辆阻碍,或正处于隧道费收费亭或其他无可避免须以低速驾驶的地方; (1984年第196号法律公告)
(c)将任何车辆停下或允许任何车辆停留不动,除非─
(i)被合法地要求这样做;
(ii)受意外、故障、紧急事故或在场其他停留不动的车辆所迫使而这样做;(d)(由1999年第49号第7条废除)
(e)非因按照第(2)款或非因紧急事故或非因召援而下车; (1999年第49号第7条)
(f)使用响号、警报器、哨子或其他发声设备;
(g)致使或允许车辆横过任何标记在路面的连续双;
(h)将车辆掉头或倒车;
(i)为车辆更换轮胎或车轮,或加油或进行修理;或
(j)以人手或其他方式推动车辆,藉以驱动该车辆。(2)任何人除非在以下情况下,否则不得徒步进入任何隧道区或在其内任何部分停留─
(a)他按照获授权人员所发出的指示或讯号而如此行事;
(b)他按照任何条例而如此行事;
(c)他是公职人员而为适当执行职责须如此行事;
(d)他获监督授权如此行事;
(e)他正上落任何专利巴士,或正前往或离开任何巴士站,或正在任何巴士站等候专利巴士。 (1999年第49号第7条)
第368A章 第10条一般禁止
任何人不得在任何隧道内驾驶任何以下车辆,或致使或允许任何以下车辆在隧道内驾驶,或致使任何以下车辆停留在任何隧道内─
(a)单车、伤残者车辆、机动三轮车、三轮车或人力车;
(b)油箱没有装载足够汽油供驶过隧道的车辆;
(c)运载没有适当控制或约束的动物或家禽的车辆,或运载没有充分遮盖的垃圾、干草、稻草或微细物或同类物料的车辆;
(d)没有将负载物或负载物的覆盖物适当地固定,以避免该覆盖物或该负载物的任何部分掉下,或触及道路、隧道构筑物或其装配或固定附物的车辆;
(e)载有站在车辆外部或坐着而身体有任何部分伸出车旁或车尾的人的车辆;
(f)驾驶人的前方或旁边视线被阻或相当可能被阻的车辆;
(g)将会或相当可能会触及隧道构筑物或其装配或固定附物的车辆;或
(h)将会或相当可能会危及人或财产,或使到隧道的使用不安全的车辆。
第368A章 第11条对运载危险品车辆的禁止
(1)除第(2)款另有规定外,任何人不得在任何隧道内驾驶任何以下车辆,或致使或允许任何以下车辆在任何隧道内驾驶,或致使任何以下车辆停留在任何隧道内─
(a)运载任何《危险品(类别)规例》*(第295章,附属法例,1983年编正版)附表第1类别所提述的货品的车辆;
(b)运载任何《危险品(类别)规例》*(第295章,附属法例,1983年编正版)附表第2类别所提述的货品的车辆,但如《危险品(一般)规例》(第295章,附属法例)第74条列表第2栏对此类货品的数量有所指明,而该车辆所运载的货品不超逾该数量,则不在此限;
(c)在不损害(b)段的原则下,运载任何用作或将用作贮存《危险品(类别)规例》*(第295章,附属法例,1983年编正版)附表第2类别所提述的压缩气体的气瓶(《危险品(一般)规例》(第295章,附属法例)第61条所界定的气瓶)的车辆,不论该等气瓶是否盛载任何数量的此类气体;
(d)运载任何《危险品(类别)规例》*(第295章,附属法例,1983年编正版)附表第5类别所提述的货品的车辆,但如《危险品(一般)规例》(第295章,附属法例)第99条列表第7或8栏对此类货品的数量有所指明,而该车辆所运载的货品不超逾该数量,则不在此限;或
(e)在不损害(d)段的原则下,经构造或改装以运载《危险品(类别)规例》*(第295章,附属法例,1983年编正版)附表第5类别所提述的货品的车辆,或运载用作或将用作贮存此类货品的盛器的车辆,不论该等车辆或盛器是否盛载任何数量的此类货品。(2)即使第(1)款已有规定,本条并不禁止─
(a)车辆在隧道内运载仅为驱动该车辆本身而载于其燃料箱内的燃料; (1997年第482号法律公告)
(aa)(就仅为驱动车辆本身而在其燃料箱内载有汽油的车辆而言)车辆在隧道内运载该车辆上所载作以上用途的汽油,但该等汽油不得超过20升,并须存于密封的罐内;或 (1997年第482号法律公告)
(b)车辆在隧道内运载汽油,以补充加油设施,供与隧道有关的当值车辆之用。___________________________________________________________________________

第368A章 第11A条海底隧道内运载危险品车辆
(1)在符合本条的规限下,海底隧道的经营人可订定时段,让本条所适用的所有或任何车辆在该等时段内进入海底隧道隧道区。
(2)除获经营人许可外,任何人不得驾驶本条所适用的任何车辆进入海底隧道隧道区;有关许可须受以下条件规限─
(a)如已根据第(1)款就该车辆所属类别的车辆订定时段,则该许可只在该等时段适用;
(b)掌管车辆的人,或负责运载车辆内或车辆上任何货品的人,须向经营人作出有关车辆及货品性质的书面声明;及
(c)经营人可派出获授权人员护送车辆通过海底隧道隧道区,并可采取他认为于个别情况下属适宜的任何其他预防措施。(3)本条适用于─
(a)运载《危险品(适用及豁免)规例》(第295章,附属法例)附表第3至10类(第5类除外)所指明的任何货品的车辆;
(b)运载大量火柴、放射性物质或对人类或动物生命有危险的生物样本的车辆。

第368A章 第12条隧道费
第III部
隧道费、移走费、许可证及豁免
(1)附表2就任何车辆使用该附表所指明的隧道而指明的适当隧道费,须由有关车辆的驾驶人于监督或经营人就此用途而设置的隧道费收费亭缴付。 (1991年第251号法律公告)
(2)除第(3)款另有规定外,任何人均不得驾驶车辆通过─
(a)并非自动收费亭的隧道费收费亭,除非─
(i)他在收费亭停车,并为该车辆向在收费亭当值的隧道费收费员缴付适当的隧道费;
(ii)他在收费亭停车,并向在收费亭当值的隧道费收费员缴交由监督认可适用于该车辆的隧道费代用券;或
(iii)他在收费亭停车,并向在收费亭当值的隧道费收费员提交由监督所发给,显示该车辆无须缴付适当隧道费而可获准通过隧道的书面批准;或(b)自动收费亭,除非为该车辆而缴付的适当隧道费是记入一个电子隧道费代用证持有人根据第12A条向监督或隧道经营人开立的户口的借方内的。 (1993年第300号法律公告)(3)第(2)(a)款不适用于第14(1)或(1A)条所指明的类别的车辆,但此类车辆须缴付的隧道费可按照监督所指示的方式缴付。 (1993年第300号法律公告;1999年第49号第9条)
第368A章 第12A条自动收费设施
(1)监督可致使或允许在他所批准的隧道费收费亭安装自动收费设施,以收取使用隧道所须缴付的隧道费,亦可致使或允许安装他所批准的附属设施。
(2)监督或经营人可在根据第(1)款批准的隧道费收费亭竖立附表1订明的第14号图形所示的交通标志,以指定该隧道费收费亭为自动收费亭。
(3)监督或经营人为通知自动收费亭的使用者,可致使或允许在该自动收费亭展示附表1订明的第12及13号图形所示的类型的任何交通标志。
(4)监督或经营人可向于监督或经营人(视属何情况而定)处开立户口的人发出电子隧道费代用证,以供其缴付发出电子隧道费代用证所关乎的车辆通过隧道的适当隧道费。

第368A章 第13条移走引起阻塞的车辆等的费用
凡根据本条例第15条移走在隧道内引起阻塞的车辆或物件,监督可要求该车辆的车主或该物件的拥有人缴付附表2就该隧道而指明的移走费(如有的话)。

第368A章 第14条须有许可证的车辆
(1)任何人不得在隧道内驾驶以下车辆─
(a)阔度(包括任何负载物及车辆上的任何附置的装备)超逾2.5米的车辆; (1984年第196号法律公告)
(b)长度(包括任何负载物及车辆上的任何附置的装备)超逾12米的车辆; (1984年第196号法律公告)
(c)正拖曳其他车辆的车辆;或
(d)正牵拉拖车,而车辆及拖车(包括牵引杆及任何负载物)的总长度超逾16米的车辆, (1984年第196号法律公告)但如上述车辆按照监督就该车辆而发出的许可证所订定的条件驶过隧道,则属例外。
(1A)任何人不得在海底隧道隧道区内驾驶以下车辆─
(a)高度(包括负载物)超逾4.6米的车辆;或
(b)车轮负荷超逾4.5公吨或车轴负荷超逾11公吨的车辆,但如上述车辆按照监督就该车辆而发出的许可证所订定的条件驶过隧道,则属例外。 (1999年第49号第10条)
(2)此类许可证须受监督所施加的条件规限。
(3)在不损害第(2)款的概括性的原则下,监督可要求根据本条获发给许可证的车辆,须在监督所提供的护送车辆陪同下,方可驶过隧道。
(4)除非因紧急事故,否则许可证的申请须于拟通过隧道前最少48小时作出,并须包含以下详情─
(a)车辆及其负载物的详细资料;及
(b)拟通过隧道的时间、日期及方向。(5)附表2就任何隧道而指明的许可证费(如有的话),须于准许任何车辆通过该隧道的许可证发出时缴付。 (1999年第44号第34条)
(6)获发给许可证以通过隧道的车辆的驾驶人,于获授权人员要求时,须立即出示该许可证以供查阅。
第368A章 第15条豁免
(1)运载当值获授权人员的车辆,得获豁免受第3(6)、3A、4(2)、6、8(d)及14(1)(c)条规限。
(2)消防车辆、救护车、警车及作防用途的车辆,包括民防用途的车辆,在执行紧急任务时,须免受第10(e)及(f)、11及11A条规限。

第368A章 第15A条有关公共及私家巴士的过渡性条文
即使在本规例中(本条除外)有任何规定,凡经构造或改装为运载15或16名乘客的汽车,并于《1988年道路交通(修订)(第3号)条例》*(1988年第89号)生效日期前已登记为私家巴士或公共巴士者,须被当作私家巴士或公共巴士(视何者适合而定)。

第368A章 第16条保留条文
于紧接本规例实施前,已根据《狮子山隧道规例》+(第140章,附属法例,1978年编正版)竖立于狮子山隧道内,而当时亦符合《狮子山隧道规例》+(第140章,附属法例,1978年编正版)规定的任何标志,只要继续符合该规定,即须当作具有犹如《狮子山隧道条例》@(第140章,1974年版)未被废除一样的效力。

第368A章 第17条杂项罪行
任何人不得在任何隧道内─
(a)准许动物处于其中,除非该动物是在车辆之内;
(b)髹上或张贴,或安排髹上或张贴任何海报、标语牌、招贴、广告或其他物品,但获得监督准许则属例外;或 (1991年第251号法律公告)
(c)干扰任何交通标志、行车标记、灯号、电话或其他装配或固定附物。
第368A章 第18条罪行及罚则
(1)任何人违反第3A、4(2)、6、8、9、10、11(1)、11A(2)、12(2)、14(1)、(1A)或(6)或17条的任何条文,即属犯罪,可处罚款$5000及监禁6个月。 (1986年第212号法律公告)
(2)任何人在任何隧道内驾驶车辆时,没有遵守附表1订明的第1至6、15、16及22号图形所示类型并根据第3(1)条展示于隧道的任何交通标志的指示,即属犯罪,可处罚款$5000及监禁6个月。 (1986年第212号法律公告)
(3)任何人在任何隧道内驾驶车辆时,没有遵守附表1订明的第10、11、14或21号图形所示类型并根据第3(1)条展示于隧道的任何交通标志的指示,即属犯罪,可处罚款$1000。 (1986年第212号法律公告;1993年第300号法律公告)
(4)任何人在任何隧道内驾驶车辆时,没有遵守《道路交通(交通管制)规例》(第374章,附属法例)所订明并根据第3(1)条展示于隧道的任何交通标志或道路标记的指示,即属犯罪,可处罚款$5000及监禁3个月。 (1986年第212号法律公告)

第368A章 第19条经营人的权力
经营人可按监督所指明的条款及条件,行使监督根据第3(1)、(1A)及(2)、3A、4、5、11A、12(3)、13及14(1)、(1A)、(2)及(3)条获授予的权力。

第368A章 附表1标志

第1号图形
行车讯号
本标志如展示在一条与其有关的行车上方时,对正在该行车上行驶的交通中的车辆所传递的讯息,为车辆可在该行车朝与箭嘴标志背向的方向,在该箭嘴下面或超越该箭嘴行驶或继续行驶。本标志亦可用于隧道费收费亭,以显示车辆可在该行车上行驶。
第2号图形
行车讯号
本标志如展示在一条与其有关的行车上方时,对正在该行车上行驶的交通中的车辆所传递的讯息,为车辆不得在该条行车朝与红色交叉标志背向的方向,在该红色交叉下面或超越该红色交叉行驶。本标志亦可用于隧道费收费亭,以显示车辆不得在该行车上行驶。
第3号图形
向右或靠右行驶
箭嘴可转至相反的方向,以显示─
向左或靠左行驶
本标志显示车辆必须驶往右手边行车,如箭嘴转至相反的方向,则必须驶往左手边行车。
第4号图形
行车讯号
本讯号可在隧道区内垂直放置或横放于行车的上方或旁边,以管制沿本讯号位于其上方或旁边的有关行车行驶的车辆,但当讯号放置于行车上方时,绿色箭嘴须指向下方。
本讯号的意义如下:─
(i)绿色箭嘴如展示在一条与其有关的行车的上方或旁边,在该行车上行驶的交通中的车辆可沿该行车行驶。
(ii)固定或间歇琥珀灯光如展示在一条与其有关的行车的上方或旁边,在该行车行驶的交通中的车辆须沿该行车小心行驶,并准备停车;但任何讯号装置,如包含能显示红色交叉的灯光及能显示绿色箭嘴的灯光,即可不设琥珀灯光。
(iii)红色交叉如展示在一条与其有关的行车的上方或旁边,在该行车行驶的交通中的车辆,不得在该红色交叉下面或超越该红色交叉行驶,或驶过该红色交叉。
本讯号可用于隧道费收费亭。
第5号图形
不准换
本标志显示车辆必须保持在原。
第6号图形
禁止危险品
本标志显示运载指定类别危险品的车辆,禁止越过本标志。
本标志可连同第7号图形所示的标志使用。
第7号图形
本标志连同第6号图形所示的标志使用时,显示该图形所提述的危险品类别。
第8号图形
隧道区
本标志显示《行车隧道(政府)条例》及《行车隧道(政府)规例》所施加的禁止及限制所适用的区域的起点。
第9号图形
隧道区终点
本标志显示《行车隧道(政府)条例》及《行车隧道(政府)规例》所施加的禁止及限制所适用的区域的终点。
第10号图形
不设找赎标志
本标志于隧道费收费亭展示时,显示该隧道费收费亭只供缴付标志上所显示的准确隧道费而不需找赎的驾驶人使用。
标志所示的隧道费可以更改,以适应个别情况。

PART I
PRELIMINARY
These regulations may be cited as the Road Tunnels (Government) Regulations.
Cap 368A reg 2 Interpretation
(1) In these regulations, unless the context otherwise requires- (44 of 1999 s. 32; 49 of 1999 s. 3)
'autotoll booth' (自动收费亭) means a toll booth equipped with an automatic toll collection facility approved by the Authority under regulation 12A; (L.N. 300 of 1993)
'bicycle' (单车) means a vehicle with 2 wheels designed and constructed to be propelled by the use of pedals;
'bus' (巴士) means a motor vehicle constructed or adapted for the carriage of more than 16 passengers and their personal effects; (89 of 1988 s. 6)
'goods vehicle' (货车) means a motor vehicle, or trailer, which is constructed or adapted for use primarily for the carriage of goods, but does not include a motor tricycle or a motor cycle with or without a sidecar attached thereto;
'gross vehicle weight' (车辆总重), in relation to a vehicle, means the sum of the weights transmitted to the road surface by all the wheels of the vehicle and includes, in the case of a trailer, any weight of the trailer imposed on the drawing vehicle, and the 'permitted gross vehicle weight' (许可车辆总重) of a vehicle means the maximum gross vehicle weight prescribed for a vehicle of its class; (L.N. 196 of 1984)
'invalid carriage' (伤残者车辆) means a motor vehicle especially designed and constructed for the sole use of a person suffering from physical defects or disabilities;
'light bus' (小型巴士) means a motor vehicle constructed or adapted for use solely for the carriage of a driver and not more than 16 passengers and their personal effects, but does not include an invalid carriage, motor cycle, motor tricycle, private car or taxi; (L.N. 196 of 1984; 89 of 1988 s. 6; 19 of 2004 s. 7)
'motor tricycle' (机动三轮车) means a three-wheeled motor vehicle other than a motor cycle with a sidecar;
'private bus' (私家巴士) means a bus used or intended for use-
(a) otherwise than for hire or reward; or
(b) for the carriage of passengers who are exclusively- (L.N. 196 of 1984)
(i) the students, teachers and employees of an educational institution; or
(ii) disabled persons and persons employed to assist them,
whether or not for hire or reward;'private car' (私家车) means a motor vehicle constructed or adapted for use solely for the carriage of a driver and not more than 7 passengers and their personal effects but does not include an invalid carriage, motor cycle, motor tricycle or taxi;
'private light bus' (私家小巴) means a light bus used or intended for use-
(a) otherwise than for hire or reward; or
(b) for the carriage of passengers who are exclusively- (L.N. 196 of 1984)
(i) the students, teachers and employees of an educational institution; or
(ii) disabled persons and persons employed to assist them,
whether or not for hire or reward;'public bus' (公共巴士) means a bus, other than a private bus, which is used or intended for use for hire or reward;
'public light bus' (公共小巴) means a light bus, other than any private light bus, which is used or intended for use for hire or reward;
'road marking' (道路标记) means a line, word, mark or device placed on, or set into, the surface of a road for conveying to persons using the road any warning, information, requirement, restriction, prohibition or direction;
'special purpose vehicle' (特别用途车辆) means a motor vehicle designed, constructed or adapted primarily for a use other than the carriage on a road of goods, the driver or passengers; (L.N. 196 of 1984)
'taxi' (的士) means a motor vehicle registered as a taxi under the Road Traffic Ordinance (Cap 374); (75 of 1982 s. 114)
'toll booth' (隧道费收费亭) means a structure erected at the entrance to, or exit from, a traffic lane in a tunnel for the purpose of collecting tolls; (L.N. 300 of 1993)
'traffic sign' (交通标志) means any sign, object or device for conveying to persons using a road any warning, information, direction, requirement, restriction or prohibition;
'trailer' (拖车) means a vehicle which is not mechanically propelled and is towed or intended for towing by a motor vehicle, including any semi-trailer or draw bar trailer;
'tricycle' (三轮车) means a vehicle with 3 wheels propelled by the use of pedals. (L.N. 196 of 1984)
(2) Notwithstanding paragraph (1), the description of a vehicle mentioned in the table of tolls for the Cross-Harbour Tunnel in the Second Schedule shall be interpreted in accordance with the definitions and classes of motor vehicles mentioned in section 2 of the Road Traffic Ordinance (Cap 374), in so far as they are applicable to such description. (3) Notwithstanding paragraph (1), a reference to goods vehicles in the Second Schedule in relation to the Cross-Harbour Tunnel shall be construed to include a reference to special purpose vehicles of the respective weights as specified therein. (49 of 1999 s. 3; L.N. 29 of 2004)
Cap 368A reg 3 Prescribed signs and road markings
PART II
TRAFFIC CONTROL
(1) The Authority for the purposes of regulating and controlling traffic may cause or permit to be displayed at any tunnel-
(a) any traffic sign of the type shown in any of the Figure Nos. 1 to 11 inclusive and 14 prescribed in the First Schedule; (L.N. 212 of 1986; L.N. 300 of 1993)
(b) any traffic sign or road marking prescribed by the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg. G). (L.N. 196 of 1984)(1A) Without prejudice to paragraph (1), the Authority for the purposes of regulating and controlling traffic may cause or permit to be displayed at the Cross-Harbour Tunnel any traffic sign of the type shown in any of the Figure Nos. 15 to 23 inclusive prescribed in the First Schedule. (2) The Authority may vary any figures or the direction of any arrow on a traffic sign prescribed in the First Schedule to adapt such traffic sign to the particular circumstances of any tunnel.
(3) Any traffic sign displayed under paragraph (1)(a) or (1A) shall, until the contrary is proved, be presumed to be lawfully so displayed. (49 of 1999 s. 4)
(4) The fact that a traffic sign has been varied under paragraph (2) or differs slightly in size, colour of type from a traffic sign prescribed in the First Schedule shall not prevent the traffic sign from being treated as a traffic sign prescribed in that Schedule so long as the general appearance of the traffic sign is not thereby materially impaired.
(5) The meaning and indication of a traffic sign prescribed in the First Schedule shall be in accordance with such traffic sign and the note relating thereto in that Schedule.
(6) The driver of a vehicle in any tunnel shall conform to the indication of-
(a) any traffic sign of the type shown in any of the Figure Nos. 1 to 6 inclusive, 10, 11, 14 and 15 to 23 inclusive prescribed in the First Schedule; (L.N. 300 of 1993; 49 of 1999 s. 4)
(b) any traffic sign or road marking prescribed by the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.),displayed at a tunnel under paragraph (1). (L.N. 212 of 1986)
Cap 368A reg 3A Signal Lights
When a driver of a vehicle enters or proceeds through the tunnel area of the Cross-Harbour Tunnel and a traffic signal light facing him in or above the lane in which he is travelling displays-
(a) green, he shall proceed along that lane;
(b) red, he shall stop his vehicle as rapidly as is safe in the circumstances;
(c) flashing amber, he shall proceed along that lane with caution and be prepared to stop when the circumstances so require.

Cap 368A reg 4 Temporary maximum speed limits
(1) In addition to any traffic sign specified under regulation 3(1) or varied under regulation 3(2) fixing a speed limit, the Authority where it considers that a temporary risk of danger to the public or of damage to a tunnel will or is likely to arise may, at any time and without notice, display such traffic sign as it may think appropriate for the purpose of fixing a temporary maximum speed limit for vehicles using that tunnel.
(2) No person shall drive a vehicle in a tunnel where a temporary maximum speed limit is fixed and a traffic sign in respect thereof is displayed under paragraph (1), at a speed in excess of the maximum so fixed.
Cap 368A reg 5 Advisory signs and road markings
Without prejudice to regulation 3, the Authority may cause or permit to be displayed at any tunnel, such signs or road markings as it may think appropriate for the giving of advice and information to persons using that tunnel.
Cap 368A reg 6 Access for vehicles
No person or vehicle shall enter or leave any tunnel otherwise than at such places as may be provided and indicated for that purpose by the Authority or an operator.

Cap 368A reg 7 Closure of tunnel
(1) The Authority may, at any time and without notice, close a tunnel or any part or lane thereof to all vehicles or to vehicles of such class or description as he may specify.
(2) An operator shall not close or partially close a tunnel to the use of the public without prior approval of the Authority or without reasonable excuse.
(3) The Authority may direct an operator to close or partially close a tunnel to the use of the public whenever such closure appears to him to be reasonably necessary or expedient for public order, for the safety of persons using or employed in the tunnel or for any other reasons and the operator shall comply with that direction.
(4) Whenever a closure is effected without the approval or direction of the Authority, an operator shall notify the Authority as soon as practicable of the closure.

Cap 368A reg 8 Traffic confined to left-hand lanes
The following vehicles shall, except when otherwise directed or signalled by an authorized officer, be driven only in the nearside of the lanes of a tunnel-
(a) a bus;
(b) a goods vehicle of a permitted gross vehicle weight exceeding 5.5 tonnes; (L.N. 196 of 1984)
(c) a vehicle requiring permission under regulation 11A(2) or a permit under regulation 14; and (49 of 1999 s. 6)
(d) a vehicle towing another vehicle.
Cap 368A reg 9 General restrictions
(1) No person shall in any tunnel unless directed or signalled by an authorized officer or unless conforming to the indication of any traffic sign displayed under these regulations- (49 of 1999 s. 7)
(a) drive any vehicle with its headlights illuminated on full beam;
(b) drive any vehicle at a speed of less than 25 kilometres per hour except where prevented by another vehicle or at a toll booth and other places where a lesser speed is unavoidable; (L.N. 196 of 1984)
(c) stop any vehicle or permit it to be stationary save when-
(i) lawfully required to do so;
(ii) compelled to do so by reason of accident, breakdown, emergency or the presence of other stationary vehicles;(d) (Repealed 49 of 1999 s. 7)
(e) alight from a vehicle save in accordance with paragraph (2) or in the event of an emergency or to summon assistance; (49 of 1999 s. 7)
(f) use any horn, siren, whistle or other noise making device;
(g) cause or permit a vehicle to cross any continuous double lines marked on the surface of a road;
(h) make any U turn with or reverse a vehicle;
(i) change a tyre or wheel on, or refuel or repair a vehicle; or
(j) propel a vehicle by pushing it, whether manually or by other means.(2) No person shall enter or remain in any part of a tunnel area on foot unless he-
(a) is directed or signalled by an authorized officer to do so;
(b) does so in accordance with any Ordinance;
(c) is a public officer and needs to do so in the due execution of his duties;
(d) has been authorized to do so by the Authority;
(e) is boarding or alighting from a franchised bus, or proceeding to or from a bus stop or waiting for a franchised bus at a bus stop. (49 of 1999 s. 7)
Cap 368A reg 10 General prohibitions
No person shall drive or cause or permit to be driven in or cause to remain in any tunnel any of the following vehicles-
(a) a bicycle, invalid carriage, motor tricycle, tricycle or rickshaw;
(b) a vehicle which is not carrying sufficient fuel in its fuel tank to enable it to be driven through;
(c) a vehicle carrying animals or poultry not properly controlled or confined, or carrying garbage, hay, straw or fine particles or similar materials which are not sufficiently covered;
(d) a vehicle with a load, or the cover of a load, not properly secured so as to prevent such cover or any part of the load from falling off or coming into contact with the road, the tunnel structure or its fittings or fixtures;
(e) a vehicle carrying a person standing on the outside of the vehicle or seated with any part of his person overhanging the sides or rear of the vehicle;
(f) a vehicle in which the driver's view to the front or sides is or is likely to be obscured;
(g) a vehicle which will or is likely to come into contact with the tunnel structure or its fittings or fixtures; or
(h) a vehicle which will or is likely to endanger persons or property or render the use of the tunnel unsafe.
Cap 368A reg 11 Prohibition against vehicles conveying dangerous goods
(1) Subject to paragraph (2) no person shall drive or cause or permit to be driven in or cause to remain in any tunnel any of the following vehicles-
(a) a vehicle carrying any of the goods referred to in Category 1 of the Schedule to the Dangerous Goods (Classification) Regulations (Cap 295 sub. leg., 1983 R. Ed.);
(b) a vehicle carrying any of the goods referred to in Category 2 of the Schedule to the Dangerous Goods (Classification) Regulations (Cap 295 sub. leg., 1983 R. Ed.) unless there is a quantity specified in relation to such goods in the second column of the Table to regulation 74 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.) and the goods carried do not exceed that quantity;
(c) without prejudice to sub-paragraph (b) a vehicle carrying any cylinders (as defined in regulation 61 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.)) used or to be used for the storage of compressed gas referred to in Category 2 of the Schedule to the Dangerous Goods (Classification) Regulations (Cap 295 sub. leg., 1983 R. Ed.), whether or not such cylinders contain any quantity of such gas;
(d) a vehicle carrying any of the goods referred to in Category 5 of the Schedule to the Dangerous Goods (Classification) Regulations (Cap 295 sub. leg., 1983 R. Ed.) unless there is a quantity specified in relation to such goods in the seventh or eighth column of the Table to regulation 99 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.) and the goods carried do not exceed that quantity; or
(e) without prejudice to sub-paragraph (d) a vehicle constructed or adapted for the conveyance, or a vehicle carrying a container used or to be used for the storage, of goods referred to in Category 5 of the Schedule to the Dangerous Goods (Classification) Regulations (Cap 295 sub. leg., 1983 R. Ed.), whether or not such vehicle or container contains any quantity of such goods.(2) Notwithstanding paragraph (1), nothing in this regulation shall prohibit-
(a) the conveyance in a tunnel of fuel which is being carried in the fuel tank of a vehicle for the purpose only of the propulsion of the vehicle; (L.N. 482 of 1997)
(aa) in the case of a vehicle carrying in its fuel tank petroleum spirit for the purpose only of its propulsion, the conveyance in a tunnel by the vehicle of petroleum spirit, up to a maximum of 20 litres in securely closed cans, which is being carried on the vehicle for such purpose; or (L.N. 482 of 1997)
(b) the conveyance in a tunnel of petroleum spirit which is being carried in a vehicle for the purposes of replenishing refuelling facilities for vehicles employed on duty relating to a tunnel.
Cap 368A reg 11A Vehicles conveying dangerous goods in the Cross-Harbour Tunnel
(1) Subject to this regulation, the operator of the Cross-Harbour Tunnel may fix the hours during which all or any of the vehicles to which this regulation applies may enter the tunnel area of the Cross-Harbour Tunnel.
(2) No person shall drive a vehicle to which this regulation applies into the tunnel area of the Cross-Harbour Tunnel except with the permission of the operator, which permission, if granted, shall be subject to the following conditions-
(a) if hours have been fixed under paragraph (1) in respect of the class of vehicle concerned, the permission shall relate only to those hours;
(b) a declaration shall be made in writing to the operator by the person in charge of the vehicle, or by the person responsible for the conveyance of any goods therein or thereon, as to the nature of the vehicle and goods; and
(c) the operator may provide authorized officers for the purpose of escorting the vehicle through the tunnel area of the Cross-Harbour Tunnel and may take any other precautionary measure which he deems expedient in the circumstances.(3) This regulation applies to-
(a) a vehicle conveying any of the goods in Categories 3 to 10 in the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.), other than Category 5;
(b) a vehicle conveying matches in bulk, radioactive substances, or biological specimens dangerous to human or animal life.

Cap 368A reg 12 Tolls
PART III
TOLLS, REMOVAL FEES, PERMITS AND EXEMPTIONS
(1) The appropriate toll specified in the Second Schedule in respect of the use of a tunnel therein specified by any vehicle shall be payable by the driver of such vehicle at a toll booth provided by the Authority or an operator for that purpose. (L.N. 251 of 1991)
(2) Subject to paragraph (3), no person shall drive a vehicle past-
(a) a toll booth other than an autotoll booth unless-
(i) he stops and pays to the toll collector on duty at the booth the appropriate toll for the vehicle;
(ii) he stops and tenders to the toll collector on duty at the booth such toll ticket as may be approved by the Authority appropriate to the vehicle; or
(iii) he stops and tenders to the toll collector on duty at the booth such approval in writing as may be provided by the Authority indicating that the vehicle is allowed passage through a tunnel without payment of the appropriate toll; or(b) an autotoll booth unless the appropriate toll for the vehicle is paid by debiting the account of the holder of an electronic toll pass opened with the Authority or the operator of the tunnel under regulation 12A. (L.N. 300 of 1993)(3) Paragraph (2)(a) shall not apply to a vehicle of the kind specified in regulation 14(1) or (1A), but the toll payable in respect of such a vehicle may be paid in such manner as the Authority may direct. Cap 368A reg 12A Automatic toll collection facilities
(1) The Authority may cause or permit the installation of such automatic toll collection facility at such toll booth as he may approve for the purpose of collecting the tolls payable for the use of a tunnel and may cause or permit the installation of such ancillary facilities as he may approve.
(2) The Authority or an operator may, by erecting a traffic sign shown in Figure No. 14 prescribed in the First Schedule at a toll booth approved under paragraph (1), designate the toll booth as an autotoll booth.
(3) The Authority or an operator for the purpose of informing the users of an autotoll booth may cause or permit to be displayed at the autotoll booth any traffic sign of the types shown in Figure Nos. 12 and 13 prescribed in the First Schedule.
(4) An electronic toll pass may be issued by the Authority or by an operator to a person who opens an account with the Authority or with an operator, as the case may be, for the payment of the toll appropriate to the passage through the tunnel of the description of vehicle in respect of which the electronic toll pass is issued.

Cap 368A reg 13 Fee for removal of vehicles etc. causing obstruction
Where a vehicle or thing causing an obstruction in any tunnel has been removed under section 15 of the Ordinance, the Authority may require the owner of such vehicle or thing to pay the removal fee (if any) specified in the Second Schedule in relation to the tunnel.

Cap 368A reg 14 Vehicles requiring permits
(1) No person shall in any tunnel drive a vehicle-
(a) the width (including any load and any equipment attached to the vehicle) of which exceeds 2.5 m; (L.N. 196 of 1984)
(b) the length (including any load and any equipment attached to the vehicle) of which exceeds 12 m; (L.N. 196 of 1984)
(c) that is towing another vehicle; or
(d) that is drawing a trailer and the combined length of the vehicle and trailer (including drawbar and any load) exceeds 16 m, (L.N. 196 of 1984)other than in accordance with the conditions of a permit issued by the Authority for the passage of that vehicle.
(1A) No person shall drive within the tunnel area of the Cross-Harbour Tunnel a vehicle-
(a) the height of which (including load) exceeds 4.6 m; or
(b) with a wheel-load exceeding 4.5 tonnes or an axle load exceeding 11 tonnes,other than in accordance with the conditions of a permit issued by the Authority for the passage of that vehicle. (49 of 1999 s. 10)
(2) Any such permit shall be subject to such conditions as the Authority may impose.
(3) Without prejudice to the generality of paragraph (2), the Authority may require that a vehicle being the subject of a permit issued under this regulation shall only pass through a tunnel when accompanied by such escort vehicle as the Authority may provide.
(4) Except in case of emergency, application for a permit shall be made not less than 48 hours before the intended passage and shall contain the following particulars-
(a) details of the vehicle and its load; and
(b) the time, date and direction of the proposed passage.(5) The permit fee (if any) specified in the Second Schedule in relation to a tunnel shall be paid on the issue of a permit for the passage of a vehicle through the tunnel. (44 of 1999 s. 34)
(6) The driver of a vehicle in respect of the passage of which a permit has been issued shall immediately when asked for it produce the permit for inspection by an authorized officer.
Cap 368A reg 15 Exemptions
(1) A vehicle which carries an authorized officer who is engaged on duty shall be exempt from regulations 3(6), 3A, 4(2), 6, 8(d) and 14(1)(c).
(2) A fire service vehicle, ambulance, police vehicle and vehicle used for defence purposes, including civil defence purposes shall, if the vehicle is being used in the course of urgent duty, be exempt from regulations 10(e) and (f), 11 and 11A.

Cap 368A reg 15A Transitional provision regarding public and private buses
Notwithstanding anything contained in these regulations apart from this regulation, a motor vehicle constructed or adapted for the carriage of 15 or 16 passengers and registered as a private bus or public bus before the commencement of the Road Traffic (Amendment) (No. 3) Ordinance 1988 (89 of 1988) shall be deemed to be a private bus or public bus, as may be appropriate.

Cap 368A reg 16 Saving
Any sign erected in the Lion Rock Tunnel under the Lion Rock Tunnel Regulations (Cap 140 sub. leg., 1978 Ed.) immediately before the coming into operation of these regulations and then complying with the Lion Rock Tunnel Regulations (Cap 140 sub. leg., 1978 Ed.) shall for so long as it continues to comply therewith be deemed to have the same effect as if the Lion Rock Tunnel Ordinance (Cap 140, 1974 Ed.) had not been repealed.
Cap 368A reg 17 Miscellaneous offences
No person shall in any tunnel-
(a) permit an animal to be therein otherwise than in a vehicle
(b) paint or affix or cause to be painted or affixed any poster, placard, bill, advertisement or other matter except with the permission of the Authority; or (L.N. 251 of 1991)
(c) interfere with any traffic sign, lane marker, light, telephone or other fitting or fixture.

(2) Any person who while driving a vehicle in any tunnel fails to conform to the indication of any traffic sign of the type shown in any of the Figure Nos. 1 to 6 inclusive, 15, 16 and 22 prescribed in the First Schedule and displayed at a tunnel under regulation 3(1) commits an offence and is liable to a fine of $5000 and to imprisonment for 6 months. (3) Any person who while driving a vehicle in any tunnel fails to conform to the indication of any traffic sign of the type shown in Figure No. 10, 11, 14 or 21 prescribed in the First Schedule and displayed at a tunnel under regulation 3(1) commits an offence and is liable to a fine of $1000. (4) Any person who while driving a vehicle in any tunnel fails to conform to the indication of any traffic sign or road marking prescribed by the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) displayed at a tunnel under regulation 3(1) commits an offence and is liable to a fine of $5000 and to imprisonment for 3 months.
