第474C章 第1条释义
导言
在本附例中,除文意另有所指外─
“巴士”(bus) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“中型货车”(medium goods vehicle) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“中间行车”(middle lane) 指收费区内任何道路沿同一行车方向前进的最左的行车与最右的行车之间的行车;
“左边行车”(nearside lane) 指收费区内任何道路沿同一行车方向前进的最左的行车;
“行车”(lane) 的涵义与《规例》中该词的涵义相同;
“全宽度”(overall width) 的涵义与《道路交通(车辆构造及保养)规例》(第374章,附属法例)中该词的涵义相同;
“自动收费亭”(autotoll booth) 指配备运输署署长认可的自动收费设施的使用费收费亭;
“交通标志”(traffic sign) 的涵义与《规例》中该词的涵义相同;
“车辆总重”(gross vehicle weight) 及“许可车辆总重”(permitted gross vehicle weight) 的涵义与《道路交通条例》(第374章)中该两词的涵义相同;
“使用费”(toll) 指公司根据本条例可收取的适当使用费;
“使用费收费亭”(toll booth) 指建立用作收取使用费的构筑物;
“使用费收费员”(toll collector) 指任何由公司授权以收取使用费的人;
“受风车辆”(wind susceptible vehicle) 指全高度超逾1.6米的车辆,亦指电单车或机动三轮车;
“订明交通标志”(prescribed traffic sign) 指大小、设计、颜色及类型由附表所订明的交通标志;
“订明管制灯号”(prescribed light signal) 指大小、设计、颜色及类型由附表所订明的管制灯号;
“重型货车”(heavy goods vehicle) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“专利巴士”(franchised bus) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“《规例》”(regulations) 指根据本条例第17条所订立的规例;
“挂接车辆”(articulated vehicle) 的涵义与《道路交通(车辆构造及保养)规例》(第374章,附属法例)中该词的涵义相同;
“电子代用证”(electronic pass) 指由公司或其代理人根据第18(3)条发出的代用证;
“道路标记”(road marking) 的涵义与《规例》中该词的涵义相同;
“管制灯号”(light signal) 的涵义与《规例》中该词的涵义相同;
“隧道”(tunnel) 的涵义与《规例》中该词的涵义相同;
“隧道区域”(tunnel area) 指在由运输署署长签署并存放于土地注册处的CPS TAP/2号图则上或在任何根据本条例第3(4)条存放的其他图则上,描述和划定为隧道区域的范围,并且包括其毗邻的范围;
“整体式车辆”(rigid vehicle) 的涵义与《道路交通(车辆构造及保养)规例》(第374章,附属法例)中该词的涵义相同;
“总经理”(General Manager) 的涵义与《规例》中该词的涵义相同。
第474C章 第2条适用范围
(1)本附例只在收费区内适用。
(2)公司须在─
(a)收费区的每个入口,放置附表第10号图形所示类型的订明交通标志;
(b)收费区的每个出口,放置附表第11号图形所示类型的订明交通标志。(3)就本附例而言,任何车辆或物件,如有部分在收费区内,即当作在收费区内。
(4)公司须在─
(a)隧道区域的每个入口,放置附表第28号图形所示类型的订明交通标志;
(b)隧道区域的每个出口,放置附表第29号图形所示类型的订明交通标志。(5)就本附例而言,任何车辆或物件,如有部分在隧道区域内,即当作在隧道区域内。
第474C章 第3条豁免
(1)担任香港特别行政区政府公务的人员在执行与收费区有关的职责时,其所乘车辆可获豁免而不受第17条规限。
(2)消防处车辆、救护车、海关车辆、警方车辆或作防务用途(包括民防用途)的车辆,在执行紧急任务时─
(a)其驾驶人及车主获豁免而不受第20(1)(b)(vi)、(x)、(xiv)、(xv)、(xvi)、(xvii)、(xviii)及(xix)条规限;及
(b)其驾驶人获豁免而不受第7及21(1)(a)、(b)、(f)及(h)条规限。(3)第20(1)(b)(xv)、(xvi)、(xvii)或(xviii)条所指明的车辆,在紧急情况下按照总经理所给予的许可移动时,其驾驶人及车主获豁免而不受第20(1)条规限。
第474C章 第4条交通管制
交通管制
所有在收费区内的人须受收费区管理人员的管制及指示所规限。
第474C章 第5条通道
除经公司提供并由交通标志所显示的供进出用的地点外,任何人均不得经其他地点进入或离开收费区,也不得致使或容许任何车辆经其他地点进入或离开收费区。
第474C章 第6条服从收费区管理人员指示
所有在收费区内的人须遵从收费区管理人员在执行其与收费区的管理或交通的管制、限制及安全有关的职责时所发出的指示。
第474C章 第7条速度限制
(1)在不抵触第(2)款的规定下,在收费区内的车辆的驾驶人,不得致使或容许其车辆以超逾附表第6、7、8或9号图形(视属何情况而定)订明的速度限制标志所显示的速度行驶。
(2)凡某订明速度根据本条生效,并准许车辆在收费区内任何道路上以超逾每小时70公里行驶,则中型货车、重型货车或巴士在该道路上行驶的最高速度为每小时70公里。
第474C章 第8条转换行车线
除经收费区管理人员授权或依交通标志而获授权外,车辆驾驶人不得致使或容许其车辆或车辆的任何部分压或驶越或横过将隧道区域及收费区划分为行车的连续双白。
第474C章 第9条交通标志、管制灯号及道路标记的涵义
(1)订明交通标志及订明管制灯号的涵义,以按照附表内该标志或该灯号的内容及与该标志或该灯号的图形有关的注释为准。
(2)《道路交通(交通管制)规例》(第374章,附属法例)及《道路交通(快速公路)规例》(第374章,附属法例)所订明的交通标志、管制灯号或道路标记的涵义,以按照该等规例各附表内该标志、灯号或标记的内容及与该标志、灯号或标记的图形有关的注释为准。
第474C章 第10条遵守交通标志、管制灯号及道路标记
在收费区内的车辆的驾驶人须遵从下述项目所显示的规定─
(a)附表中任何图形所示类型的订明交通标志或订明管制灯号;
(b)《道路交通(交通管制)规例》(第374章,附属法例)及《道路交通(快速公路)规例》(第374章,附属法例)所订明的交通标志、管制灯号或道路标记,而此等标志、灯号及标记为公司认为适合用以规管交通,并由该公司依据《规例》所赋予的权力,在收费区内竖立、放置或以其他方式展示者。
第474C章 第11条在隧道内使用车灯
车辆在隧道内须保持使用车头低灯,车头高灯不得亮。
第474C章 第12条限于在隧道内左边行车线及/或中间行车线行驶的车辆
(1)除收费区管理人员另有指示外,许可车辆总重超逾5.5公吨的货车,只可在隧道内的左边行车或中间行车行驶。
(2)除收费区管理人员另有指示外,以下车辆只可在隧道内的左边行车行驶─
(a)巴士;
(b)根据第21条须领有许可证的车辆;
(c)第22条适用的车辆;或
(d)拖曳另一车辆的车辆。(3)在第(1)款中,“货车”(goods vehicle) 的涵义与《道路交通条例》(第374章)中该词的涵义相同。
第474C章 第13条一般限制
(1)任何人除非是为遵从订明交通标志、订明管制灯号,或遵从收费区管理人员发出的指示,否则不得─
(a)在隧道区域内─
(i)以低于每小时25公里的速度驾驶车辆,但如受另一车辆所阻碍或当时所处之处无可避免须以低于每小时25公里的速度驾驶,则属例外;或
(ii)将车辆掉头或倒车;(b)在收费区(包括隧道区域)内─
(i)将车辆停下或容许车辆停留不动,但在下列情况下则不在此限─
(A)被合法地要求如此做;
(B)因意外、故障、紧急事故或因有其他停留不动的车辆存在而被迫如此做;
(C)就专利巴士而言,在指定的巴士站如此做,而如此做的时间仅为让乘客上车或下车所需者;(ii)下车,但在下列情况下则不在此限─
(A)在紧急情况下或为求助而下车;
(B)为遵从第14条而下车;
(C)如车辆是专利巴士,则在指定的巴士站下车;
(D)正在执行与收费区有关的职责;(iii)更换车辆的车胎或车轮,或为车辆加添燃料或修理车辆;
(iv)拉或推某车辆以拖曳或驱动该车辆,而不论是用人力或其他方法拖曳或驱动;
(v)将车辆驶上行人路;
(vi)作为车辆驾驶人而让车辆无人看顾,但为遵从第14条或在本附例所订明的其他情况下则属例外;
(vii)移动、干扰或故意妨碍交通标志、管制灯号、道路标记或任何设施、设备或装置的运作;或
(viii)使用任何响号、警报器、哨子或其他发声的器件;(c)步行进入收费区。(2)第(1)(b)(iv)款不适用于挂接车辆。
第474C章 第14条车辆发生火警
如任何车辆之上或之内发生火警,车辆驾驶人须─
(a)(如该车辆尚未停留不动)在切实可行范围内尽快将该车辆停下;及
(b)立即离开该车辆,并在安全情况下启动最接近的火警警报器。
第474C章 第15条车辆等造成阻塞
(1)收费区管理人员可将造成阻塞的车辆或物件拖走或移走,有关损失及开支由车辆的车主或物件的拥有人自行承担,而该等车辆或物件可由公司扣留和存放。
(2)公司可就拖走或移走以及存放该等车辆或物件而向有关车主或拥有人追讨费用,该费用为公司不时厘定并经运输署署长书面批准者。
(3)公司根据第(2)款所厘定的费用的一览表,可由公司用其认为合适的方法公布。
第474C章 第16条缴付使用费的法律责任
使用费
须缴使用费的车辆的车主或驾驶人有法律责任就该车辆通过收费区而缴付使用费。
第474C章 第17条缴付使用费
(1)除第(2)款另有规定外,任何人均不得驾驶车辆通过─
(a)并非自动收费亭的使用费收费亭,除非他─
(i)在收费亭停车,并为该车辆向在收费亭当值的使用费收费员缴付适当的使用费;或
(ii)在收费亭停车,并向在收费亭当值的使用费收费员缴交由公司提供的适用于该车辆的使用费代用券;(b)自动收费亭,除非有为该车辆缴付适当使用费,而该使用费是藉记入一个电子代用证持有人根据第18(3)条于公司或其代理人开立的户口的借方内而缴付的。(2)第(1)款并不适用于属第3(2)条所提及类别的车辆,但就该车辆而须缴付的使用费可以由公司及运输署署长所不时以书面协定的方式缴付。
第474C章 第18条自动收费设施
(1)公司可安排或准许将运输署署长批准的自动收费设施安装在任何使用费收费亭,以收取车辆通过收费区而须缴付的使用费,亦可安排或准许安装运输署署长所批准的附属设施。
(2)公司可在获得运输署署长的书面批准下藉竖立附表第23及24号图形所示的各交通标志,以指定某行车及某使用费收费亭为自动收费行车及自动收费亭(视属何情况而定)。
(3)公司或其代理人可向于公司或其代理人开立户口的人发出电子代用证,以供缴付发出电子代用证所关乎类别的车辆通过收费区的适当使用费。
第474C章 第19条禁止干扰或伪造电子使用费代用证
(1)除获公司或其代理人授权外,任何人均不得对电子代用证作出以下行为或将电子代用证作有以下结果的处置─
(a)将电子代用证上的密码资料全部或部分消除,或藉其他方式改动或干扰该等资料;或
(b)藉其他方式损坏或毁坏电子代用证。(2)任何人不得为缴付就通过收费区而须缴付的使用费而在任何自动收费亭使用或企图为缴付上述使用费而在上述收费亭使用─
(a)已被改动、损坏、毁坏或干扰的电子代用证;
(b)偷来或藉欺诈行为或欺骗手段而取得的电子代用证;或
(c)任何看来是或充作是电子代用证的物料或物件。
第474C章 第20条遭禁止的车辆
禁止和限制交通
(1)任何人不得─
(a)在隧道区域内驾驶以下车辆,或致使或容许以下车辆在隧道区域内行驶,或致使以下车辆停留在隧道区域内─
(i)载水不足、载于燃料箱内的燃料不足或电池充电不足,以致如无协助则不能完成通过隧道行程的车辆;
(ii)没有将负载物或负载物的封盖适当地固定,以避免负载物任何部分或其封盖从车辆掉下或触及隧道任何部分(包括隧道的装配物或固定附物)的车辆;或
(iii)会触及或相当可能触及隧道任何部分(包括隧道的装配物或固定附物)的车辆;(b)在收费区(包括隧道区域)内驾驶以下车辆,或致使或容许以下车辆在收费区(包括隧道区域)内行驶,或致使以下车辆停留在收费区(包括隧道区域)内─
(i)并非汽车亦非挂接车辆的车辆;
(ii)机动脚踏车;
(iii)引擎汽缸总容量不超逾125立方厘米的车辆;
(iv)车胎有缺陷或车胎没有适当充气的车辆;
(v)用履带行驶的履带式车辆;
(vi)载有站在车辆外部或坐而身体有任何部分伸出车旁或车尾之外的人的车辆;
(vii)运载没有予以适当控制或约束的动物或家禽的车辆,或运载没有充分遮盖的负载物的车辆;
(viii)正发出或相当可能发出过量的烟气或烟雾的车辆;
(ix)插口或其他部分漏油的油槽车;
(x)驾驶人的前方或旁边视线受阻或容易受阻的车辆;
(xi)正由受酒类或药物影响以致不能适当地控制车辆的人所驾驶的车辆;
(xii)相当可能危及人或财产,或令收费区的使用不安全的车辆;
(xiii)根据《道路交通(驾驶执照)规例》(第374章,附属法例)所界定的学习驾驶执照而驾驶车辆的人所驾驶的车辆;
(xiv)运载任何《危险品(适用及豁免)规例》(第295章,附属法例)附表第1类所指明的货品的车辆;
(xv)运载任何《危险品(适用及豁免)规例》(第295章,附属法例)附表第2类所指明的货品的车辆,但如《危险品(一般)规例》(第295章,附属法例)第74条表内第2栏对此类货品的分量有所指明,而该车辆所运载的货品不超逾该分量,则不在此限;
(xvi)在不损害第(xv)节的规定下,运载任何用作或将用作贮存《危险品(适用及豁免)规例》(第295章,附属法例)附表第2类所指明的压缩气体的气瓶(《危险品(一般)规例》(第295章,附属法例)第61条所界定的气瓶)的车辆,不论该等气瓶是否盛载任何分量的此类气体;
(xvii) 运载任何《危险品(适用及豁免)规例》(第295章,附属法例)附表第5类所指明的货品的车辆,但如《危险品(一般)规例》(第295章,附属法例)第99条表内第7栏对此类货品的分量有所指明(如第7栏并无指明,则为第8栏所指明),而该车辆所运载的货品不超逾该分量,则不在此限;
(xviii)在不损害第(xvii)节的规定下,在构造上是用以或经改装以运送《危险品(适用及豁免)规例》(第295章,附属法例)附表第5类所指明的货品的车辆,或运载用作或将用作贮存此类货品的盛器的车辆,不论该车辆或盛器是否盛载任何分量的此类货品;或
(xix)不符合《道路交通(车辆构造及保养)规例》(第374章,附属法例)的规定的车辆。(2)本条并不禁止─
(a)车辆在隧道内运送仅为驱动该车辆本身而载于其燃料箱内的燃料;或
(b)(就仅为驱动车辆本身而在其燃料箱内载有汽油的车辆而言)车辆在隧道内运送该车辆上所载作以上用途的汽油,但该等汽油不得超过20升,并须存于密封的罐内。
第474C章 第21条须领有许可证的车辆
(1)任何人均不得驾驶任何以下车辆进入收费区,但如该人管有由总经理就该车辆而以书面发出的许可证并按照该许可证的规定驾驶该车辆进入收费区,则不在此限─
(a)高度(包括负载物)超逾4.6米的车辆;
(b)长度超逾12米的整体式车辆;
(c)长度超逾16米的挂接车辆;
(d)所载负载物向前伸展至超出车辆最前端1.5米以上的车辆(拖车除外);
(e)所载负载物向后伸展至超出车辆最后端1.4米以上的车辆;
(f)车轮负荷超逾4.5公吨或车轴负荷超逾11公吨的车辆;
(g)根据《道路交通(车辆登记及领牌)规例》(第374章,附属法例)第53(1)条而获发车辆行驶许可证的车辆或拖车;
(h)全宽度(包括负载物)超逾2.5米的车辆;
(i)本条例附表1没有指明使用费的车辆;
(j)任何类别的车辆,而其车辆总重超逾按照《道路交通(车辆构造及保养)规例》(第374章,附属法例)附表2就该车辆所指定或厘定的许可最高车辆总重或(如适用的话)许可最高组合式车辆总重。(2)任何人均可向总经理申请第(1)款所提述的许可证,申请须列明与该申请有关的车辆或拖车及其负载物(如有的话)的详细资料,以及拟通过收费区的日期、时间及方向。
(3)凡根据第(2)款就第(1)(g)款所提述的车辆或拖车申请许可证,如总经理提出要求,则申请书须附有总经理所指明的与该车辆或拖车有关的土木工程意见或其他资料。
(4)除非总经理免除本款所订的预先提出申请的规定,否则须在有关车辆或拖车拟通过收费区最少48小时前提出第(2)款所指的许可证申请。
(5)总经理可在根据本条所发出的许可证上指明─
(a)有关车辆或拖车通过收费区的日期及时间;及
(b)总经理认为合适的其他条件。(6)任何人欲获发给本条所指的许可证,须向公司缴付以下费用─
(a)就第(1)(a)、(b)、(c)、(d)、(e)、(f)、(h)、(i)或(j)款所提述的车辆而发出的许可证 .............................................................................. $250;及
(b)就第(1)(g)款所提述的车辆或拖车而发出的许可证 ................. $750。
第474C章 第22条运送危险品的车辆
(1)除本条另有规定外,公司可以其认为合适的方式公布其认为合适的资料,藉以订定本条适用的所有或任何车辆进入收费区的时段。
(2)除获总经理的书面准许外,任何人均不得驾驶任何本条适用的车辆进入收费区;如给予准许,则该准许须受以下条件规限─
(a)如已根据第(1)款就某类别的有关车辆订定时段,则该准许只可限于该时段;
(b)掌管该车辆的人,或负责运送车辆内或车辆上任何货品的人,须以书面向总经理作出有关车辆及货品性质的声明;及
(c)总经理可派收费区管理人员护送该车辆通过收费区,并可采取任何他认为于有关情况属适宜的其他预防措施。(3)本条适用于─
(a)运送任何《危险品(适用及豁免)规例》(第295章,附属法例)附表第3、4、6、7、8、9或10类所指明的货品的车辆;及
(b)运送大量火柴或运送放射性物质或对人类或动物生命有危险的生物样本的车辆。
第474C章 第23条一般禁制
杂项
任何人─
(a)不得妨碍或干扰公司的任何雇员或代理人执行其职责;
(b)不得进入收费区的任何部分,但如按照本条例或本附例的条文或获总经理书面授权而按该授权如此做,则不在此限;
(c)不得损坏或污损公司的任何财产;
(d)不得在被收费区管理人员要求离开收费区后,仍在收费区内游荡或停留;
(e)不得疏忽而让动物在收费区内走失或走进收费区;
(f)不得在收费区内从车辆上抛掷或掉下任何物件或将任何物件从车辆上抛掷或掉入收费区内;
(g)不得在收费区内出售或要约出售任何物品,但如获总经理书面同意,则不在此限;
(h)如非公司的雇员或代理人,不得─
(i)改动或干扰任何在收费区内的道路标记、告示、管制灯号或交通标志;
(ii)在收费区内绘画、书写、黏贴或以其他方式展示任何标语牌、招贴、告示、广告或其他物品;
(iii)爬上或移走公司的任何财产;(i)不得在收费区内抛掷或掉下任何物件。
第474C章 第24条吸烟及无遮盖火焰
当收费区管理人员提出要求时,任何人须─
(a)弄熄其所管有的已燃点香烟、雪茄或烟斗;
(b)避免暴露无遮盖火焰或引起火花。
第474C章 第25条罪行及罚则
任何人违反第5、6、7、8、10、11、12(1)及(2)、13(1)、14、17(1)、19、20(1)、21(1)、22(2)、23或24条,即属犯罪,一经定罪,可处第2级罚款。
第474C章 第26条保留条文
本附例不得视为限制、减损或以其他方式干扰由或根据任何法律所赋予或委以任何担任香港特别行政区政府公务的人员的权力或职责。
第474C章 第27条对香港特别行政区政府的适用范围
除另有明文规定者外,本附例适用于用于香港特别行政区政府公务的车辆及担任香港特别行政区政府公务的人员。

第1号图形
行车使用讯号
本标志如展示在一条行车上方时,表示在该行车的车辆可朝该标志迎面行驶并越过该标志继续向同一方向行驶。本标志亦可用于任何使用费收费亭,以示车辆可在该行车行驶。
第2号图形
向右或靠右行驶
箭嘴可转至相反的方向,以显示─
向左或靠左行驶
本标志表示车辆必须驶往右方的隔邻行车,如箭嘴转至相反的方向,则必须驶往左方的隔邻行车。
第3号图形
行车使用讯号
本标志如展示在一条行车上方时,表示在该条行车的车辆不得朝红色交叉迎面在其下行驶,也不得迎面越过该红色交叉。本标志亦可用于任何使用费收费亭,以示车辆不得在该行车行驶。
第4号图形
行车讯号
本讯号可在收费区内行车的上方或旁边垂直放置或横放,以管制沿本讯号所放置之处的下方或旁边并为本讯号所关乎的行车行驶的车辆,但当本讯号放置于行车上方时,绿色箭嘴须指向下方。
本讯号的意义如下─
(i)如有绿色箭嘴展示,在该箭嘴所展示的下方或旁边并为该箭嘴所关乎的行车上行驶的车辆,可沿该行车行驶。
(ii)如有固定或间歇亮的琥珀色灯展示,在该灯所展示的下方或旁边并为该灯所关乎的行车上行驶的车辆,须沿该行车小心行驶,并要有停车准备。
(iii)如有红色交叉展示,在该红色交叉所展示的下方或旁边并为该红色交叉所关乎的行车上行驶的车辆,不得在该红色交叉下面行驶或越过该红色交叉,或驶过该红色交叉。
本讯号可省却琥珀色灯讯号而在使用费收费亭使用。
第5号图形
使用车头低灯
本标志显示时,所有车辆通过隧道时均须使用车头低灯。
第6号图形
速度限制
本标志表示在紧接本标志后的一段道路上的速度限制为每小时50公里。
本标志可竖立在开始施加此限制所在的道路两旁;如该道路是双程分隔车路,则可竖立在开始施加此限制所在的中央分道带上。如此竖立的标志须面向迎面而来的车辆。
沿适用本标志的一段道路每隔一段距离亦可竖立一个300毫米大小的标志,以提醒驾车人现正生效的速度限制。
第7号图形
速度限制
本标志表示在紧接本标志后的一段道路上的速度限制为每小时70公里。
本标志可竖立在开始施加此限制所在的道路两旁;如该道路是双程分隔车路,则可竖立在开始施加此限制所在的中央分道带上。如此竖立的标志须面向迎面而来的车辆。
沿适用本标志的一段道路每隔一段距离亦可竖立一个450毫米大小的标志,以提醒驾车人现正生效的速度限制。
第8号图形
速度限制
本标志表示在紧接本标志后的一段道路上的速度限制为每小时80公里。

本标志显示收费区的起点。
第11号图形
收费区终止
本标志显示收费区的终点。

不准换

Cap 474C s 1 Interpretation
PRELIMINARY
In this Bylaw, unless the context otherwise requires-
'articulated vehicle' (挂接车辆) has the same meaning as in the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.);
'autotoll booth' (自动收费亭) means a toll booth equipped with an automatic toll collection facility approved by the Commissioner;
'bus' (巴士) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'electronic pass' (电子代用证) means a pass issued by the Company or its agent under section 18(3);
'franchised bus' (专利巴士) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'General Manager' (总经理) has the same meaning as in the regulations;
'gross vehicle weight' (车辆总重) and 'permitted gross vehicle weight' (许可车辆总重) have the same meanings as in the Road Traffic Ordinance (Cap 374);
'heavy goods vehicle' (重型货车) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'lane' (行车) has the same meaning as in the regulations;
'light signal' (管制灯号) has the same meaning as in the regulations;
'medium goods vehicle' (中型货车) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'middle lane' (中间行车) means the lane between the left most lane and the right most lane (in relation to the direction of traffic) in any road within the toll area;
'nearside lane' (左边行车) means the left most lane (in relation to the direction of traffic) in any road within the toll area;
'overall width' (全宽度) has the same meaning as in the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.);
'prescribed light signal' (订明管制灯号) means a light signal of a size, design, colour and type prescribed in the Schedule;
'prescribed traffic sign' (订明交通标志) means a traffic sign of the size, design, colour and type prescribed in the Schedule;
'regulations' (《规例》) means regulations made under section 17 of the Ordinance;
'rigid vehicle' (整体式车辆) has the same meaning as in the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.);
'road marking' (道路标记) has the same meaning as in the regulations;
'toll' (使用费) means the appropriate toll chargeable by the Company under the Ordinance;
'toll booth' (使用费收费亭) means a structure erected for the purpose of collecting tolls;
'toll collector' (使用费收费员) means any person authorized by the Company for the purpose of collecting toll;
'traffic sign' (交通标志) has the same meaning as in the regulations;
'tunnel' (隧道) has the same meaning as in the regulations;
'tunnel area' (隧道区域) means that part of the area described and delineated as such on the plan numbered CPS TAP/2 signed by the Commissioner and deposited in the Land Registry or any other plan deposited under section 3(4) of the Ordinance, and includes any area adjacent thereto;
'wind susceptible vehicle' (受风车辆) means a vehicle with an overall height exceeding 1.6 m, a motor cycle or a motor tricycle.
Cap 474C s 2 Application
(1) This Bylaw applies only within the toll area.
(2) The Company shall place a prescribed traffic sign of the type shown in-
(a) Figure No. 10 in the Schedule at each entrance to the toll area;
(b) Figure No. 11 in the Schedule at each exit from the toll area.(3) Any vehicle or thing that is partly within the toll area shall, for the purposes of this Bylaw, be deemed to be within that area.
(4) The Company shall place a prescribed traffic sign of the type shown in-
(a) Figure No. 28 in the Schedule at each entrance to the tunnel area;
(b) Figure No. 29 in the Schedule at each exit from the tunnel area.(5) Any vehicle or thing that is partly within the tunnel area shall, for the purposes of this Bylaw, be deemed to be within that area.
Cap 474C s 3 Exemptions
(1) A vehicle that carries a person in the public service of the Government of the Hong Kong Special Administrative Region when he is engaged on duty relating to the toll area is exempted from section 17.
(2) If a vehicle of the Fire Services Department, an ambulance, a customs and excise vehicle, a police vehicle or a vehicle used for defence purposes, including civil defence purposes, is being used in the course of urgent duty-
(a) the driver and owner of the vehicle are exempted from section 20(1)(b)(vi), (x), (xiv), (xv), (xvi), (xvii), (xviii) and (xix); and
(b) the driver of the vehicle is exempted from sections 7 and 21(1)(a), (b), (f) and (h).(3) The driver and owner of a vehicle specified in section 20(1)(b)(xv), (xvi), (xvii) or (xviii), which is being moved in an emergency in accordance with the permission of the General Manager are exempted from section 20(1).
Cap 474C s 4 Control of traffic
TRAFFIC CONTROL
All persons in the toll area shall be subject to the control and direction of toll area control officers.
Cap 474C s 5 Access
No person shall enter or leave the toll area, or shall cause or permit any vehicle to do so, except at such places as may be provided by the Company for the purpose and be indicated by traffic signs.
Cap 474C s 6 Directions of toll area control officers to be obeyed
All persons in the toll area shall comply with the directions given by a toll area control officer in the course of his duty relating to the management of the toll area or the control, restriction and safety of traffic.
Cap 474C s 7 Speed limit
(1) Subject to subsection (2), the driver of a vehicle in the toll area shall not cause or permit the vehicle to travel at speed exceeding the speed indicated by a speed limit sign as prescribed by Figures No. 6, 7, 8 or, as the case may be, 9 in the Schedule.
(2) Where a prescribed speed limit is in effect under this section and permits a vehicle to travel on any road within the toll area in excess of 70 km an hour, the maximum speed at which a medium goods vehicle, heavy goods vehicle or bus shall travel on such road shall be 70 km an hour.
Cap 474C s 8 Lane changing
The driver of a vehicle shall not, unless authorized to do so by a toll area control officer or by a traffic sign, cause or permit his vehicle or any part of it to be on or over or to cross the continuous double white lines dividing the tunnel area and the toll area into lanes.
Cap 474C s 9 Meaning of traffic signs, light signals and road markings
(1) The meaning of a prescribed traffic sign and prescribed light signal shall be in accordance with its content and the note relating to the figure of that sign or that signal in the Schedule.
(2) The meaning of a traffic sign, light signal or road marking prescribed by the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) and the Road Traffic (Expressway) Regulations (Cap 374 sub. leg.) shall be in accordance with its content and the note relating to the figure of that sign, signal or marking in the Schedules to those regulations.
Cap 474C s 10 Traffic signs, light signals and road markings to be obeyed
The driver of a vehicle in the toll area shall comply with the requirement indicated by-
(a) a prescribed traffic sign or prescribed light signal of the type shown in any of the figures in the Schedule;
(b) such traffic signs, light signals or road markings prescribed by the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) and the Road Traffic (Expressway) Regulations (Cap 374 sub. leg.) erected, placed or otherwise displayed by the Company within the toll area pursuant to the powers vested in the Company under the regulations as the Company shall deem fit for the purpose of regulating traffic.
Cap 474C s 11 Use of vehicle lights in tunnel
Dipped headlights shall always be used inside the tunnel and no headlights illuminated on main beam shall be allowed.
Cap 474C s 12 Traffic confined to the nearside lane and/or middle lane in tunnel
(1) A goods vehicle having a permitted gross vehicle weight in excess of 5.5 tonnes shall, except when otherwise directed by a toll area control officer, be driven only in the nearside lane or middle lane inside the tunnel.
(2) The following vehicles shall, except when otherwise directed by a toll area control officer, be driven only in the nearside lane inside the tunnel-
(a) a bus;
(b) a vehicle requiring a permit under section 21;
(c) a vehicle to which section 22 applies; or
(d) a vehicle towing another vehicle.(3) In subsection (1), 'goods vehicles' (货车) has the same meaning as in the Road Traffic Ordinance (Cap 374).
Cap 474C s 13 General restrictions
(1) Unless complying with a prescribed traffic sign, a prescribed light signal or with a direction given by a toll area control officer, no person shall-
(a) in the tunnel area-
(i) drive a vehicle at a speed of less than 25 km per hour except where prevented by another vehicle or at places where a speed of less than 25 km per hour is unavoidable; or
(ii) make a U turn with or reverse a vehicle;(b) within the toll area (including the tunnel area)-
(i) stop a vehicle or permit a vehicle to be stationary except-
(A) when lawfully required to do so;
(B) when compelled to do so by reason of an accident, breakdown or emergency or by the presence of other stationary vehicles;
(C) in the case of a franchised bus, at a designated bus stop, and then only for so long a period as may be required for the passengers to get on or off the bus;(ii) alight from a vehicle except-
(A) in the event of an emergency or to summon assistance;
(B) for the purpose of complying with section 14;
(C) in the case of a franchised bus, at a designated bus stop;
(D) when engaged on duty relating to the toll area;(iii) change a tyre or wheel on, or refuel or repair, a vehicle;
(iv) tow or propel a vehicle by pulling or pushing that vehicle, whether manually or by any other means;
(v) drive a vehicle onto any footway;
(vi) being the driver of a vehicle, leave the vehicle unattended, except for the purpose of complying with section 14 or as otherwise prescribed by this Bylaw;
(vii) move, tamper with or wilfully impede the operation of a traffic sign, light signal, road marking or any facility, equipment or installation; or
(viii) use any horn, siren, whistle or other noise-making device;(c) enter the toll area on foot.(2) Subsection (1)(b)(iv) shall not apply in the case of articulated vehicles.
Cap 474C s 14 Fire on vehicles
If a fire occurs on or in any vehicle, the driver of the vehicle shall-
(a) stop the vehicle as soon as practicable, if it is not already stationary; and
(b) immediately vacate the vehicle and activate the nearest fire alarm if it is safe to do so.
Cap 474C s 15 Vehicles, etc., causing obstruction
(1) A vehicle or thing causing obstruction may be towed away or removed by a toll area control officer at the risk and expense of its owner, and may be detained and stored by the Company.
(2) The Company may recover from the owner of such vehicle or thing such charge in respect of its towage or removal and storage as may be fixed from time to time by the Company with the approval in writing of the Commissioner.
(3) A list of the charges fixed by the Company under subsection (2) may be published by the Company in such manner as it thinks fit.
Cap 474C s 16 Liability for tolls
TOLLS
The owner or the driver of a vehicle in respect of which a toll is payable is liable to pay the toll in respect of the passage of the vehicle through the toll area.
Cap 474C s 17 Payment of tolls
(1) Subject to subsection (2), no person shall drive a vehicle past-
(a) a toll booth which is not an autotoll booth unless he-
(i) stops and pays to the toll collector on duty at the booth the appropriate toll for the vehicle; or
(ii) stops and tenders to the toll collector on duty at the booth such toll ticket as may be provided by the Company appropriate to the vehicle;(b) an autotoll booth unless the appropriate toll for the vehicle is paid by debiting the account of the holder of an electronic pass opened with the Company or its agent under section 18(3).(2) Subsection (1) shall not apply to a vehicle of the kind mentioned in section 3(2), but the toll payable in respect of such a vehicle may be paid in such a manner as may be agreed in writing between the Company and the Commissioner from time to time.
Cap 474C s 18 Automatic toll collection facilities
(1) The Company may cause or permit the installation of such automatic toll collection facilities as the Commissioner may approve at any toll booth for the purpose of collecting the toll payable for the passage of a vehicle through the toll area and may also cause or permit the installation of such ancillary facilities as the Commissioner may approve.
(2) The Company may, with the written approval of the Commissioner, by erecting traffic signs as shown in Figures No. 23 and 24 in the Schedule, designate a lane and toll booth to be an autotoll lane and an autotoll booth as the case may be.
(3) An electronic pass may be issued by the Company or its agent to a person who opens an account with the Company or its agent for the payment of the toll appropriate to the passage through the toll area of the description of vehicle in respect of which the electronic pass is to be issued.
Cap 474C s 19 Prohibition against interference with or falsification of electronic toll passes
(1) Except when authorized by the Company or its agent, no person shall do anything to or with an electronic pass whereby-
(a) the coded data thereon is erased wholly or in part or is otherwise altered or interfered with; or
(b) the electronic pass is otherwise damaged or destroyed.(2) No person shall use or attempt to use for the purpose of paying the toll payable for passing through the toll area at any autotoll booth-
(a) an electronic pass which has been altered, damaged, destroyed or interfered with;
(b) an electronic pass which has been stolen or obtained by fraud or deception; or
(c) any material or thing purported to be or passed off as an electronic pass.
Cap 474C s 20 Vehicles prohibited
PROHIBITED AND RESTRICTED TRAFFIC
(1) A person shall not drive or cause or permit to be driven, or cause to remain-
(a) in the tunnel area-
(i) a vehicle which is not carrying sufficient fuel in its fuel tank or water or the batteries of which are insufficiently charged to enable it to be driven through the tunnel unaided;
(ii) a vehicle with a load, or the cover of a load, which is not properly secured so as to prevent any part of the load or that cover from falling off the vehicle or otherwise coming into contact with any part of the tunnel (including any fittings or fixtures); or
(iii) a vehicle which will or is likely to come into contact with any part of the tunnel (including any fittings or fixtures);(b) within the toll area (including the tunnel area)-
(i) a vehicle other than a motor vehicle and an articulated vehicle;
(ii) a motor assisted pedal-cycle;
(iii) a vehicle with an engine the total cylinder capacity of which does not exceed 125 cubic centimetres;
(iv) a vehicle with a tyre that is defective or not properly inflated;
(v) a tracked vehicle travelling on its tracks;
(vi) a vehicle carrying a person standing on the outside of the vehicle or seated with any part of his body overhanging the sides or rear of the vehicle;
(vii) a vehicle carrying animals or poultry not properly controlled or confined, or carrying a load which is not sufficiently covered;
(viii) a vehicle that is emitting or is likely to emit excessive fumes or smoke;
(ix) a tanker vehicle with a spigot or other part that is leaking;
(x) a vehicle in which the driver's view to the front or sides is or could readily be obscured;
(xi) a vehicle being driven by a person who is under the influence of drink or drugs to such an extent as to be incapable of having proper control of the vehicle;
(xii) a vehicle that is likely to endanger persons or property or render the use of the toll area unsafe;
(xiii) a vehicle being driven by a person under a learner's driving licence as defined in the Road Traffic (Driving Licences) Regulations (Cap 374 sub. leg.);
(xiv) a vehicle carrying any of the goods specified in Category 1 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.);
(xv) a vehicle carrying any of the goods specified in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.) unless there is a quantity specified in relation to such goods in the second column of the Table to regulation 74 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.) and the goods carried do not exceed that quantity;
(xvi) without prejudice to subparagraph (xv), a vehicle carrying any cylinders as defined in regulation 61 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.), used or to be used for the storage of any compressed gas specified in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.), whether or not such cylinders contain any quantity of such gas;
(xvii) a vehicle carrying any of the goods specified in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.), unless there is a quantity specified in relation to such goods in the seventh or, where no such quantity is there specified, in the eighth column of the Table to regulation 99 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg.) and the goods carried do not exceed that quantity;(xviii) without prejudice to subparagraph (xvii), a vehicle constructed or adapted for the conveyance, or a vehicle carrying a container used or to be used for the storage, of goods specified in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.), whether or not such vehicle or container contains any quantity of such goods; or
(xix) a vehicle that does not conform to the requirements of the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.).(2) This section shall not prohibit-
(a) the conveyance in the tunnel of fuel which is being carried in the fuel tank of a vehicle for the purpose only of the propulsion of the vehicle; or
(b) in the case of a vehicle carrying in its fuel tank petroleum spirit for the purpose only of its propulsion, the conveyance in the tunnel by the vehicle of petroleum spirit, up to a maximum of 20 litres in securely closed cans, which is being carried on the vehicle for such purpose.
Cap 474C s 21 Vehicles requiring permits
(1) No person shall drive any of the following vehicles into the toll area unless he is in possession of a permit issued in writing in respect of that vehicle by the General Manager and such entry is in accordance with that permit-
(a) a vehicle the height of which (including load) exceeds 4.6 metres;
(b) a rigid vehicle the length of which exceeds 12 metres;
(c) an articulated vehicle the length of which exceeds 16 metres;
(d) a vehicle, other than a trailer, the load of which extends forward more than 1.5 metres from the foremost part of the vehicle;
(e) a vehicle the load of which extends backward more than 1.4 metres behind the rearmost part of the vehicle;
(f) a vehicle with a wheel-load exceeding 4.5 tonnes or an axle load exceeding 11 tonnes;
(g) a vehicle or trailer in respect of which a movement permit is issued under regulation 53(1) of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.);
(h) a vehicle the overall width of which (including load) exceeds 2.5 metres;
(i) a vehicle for which no toll is specified in Schedule 1 to the Ordinance;
(j) a vehicle of any class the gross vehicle weight of which exceeds the permitted maximum gross vehicle weight or if applicable, the permitted maximum gross combined weight assigned or determined in respect of that vehicle in accordance with the Second Schedule to the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.).(2) Any person may apply to the General Manager for a permit referred to in subsection (1) giving details of the vehicle or trailer to which the application relates and its load, if any, and the time, date and direction of its proposed passage through the toll area.
(3) Where an application for a permit is made under subsection (2) in respect of a vehicle or trailer referred to in subsection (1)(g) such application shall, if so required by the General Manager, be accompanied by such civil engineering advice or other information relating to the vehicle or trailer as may be specified by the General Manager.
(4) An application for a permit under subsection (2) shall be made at least 48 hours before the proposed passage of the vehicle or trailer through the toll area, except where the General Manager waives this requirement.
(5) The General Manager may specify in a permit issued under this section-
(a) the date and time for the passage of the vehicle or trailer through the toll area; and
(b) such other conditions as the General Manager thinks fit.(6) The following fee shall be payable to the Company for the issue of a permit under this section-
(a) for a permit in respect of a vehicle referred to in subsection (1)(a), (b), (c), (d), (e), (f), (h), (i) or (j) .......................................................................... $250; and
(b) for a permit in respect of a vehicle or trailer referred to in subsection (1)(g) . ............................................................................................................. $750.
Cap 474C s 22 Vehicles conveying dangerous goods
(1) Subject to this section, the Company may fix the hours during which all or any of the vehicles to which this section applies may enter the toll area by publishing such information in such manner as it thinks fit.
(2) No person shall drive any vehicle to which this section applies into the toll area except with the permission of the General Manager in writing, which permission, if granted, shall be subject to the following conditions-
(a) if hours have been fixed under subsection (1) in respect of the class of vehicle concerned, the permission shall relate only to those hours;
(b) a declaration shall be made in writing to the General Manager by the person in charge of the vehicle, or by the person responsible for the conveyance of any goods in or on the vehicle, as to the nature of the vehicle and goods; and
(c) the General Manager may provide toll area control officers for the purpose of escorting the vehicle through the toll area and may take any other precautionary measure which he considers expedient in the circumstances.(3) This section applies to-
(a) a vehicle conveying any goods specified in Category 3, 4, 6, 7, 8, 9 or 10 in the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg.); and
(b) a vehicle conveying matches in bulk, radioactive substances, or biological specimens dangerous to human or animal life.
Cap 474C s 23 General prohibitions
MISCELLANEOUS
No person shall-
(a) obstruct or interfere with any employee or agent of the Company in the execution of his duty;
(b) enter any part of the toll area save in accordance with the provisions of the Ordinance or this Bylaw or if authorized to do so by the General Manager in writing;
(c) damage or deface any property of the Company;
(d) loiter or remain in the toll area, after having been requested by a toll area control officer to leave the toll area;
(e) negligently allow any animal to stray in or into the toll area;
(f) throw or drop anything from a vehicle in or into the toll area;
(g) sell or offer for sale any article in the toll area except with the consent in writing of the General Manager;
(h) not being an employee or agent of the Company-
(i) alter or interfere with any road marking, notice, light signal or traffic sign in the toll area;
(ii) paint, write, stick or otherwise display any placard, bill, notice, advertisement or other matter in the toll area;
(iii) climb upon or remove any property of the Company;(i) throw or drop anything within the toll area.
Cap 474C s 24 Smoking and naked flames
When requested to do so by a toll area control officer, a person shall-
(a) extinguish a lighted cigarette, cigar or pipe in his possession;
(b) refrain from exposing a naked flame or causing a spark.
Cap 474C s 25 Offences and penalties
Any person who contravenes section 5, 6, 7, 8, 10, 11, 12(1) and (2), 13(1), 14, 17(1), 19, 20(1), 21(1), 22(2), 23 or 24 shall be guilty of an offence and shall be liable on conviction to a fine at level 2.
Cap 474C s 26 Saving
Nothing in this Bylaw shall be taken to restrict, derogate from or otherwise interfere with any power conferred or duty imposed by or under any law upon any person in the public service of the Government of the Hong Kong Special Administrative Region.
Cap 474C s 27 Application to the Government of the Hong Kong Special Administrative Region
Except where otherwise expressly provided, this Bylaw shall apply to vehicles and persons in the public service of the Government of the Hong Kong Special Administrative Region.

THIS SIGNAL MAY IN THE TOLL AREA BE PLACED IN A VERTICAL OR HORIZONTAL POSITION ABOVE OR AT THE SIDE OF A LANE FOR THE CONTROL OF THAT TRAFFIC PROCEEDING ALONG THE LANE OVER OR AT THE SIDE OF AND IN RELATION TO WHICH THIS SIGNAL HAS BEEN PLACED, PROVIDED THAT WHEN THIS SIGNAL IS PLACED ABOVE THE LANE THE GREEN ARROW SHALL POINT DOWNWARDS.
THE MEANING OF THIS SIGNAL SHALL BE AS FOLLOWS-
(i) WHEN A GREEN ARROW IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED MAY PROCEED ALONG THAT LANE.
(ii) WHEN A STEADY OR INTERMITTENT AMBER LIGHT IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED SHALL PROCEED ALONG THAT LANE WITH CAUTION AND BE PREPARED TO STOP.
(iii) WHEN A RED CROSS IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED SHALL NOT PROCEED BENEATH OR BEYOND OR PAST THE RED CROSS.
THIS SIGNAL MAY BE USED AT TOLL BOOTHS WITH THE AMBER LIGHT SIGNAL OMITTED.

THIS SIGN INDICATES THAT ALL TRAFFIC SHALL PROCEED THROUGH THE TUNNEL ON DIPPED HEADLIGHTS.

THIS SIGN INDICATES THAT A SPEED LIMIT OF 50 KM PER HOUR IS IMPOSED ON THE SECTION OF THE ROAD IMMEDIATELY FOLLOWING THE SIGN.
THIS SIGN MAY BE ERECTED ON BOTH SIDES OF THE ROAD AND/OR ON A CENTRAL RESERVATION IN THE CASE OF A DUAL CARRIAGEWAY AT THE START OF A RESTRICTION FACING ONCOMING TRAFFIC.
A 300 MM SIZED SIGN MAY ALSO BE ERECTED AT INTERVALS ALONG THE SECTION OF THE ROAD TO WHICH THIS SIGN IS APPLICABLE TO REMIND MOTORISTS OF THE SPEED LIMIT IN FORCE.
