第520A章 第2条释义
在本规例中,除文意另有所指外─
“行车”(lane) 指隧道区内的行车;
“交通标志”(traffic sign) 指向道路使用者传达警告、资料、规定、限制、禁制或指示的标志、物体或设备;
“收费亭”(toll booth) 指竖立在隧道区行车入口或出口,用作收取使用费的构筑物;
“控制中心”(control centre) 指第3(b)条提述的控制中心,但不包括第3(c)条提述的小型控制中心;
“道路标记”(road marking) 指置于或嵌装于路面,以向道路使用者传达警告、资料、规定、限制、禁制或指示的条、字、标记或设备;
“管制灯号”(light signal) 指管制隧道区内车辆交通的照明讯号;
“隧道经理”(Tunnel Manager) 指公司委任以管制和管理隧道区的隧道人员。

第520A章 第3条交通管制
公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)在隧道区内竖立和维持足够并能发挥效用的交通标志及管制灯号,并在隧道区内放置和维持足够和能发挥效用的道路标记;
(b)提供和维持一个符合以下说明的控制中心─
(i)位于隧道西面入口;
(ii)备有足够而适当的设备,以规管、管制、限制和导引隧道区内的车辆及使用隧道区或受雇在隧道区内工作的人;及
(iii)时刻由足够数目而在使用第(ii)节提述设备方面曾受训练及完全熟悉紧急交通安排的人员操作;(c)于隧道东面入口提供和维持一个须符合以下说明的小型控制中心─
(i)配备连接控制中心的直接电话联系或对讲机;及
(ii)时刻由一名隧道人员操作;及(d)提供足够数目的巡逻车辆及车速侦查设备,而该等车辆及设备的类型、规格及数量须事先获得运输署署长批准。

第520A章 第4条交通标志、管制灯号及道路标记
(1)为遵从第3(a)条的规定,公司可安排或允许在隧道区内竖立或放置─
(a)任何交通标志、管制灯号或道路标记,而其大小、颜色及类型须为根据本条例订立的附例所订明者;
(b)任何属警告性或提示性的交通标志或道路标记,或连同该等标志或标记一起使用的辅助字牌,而其大小、颜色及类型须为《道路交通(交通管制)规例》(第374章,附属法例)附表1及2所示者;
(c)(在运输署署长批准予以竖立或放置的情况下)任何属限制性的交通标志、管制灯号或道路标记,或连同该等标志、灯号或标记一起使用的辅助字牌,而其大小、颜色及类型须为《道路交通(交通管制)规例》(第374章,附属法例)附表1、2及3所示者;及
(d)公司认为为向使用隧道区的人士提供提示及资料而属适当的任何交通标志、管制灯号或道路标记。(2)公司可藉竖立或放置适当的标志,以取消、更改或暂停任何根据第(1)(a)、(b)或(d)款竖立或放置的交通标志、管制灯号或道路标记的运作。
(3)公司在运输署署长指示下,须自费移去或更改任何根据第(1)或(2)款在隧道区内竖立或放置的交通标志、管制灯号或道路标记。

第520A章 第5条通讯
(1)公司须提供下述设备和时刻将该等设备维持于能发挥效用的操作状态,并须达到令运输署署长感到满意的程度─
(a)控制中心与下述机构的直接电讯联系(包括直接电话联系)─
(i)香港警务处的地区指挥及控制中心;
(ii)消防处的通讯中心;及
(iii)运输署紧急事故交通协调中心;(b)设于隧道及连接道路内的紧急通讯系统,以供消防处的人员与该部门的通讯中心通讯;
(c)无线电转播系统,将控制中心发出关于交通情况及交通安排的讯息传送予使用隧道人士;
(d)接驳隧道及连接道路的中央闭路电视系统而设于控制中心内的影像输出埠,以供装设接驳运输署紧急事故交通协调中心的闭路电视监控设备;及
(e)紧急电话系统,以供隧道及连接道路的使用者在紧急情况下与控制中心通讯。(2)当任何在隧道区内有交通改道或阻碍交通的情况而可能影响隧道区外的交通流动时,公司须立刻向香港警务处的地区指挥及控制中心及运输署署长所指定的人员报告。

第520A章 第6条救援
(1)公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)提供足够数目而适合处理隧道区内的车辆故障、交通意外及交通阻塞的曾受训练的人员及服务车辆;
(b)确保─
(i)(a)段提述的车辆的类型、规格及数量须是已事先获得运输署署长批准的,而该等车辆须由有关工作人员操控和时刻维持于准备随时出动的状态;及
(ii)当任何该等车辆在行车上时,须维持该等车辆与控制中心之间的双向无线电通讯联系;及(c)提供和时刻维持足够并能发挥效用的急救设备。(2)公司须在隧道区内提供和时刻维持足够并能发挥效用的消防装置及设备,并且须达到令消防处处长感到满意的程度。
(3)公司须在隧道区内发生火警、交通意外或有人受伤的情况时而于消防处人员及香港警务处人员未抵达之前,在合理的切实可行范围内尽量和尽快采取灭火行动和为受伤的人提供急救治疗,并且须协助消防处人员及香港警务处人员进行任何灭火或救援行动。

第520A章 第7条空气质素及通风
(1)公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)提供足够的通风系统并时刻将其维持于良好操作状态,以保障使用隧道区或受雇在隧道区内工作的人的健康及安全;
(b)提供设备,用以持续测量和记录隧道内的一氧化碳气体浓度及二氧化氮气体浓度以及消光系数,并在浓度超过第(2)款指明的水平时在控制中心发出可见并可听到的警报;如在商业市场上并无测量二氧化氮气体的设备,则须提供用以持续测量和记录一氧化氮气体的设备,但一旦在商业市场上有测量二氧化氮气体的设备,须立即予以替换;及
(c)以运输署署长规定的格式,每月向运输署署长提交报告,该报告须有显示(b)段提述的持续测量结果的统计资料及运输署署长所规定的资料。(2)公司须确保─
(a)隧道内的一氧化碳气体浓度,在任何5分钟内以容积计平均不超过百万分之一百;
(b)隧道内的二氧化氮气体浓度,在任何5分钟内以容积计平均不超过百万分之一;如公司已根据第(1)(b)款提供测量一氧化氮气体的设备,则公司须确保隧道内的一氧化氮气体浓度,在任何5分钟内以容积计平均不超过百万分之11.4;及
(c)隧道内的能见度在任何5分钟内均维持于消光系数不超过每公尺0.005。

第520A章 第8条整齐清洁等
(1)公司须保持隧道区清洁整齐,并须达到令运输署署长感到满意的程度。
(2)公司须确保─
(a)隧道洗涤设备的类型、规格及数量须是获得运输署署长批准的;及
(b)因定期洗涤隧道而排出的洗涤水符合《技术备忘录:排放入排水及排污系统、内陆及海岸水域的流出物的标准》(第358章,附属法例)内就排出物而指明的现行标准。

第520A章 第9条照明
公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)在隧道区内提供足够和能发挥效用的照明;及
(b)确保(a)段提述的照明因应隧道外的光暗情况而作出调节。

第520A章 第10条电力供应
公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)提供与2个独立外来电源连系的接驳连系,以便在一个电源发生故障时,有足够电力继续供隧道设施全面运作;
(b)安装和维持一个不间断供电系统,以操作位于隧道区内的下述必要设备最少30分钟─
(i)紧急照明设备,包括必要的隧道照明设备;
(ii)必要的通讯系统;
(iii)电脑系统;
(iv)必要的管制及监控系统;
(v)交通控制及监察系统;及
(vi)收费系统;(c)除(a)及(b)段所述的规定外,亦须提供发电装置和将该发电装置时刻维持于随时可应用和能发挥效用的操作状态,以便外来电源一旦发生故障时,所供应的电力足以操作位于隧道区内的下述紧急系统及设备最少6小时─
(i)消防系统;
(ii)所有接受不间断供电支援的负荷;
(iii)隧道内的紧急电源插座;
(iv)电脑室、控制室及不间断供电支援室的空气调节系统;
(v)电池室的机械通风设备;及
(vi)紧急照明设备、必要的隧道照明设备及隧道及连接道路的附属建筑物的必要的电源插座;及(d)将紧急电力供应时刻维持于能发挥效用的操作状态,以供消防处人员在隧道内使用。

第520A章 第11条危险品的管制
公司须为防止或管制运载危险品通过隧道及连接道路而采取措施,并须达到令运输署署长感到满意的程度。

第520A章 第12条编配足够人手的规定
公司须遵守下述规定,并须达到令运输署署长感到满意的程度─
(a)按照获得运输署署长批准的关于人手编配的规定,为车辆安全地和有秩序地通过隧道及连接道路以及在隧道区内的车辆和人的管制及安全,部署足够而有效率的人员;及
(b)确保所有执行交通管制及操作职务的隧道人员已接受关乎灭火程序、急救技巧和使用灭火及急救设备的训练。

第520A章 第13条使用费通知的展示及出售
(1)公司须安排在隧道及连接道路两端的显眼位置展示通知,说明就各类汽车所须缴付的使用费,该通知的展示方式须令运输署署长感到满意。
(2)公司须安排将公司现行收取的使用费的收费表印本,存放于公司的注册办事处,并须安排令该等印本可供以合理价钱出售予任何人。

第520A章 第14条关于隧道经营的纪录
(1)公司须时刻以令运输署署长满意的格式及内容备存关于隧道及连接道路的经营的纪录,该等纪录须包括以下资料─
(a)任何设备发生故障和所采取的补救行动的次数、持续时间、位置、时间及性质;
(b)在隧道区内发生的意外或事故的详细资料;
(c)按车辆类型划分的每小时内通过隧道及连接道路的交通流量;
(d)按车辆类型划分的每日收取的使用费详细资料;
(e)每个收费亭的开放时间,以及个别隧道人员开始和停止操作该收费亭的时间;
(f)就隧道及连接道路的使用而获取的现金及其他收入;
(g)空气质素及通风风扇的操作情况;
(h)供财政评估用的簿册及纪录;及
(i)关于隧道及连接道路的经营的人员编制状况。(2)运输署署长可在公司向他提供他所合理要求的协助的情况下,自由取用根据第(1)款备存的纪录和制备其副本。

第520A章 第15条关于隧道维修的纪录
(1)公司须时刻以令路政署署长满意的格式及内容备存关于隧道区及隧道设施的检查、例行维修、修理及替换的纪录,该等纪录须包括以下资料─
(a)检查及维修工程的时间、持续时间、位置及性质;
(b)隧道设施发生故障或出现欠妥状况的时间、持续时间、位置及性质;
(c)替换部件、设备及设施的时间、持续时间及位置;及
(d)关于隧道区及隧道设施维修的人员编制状况。(2)路政署署长可在公司向他提供他所合理要求的协助的情况下,自由取用根据第(1)款备存的纪录和制备其副本。

第520A章 第16条制服及身分证明
当值隧道人员─
(a)须穿设计获警务处处长批准的制服,但隧道经理不在此限;
(b)须携带由公司发出并获运输署署长批准的身分证件;及
(c)在有人有合理理由而提出要求下,须立即向该人出示隧道人员的身分证件及委任证明。

Cap 520A s 2 Interpretation
In this Regulation, unless the context otherwise requires-
'control centre' (控制中心) means the control centre referred to in section 3(b) but does not include a minor control centre referred to in section 3(c);
'lane' (行车) means a traffic lane in the tunnel area;
'light signal' (管制灯号) means an illuminated signal to control vehicular traffic within the tunnel area;
'road marking' (道路标记) means a line, word, mark or device placed on, or set into, the surface of a road for conveying to persons using the road any warning, information, requirement, restriction, prohibition or direction;
'toll booth' (收费亭) means a structure erected at the entrance to, or exit from, a lane in the tunnel area for the purpose of collecting tolls;
'traffic sign' (交通标志) means a sign, object or device for conveying to persons using a road any warning, information, requirement, restriction, prohibition or direction;
'Tunnel Manager' (隧道经理) means the tunnel officer appointed to control and manage the tunnel area.
Cap 520A s 3 Traffic control
The Company shall, to the satisfaction of the Commissioner-
(a) erect and maintain adequate and efficient traffic signs and light signals, and place and maintain adequate and efficient road markings, in the tunnel area;
(b) provide and maintain a control centre which shall-
(i) be situated at the western entrance to the tunnel;
(ii) contain adequate and appropriate equipment for the regulation, control, restriction and guidance of vehicles and persons using or employed in the tunnel area; and
(iii) be manned at all times by an adequate number of persons trained in the use of equipment provided for the purposes mentioned in subparagraph (ii) and who are fully conversant with emergency traffic arrangements;(c) provide and maintain a minor control centre at the eastern entrance to the tunnel which shall-
(i) be equipped with direct telephone link or intercom to the control centre; and
(ii) be manned at all times by a tunnel officer; and(d) provide adequate number of patrol vehicles and speed check equipment, the type, specification and quantity of which shall be subject to the prior approval of the Commissioner.
Cap 520A s 4 Traffic signs, light signals and road markings
(1) In order to comply with section 3(a), the Company may cause or permit to be erected or placed in the tunnel area-
(a) any traffic sign, light signal or road marking of the size, colour and type prescribed in bylaws made under the Ordinance;
(b) any warning or informatory traffic sign or road marking or any supplementary plate that may be used with any such traffic sign or road marking of the size, colour and type shown in Schedules 1 and 2 to the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
(c) if the Commissioner approves each such erection or placing, any regulatory traffic sign, light signal or road marking or any supplementary plate that may be used with any such traffic sign, light signal or road marking of the size, colour and type shown in Schedules 1, 2 and 3 to the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.); and
(d) any traffic sign, light signal or road marking as it may think appropriate for the giving of advice and information to persons using the tunnel area.(2) The Company may by the erection or placing of an appropriate sign cancel, alter or temporarily suspend the operation of any traffic sign, light signal or road marking erected or placed under subsection (1)(a), (b) or (d).
(3) The Company shall, if directed to do so by the Commissioner, remove or alter at its own cost any traffic sign, light signal or road marking erected or placed in the tunnel area under subsection (1) or (2).
Cap 520A s 5 Communication
(1) The Company shall, to the satisfaction of the Commissioner, provide and maintain in efficient working order at all times-
(a) direct telecommunications links, including direct telephone link, between the control centre and- (36 of 2000 s. 28)
(i) a regional command and control centre of the Hong Kong Police Force;
(ii) the communication centre of the Fire Services Department; and
(iii) the Emergency Transport Coordination Centre of the Transport Department;(b) an emergency communication system in the Tunnel Link for officers of the Fire Services Department to communicate with the communication centre of that department;
(c) a radio re-broadcasting system for the transmission of messages on traffic conditions and arrangements from the control centre to persons using the tunnel;
(d) a video output port in the control centre for the central closed circuit television system of the Tunnel Link for the installation of closed circuit television monitor to the Emergency Transport Coordination Centre of the Transport Department; and
(e) an emergency telephone system for users of the Tunnel Link to communicate with the control centre in case of emergency.(2) The Company shall, without delay, report any diversion or interruption of traffic within the tunnel area that may affect the flow of traffic outside that area to a regional command and control centre of the Hong Kong Police Force and to an officer designated by the Commissioner.
Cap 520A s 6 Recovery and rescue
(1) The Company shall, to the satisfaction of the Commissioner-
(a) provide an adequate number of trained personnel and service vehicles suitable for dealing with vehicular breakdowns, accidents and obstruction in the tunnel area;
(b) ensure that-
(i) the vehicles referred to in paragraph (a) are of the type, specification and quantity for which the Commissioner has given prior approval and are manned and maintained at all times in a state of readiness; and
(ii) while any such vehicle is present in a lane, a 2-way radio link is maintained between the vehicle and the control centre; and(c) provide and maintain at all times adequate and efficient first aid equipment.(2) The Company shall, to the satisfaction of the Director of Fire Services, provide and maintain adequate and efficient fire service installations and equipment in the tunnel area at all times.
(3) The Company shall in the event of fire, traffic accident or injury to persons in the tunnel area, conduct fire fighting operation and render first aid treatment to the injured persons as soon as and so far as it is reasonably practicable prior to the arrival of those officers of the Fire Services Department and Hong Kong Police Force, and offer assistance to those officers in the course of any fire fighting or rescue operation.
Cap 520A s 7 Air quality and ventilation
(1) The Company shall, to the satisfaction of the Commissioner-
(a) provide and maintain in good working order at all times an adequate system of ventilation for the health and safety of persons using or employed in the tunnel area;
(b) provide equipment for the continuous measurement and recording of the concentration of carbon monoxide gas, nitrogen dioxide gas and extinction coefficient in the tunnel and for visual and audible alarm warnings to be given in the control centre if the concentration exceeds the level specified in subsection (2); where the equipment for measuring nitrogen dioxide gas is not commercially available in the market, equipment for the continuous measurement and recording of nitric oxide gas shall be provided subject to it being immediately replaced by equipment for measuring nitrogen dioxide gas when such equipment is available; and
(c) submit monthly report with statistical data showing the results of the continuous measurements referred to in paragraph (b) to the Commissioner, in a form and containing the information required by him.(2) The Company shall ensure that-
(a) the concentration of carbon monoxide gas in the tunnel does not during any 5-minute period exceed an average of 100 parts per million by volume;
(b) the concentration of nitrogen dioxide gas in the tunnel does not during any 5-minute period exceed an average of 1 part per million by volume or; where the Company has provided the equipment for measuring nitric oxide gas under subsection (1)(b), the concentration of nitric oxide gas in the tunnel does not during any 5-minute period exceed an average of 11.4 parts per million by volume; and
(c) the visibility in the tunnel does not during any 5-minute period exceed an extinction coefficient of 0.005 per metre.
Cap 520A s 8 Order and cleanliness, etc.
(1) The Company shall, to the satisfaction of the Commissioner, keep the tunnel area in a clean and orderly condition.
(2) The Company shall ensure that-
(a) the tunnel washing equipment is of the type, specification and quantity approved by the Commissioner; and
(b) the discharge of wash water from regular tunnel washing meets the prevailing standards for effluents as specified in the Technical Memorandum Standards for Effluents Discharged into Drainage and Sewerage Systems, Inland and Coastal Waters (Cap 358 sub. leg.).
Cap 520A s 9 Illumination
The Company shall, to the satisfaction of the Commissioner-
(a) provide adequate and efficient illumination within the tunnel area; and
(b) ensure that the illumination referred to in paragraph (a) is varied having regard to the light conditions outside the tunnel.
Cap 520A s 10 Electricity supply
The Company shall, to the satisfaction of the Commissioner-
(a) provide connection to 2 independent outside sources of electric power so that, if there is failure of one source, adequate electric power continues to be available for the full operation of the tunnel facilities;
(b) install and maintain an uninterruptible power supply system to operate the following essential equipment in the tunnel area for a minimum of 30 minutes-
(i) emergency lighting including essential tunnel lighting;
(ii) essential communication system;
(iii) computer system;
(iv) essential control and monitoring system;
(v) traffic control and surveillance system; and
(vi) toll collection system;(c) in addition to the requirements mentioned in paragraphs (a) and (b), provide and maintain in a state of readiness and in efficient working order at all times an electricity generating apparatus which, in the event of failure of the outside sources of electric power, will be sufficient to operate the following emergency systems and equipment in the tunnel area for a minimum of 6 hours-
(i) fire services systems;
(ii) all loads backed up by uninterruptible power supply;
(iii) emergency power points inside the tunnel;
(iv) air-conditioning for computer rooms, control rooms and uninterruptible power supply rooms;
(v) mechanical ventilation for battery rooms; and
(vi) emergency lighting, essential tunnel lighting and essential power points for ancillary buildings of the Tunnel Link; and(d) maintain in efficient working order at all times an emergency power supply for use in the tunnel by the Fire Services Department.
Cap 520A s 11 Control of dangerous goods
The Company shall take measures to prevent or control the carriage of dangerous goods through the Tunnel Link to the satisfaction of the Commissioner.
Cap 520A s 12 Adequate manning requirements
The Company shall, to the satisfaction of the Commissioner-
(a) deploy adequate and efficient personnel for the safe and orderly passage of motor vehicles through the Tunnel Link and the control and safety of motor vehicles and persons in the tunnel area in accordance with the manning requirements approved by the Commissioner; and
(b) ensure that all the tunnel officers, who are engaged in traffic control and operational duties, are trained in fire fighting procedures, first aid techniques and the use of fire fighting and first aid equipment.
Cap 520A s 13 Display of notices of tolls and sale thereof
(1) The Company shall, to the satisfaction of the Commissioner cause to be displayed at both ends of the Tunnel Link, in conspicuous places, notices stating the toll payable in respect of each category of motor vehicle.
(2) The Company shall cause printed copies of a list of the tolls currently chargeable by the Company to be kept at the registered office of the Company and to be available for sale to any person at a reasonable charge.
Cap 520A s 14 Records on tunnel operation
(1) The Company shall at all times maintain, in form and substance satisfactory to the Commissioner, records relating to the operation of the Tunnel Link including-
(a) the frequency, duration, location, time and nature of any equipment failure and of any remedial action taken;
(b) the details of accidents or incidents that occurred in the tunnel area;
(c) the volume of traffic passing through the Tunnel Link during each hour by vehicle type;
(d) the breakdown, according to vehicle type, of tolls collected on each day;
(e) the times at which each toll booth is kept open and the starting and finishing times at which it is operated by a particular tunnel officer;
(f) all cash and other receipts deriving from the use of the Tunnel Link;
(g) air quality and ventilation fan operation;
(h) books and records for financial assessment; and
(i) the staffing situation in connection with the operation of the Tunnel Link.(2) The Commissioner may, with such assistance from the Company as the Commissioner may reasonably require, have free access to and make copies of records maintained under subsection (1).
Cap 520A s 15 Records on tunnel maintenance
(1) The Company shall at all times maintain, in form and substance satisfactory to the Director of Highways, records relating to the inspections, routine maintenance, repair and replacement of the tunnel area and the tunnel facilities including-
(a) the time, duration, location and nature of inspection and maintenance works;
(b) the time, duration, location and nature of failure or defects of the tunnel facilities;
(c) the time, duration and location of parts, equipment and facilities replaced; and
(d) the staffing situation in connection with the maintenance of the tunnel area and tunnel facilities.(2) The Director of Highways may, with such assistance from the Company as the Director of Highways may reasonably require, have free access to and make copies of records maintained under subsection (1).
Cap 520A s 16 Uniforms and identification
A tunnel officer on duty shall-
(a) except in the case of the Tunnel Manager, wear a uniform of a design approved by the Commissioner of Police;
(b) carry such means of identity issued by the Company and approved by the Commissioner; and
(c) promptly produce to any person who on reasonable grounds requests him to do so his means of identity and evidence of appointment.
