第556D章 第1条释义
第I部
导言
在本附例中,除文意另有所指外─
“中央分道带”(central reservation) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“公共小巴”(public light bus) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“公共小巴站”(public light bus stand) 指划定为公共小巴站、而公共小巴可在其内停泊或为上落乘客而停留的道路范围;
“巴士站”(bus stop) 指划定为巴士站、而专利巴士可在其内停泊或停车上落乘客的道路范围;
“司机”(driver) 就任何车辆而言,指任何掌管或协助控制该车辆的人;
“交通标志”(traffic sign) 指标志、物件或设备,用以向道路使用者传达任何警告、资料、要求、限制、禁止或指示的讯息;
“管制灯号”(light signal) 指管制车辆交通或行人的照明讯号,包括《道路交通(交通管制)规例》(第374章,附属法例)附表4订明的黄色球体;
“管制灯号控制的过路处”(light signal crossing) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中“交通灯控制的过路处”(light signal crossing) 的涵义相同;
“行人安全岛”(pedestrian refuge) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“汽车”(motor vehicle) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“车主”(owner) 在有车辆登记在某人名下的情况下,包括该人,以及保管和使用该车辆的人,而就根据租用协议或租购协议租售的车辆而言,则指根据该协议拥有车辆的人;
“车路”(carriageway) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“车辆”(vehicle) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“定额罚款”(fixed penalty) 指第37条订明的罚款;
“法律程序”(proceeding) 指根据第42或45条在裁判官席前进行的法律程序;
“泊车位”(parking space) 指由地铁公司以订明交通标志或订明道路标记指明供停泊车辆的运输交汇处内的空位;
“泊车”、“停泊”(parking) 的涵义与《道路交通(泊车)规例》(第374章,附属法例)中该两词的涵义相同;
“的士”(taxi) 的涵义与《道路交通条例》(第374章)中该词的涵义相同;
“的士候客处”(taxi rank) 指以订明交通标志、订明道路标记或订明管制灯号划定的、由一个或多于一个的士候客位组成的区域;
“的士候客位”(taxi bay) 指在的士候客处内以订明交通标志或订明道路标记划定的单一的士候客位、供的士在其内停车或候客或让乘客下车;
“的士轮候车道”(taxi queue lane) 指以订明交通标志、订明道路标记或订明管制灯号划定、供的士排队进入的士候客处的行车;
“指明路”(specified route) 的涵义与《公共巴士服务条例》(第230章)中该词的涵义相同;
“订明交通标志”(prescribed traffic sign) 指符合附表1订明的或符合根据《道路交通(交通管制)规例》(第374章,附属法例)或《道路交通(公共服务车辆)规例》(第374章,附属法例)订明的设计、大小、颜色及类型的交通标志;
“订明管制灯号”(prescribed light signal) 指符合附表1订明的或符合根据《道路交通(交通管制)规例》(第374章,附属法例)附表3订明的设计、大小、颜色及类型的管制灯号,并包括该规例附表4所订明的黄色球体;
“订明道路标记”(prescribed road marking) 指符合附表1订明的或符合根据《道路交通(交通管制)规例》(第374章,附属法例)或《道路交通(公共服务车辆)规例》(第374章,附属法例)订明的设计、大小、颜色及类型的道路标记;
“限制”、“具限制作用的”(regulatory) 就订明交通标志、订明道路标记或订明管制灯号而言─
(a)指附表1所载的标志、标记或管制灯号的性质;或
(b)在不遵从该标志、标记或管制灯号即构成犯《道路交通条例》(第374章)、《道路交通(交通管制)规例》(第374章,附属法例)或《道路交通(公共服务车辆)规例》(第374章,附属法例)所订罪行的情况下,指该标志、标记或管制灯号的性质;“限制区”(restricted zone) 指由地铁公司以订明交通标志或订明道路标记划定的在运输交汇处内的任何区域,而任何车辆的司机或任何指明种类或类别的车辆的司机在指明的日子、在任何一日的指明时间内、或在任何指明日子的指明时间内在该区域─
(a)让乘客上车或落车;或
(b)装载或卸下行李或货物,是被禁止的;
“停车票”(ticket) 指由地铁公司发出、代表地铁公司发出或在取得地铁公司的认可或同意下发出的任何性质及类别藉以使用停车场内的泊车位的票据或卡;
“停车场”(car park) 指由地铁公司拨出和划定,内有供按照第11条停泊车辆用的泊车位的运输交汇处的部分;
“专利巴士”(franchised bus) 在有根据《公共巴士服务条例》(第230章)就巴士批予的专营权而该专营权正有效的情况下,指该巴士;
“专营公司”(grantee) 的涵义与《公共巴士服务条例》(第230章)中该词的涵义相同;
“被判决须付的款项”(sum adjudged to be paid) 指裁判官在任何法律程序中命令须缴付的款项,以及根据第51(2)(a)条判被告人须缴付的讼费;
“许可证”(permit) 指由地铁公司发出或获地铁公司就此而授权的其他人所发出,使车辆可在限制区内上落客或装载或卸下行李或货物,或驶入运输交汇处内的禁区或在禁区内驾驶的证件或授权;
“通行证”(pass) 指由地铁公司或获地铁公司就此而授权的其他人所发出、授权在泊车位停泊车辆的通行证件;
“斑马”(zebra crossing) 指在任何道路上设置的行人过路处,而该行人过路处的存在及界限均以《道路交通(交通管制)规例》(第374章,附属法例)附表4显示;
“斑马控制区”(zebra controlled area) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“登记地址”(registered address) 就在某人名下登记的汽车而言,指在署长根据《道路交通(车辆登记及领牌)规例》(第374章,附属法例)第4(1)条备存的车辆登记册上的该名登记车主的地址;
“登记车主”(registered owner) 指─
(a)在有汽车按照《道路交通条例》(第374章)登记在某人名下的情况下,指该人;及
(b)就系有根据《道路交通(车辆登记及领牌)规例》(第374章,附属法例)发出的试车字牌或许可证的汽车而言,指获发有关试车牌照或许可证的人;“发出条件”(conditions of issue) 指由地铁公司、代表地铁公司、或在取得地铁公司的认可或同意下不时公布及张贴在任何停车场、泊车位、限制区或禁区或有关部分的条件,而该等条件是就使用有关停车场或泊车位、或驾车驶入有关禁区或在有关禁区内驾驶、或在有关限制区内让乘客上车或落车或装载或卸下行李或货物而发出的停车票、通行证或许可证的发出条件;
“禁区”(prohibited zone) 指由地铁公司以订明交通标志或订明道路标记划定的在运输交汇处的任何区域,而任何车辆或任何指明种类或类别的车辆在指明的日子、在任何一日的指明时间内或在任何指明日子的指明时间内驶入该区域或在该区域行驶是被禁止的;
“违例事项”(contravention) 指违反附表2第II部所列明的任何条文;
“道路标记”(road marking) 指放置在或嵌于道路表面,用以向道路使用者传达任何警告、资料、规定、限制、禁止或指示的讯息的条、文字、记号或设备,包括路丘;
“过路处”、“行人”(crossing) 的涵义与《道路交通(交通管制)规例》(第374章,附属法例)中该词的涵义相同;
“获授权人”(authorized person) 指获地铁公司授权为施行本附例而代表地铁公司行事的人。
第556D章 第2条适用范围
(1)本附例适用于运输交汇处内所有人及车辆,运输交汇处的界由按照本条例第31条存放于土地注册处的经核证图则所划定。 (2000年第13号第64条)
(2)地铁公司须在─
(a)运输交汇处的每个车辆入口,放置或安排放置附表1第1号图形所示类型的适当订明的交通标志;及
(b)运输交汇处的每个车辆出口,放置或安排放置附表1第2号图形所示类型的适当订明交通标志。(3)就本附例而言,任何车辆或物件,如有部分在运输交汇处内,即当作在运输交汇处内。
第556D章 第3条限制的豁免
本附例的适用,须不致于─
(a)限制将车辆安全和方便地用于与任何建筑作业、拆卸或挖掘工程、移开任何交通障碍物、或维修、改善或重建任何道路、或安装、更改或修理任何污水渠或任何用以输送气体、水或电的总管道、喉管或器具、或任何电话线、电缆、配件或支架相关的目的的用途,但须将有关车辆作上述用途先获地铁公司批准;或
(b)正用于执行职能的消防车、救护车、警车、海关车辆、入境事务处车辆或武装部队使用的车辆。
第556D章 第4条交通管制
第II部
交通管制
(1)地铁公司须时刻容许公众人士及所有类型的车辆就所有合法目的,无须缴付任何费用而自由进入和通往运输交汇处,但须受本附例规限及停车场使用者须缴付费用。
(2)所有在运输交汇处内的人须受任何获授权人的管制及指示。
第556D章 第5条获授权人的指示
所有在运输交汇处内的人须遵从由获授权人所发出或作出的任何合理命令、讯号、要求、指令或指示。
第556D章 第6条订明交通标志、订明道路标记及订明管制灯号
(1)除非获授权人另有指示,否则所有在运输交汇处内的人须遵从任何在运输交汇处内竖立、展示或放置而具限制作用的订明交通标志、订明道路标记及订明管制灯号。
(2)在运输交汇处的任何部分内竖立、展示或放置的任何订明交通标志、订明道路标记及订明管制灯号如经获授权人遮盖、涂去或移走,则其根据本附例所具有的效力、作用或效用即予终止。
第556D章 第7条行人及安全
(1)任何人不得驾驶车辆、致使或容许他人驾驶车辆、或致使车辆停留,以致会危及或相当可能会危及在运输交汇处的任何人、车辆或财产。
(2)任何在运输交汇处内的行人─
(a)不得─
(i)在斑马控制区之内在斑马以外的地方横过道路;
(ii)在管制灯号控制的过路处15米范围之内在该等管制灯号所运作的过路处以外的地方横过道路;或
(iii)违反获授权人的任何指示而横过道路;(b)不得在过路处停留超过行毕该过路处所需时间;或
(c)不得攀越或穿过任何路边围栏或中央分道带而进入车路。(3)在斑马上的每一名行人,当在斑马时,较任何车辆享有优先权;如车辆或其任何部分驶至斑马或在斑马上之前,行人已在该斑马上,则该车辆的司机须让该行人先行:
但如在斑马上有一个行人安全岛或中央分道带,则位于行人安全岛或中央分道带每一边的斑马,须分别视为一条独立的斑马。
(4)(a)当一部车辆(在本款内称为“驶近的车辆”)或其任何部分在一个斑马控制区内,并正驶向该斑马,其司机不得致使该驶近的车辆或其任何部分─
(i)超越另一部正行驶的车辆的最前部分,而该另一部车辆是完全或部分位于该控制区内并朝同一方向行驶的;或
(ii)超越一部停定的车辆的最前部分,而该车辆与驶近的车辆同位于该斑马控制区内相同的部分,而该车辆完全或部分停在该控制区内是为了遵从第(3)款的,
除非该司机是为遵从获授权人的指示如此超车,则不在此限。
(b)就本款而言─
(i)在提述另一部正行驶的车辆时,如只有一部其他车辆正在斑马控制区内朝同一方向行驶,则指该车辆;如有一部以上的其他车辆正如此行驶,则指其中最接近斑马的一部车辆;
(ii)在提述一部停止的车辆时,如只有一部为遵从第(3)款而停车的车辆,则指该车辆;如有一部以上为遵从该款而停车的其他车辆,则指其中最接近斑马的一部车辆。(c)就本款而言,如在单程路上有一条斑马,而在该斑马上有一个行人安全岛或中央分道带,则位于该行人安全岛或中央分道带每一边的斑马,须分别视为一条独立的斑马。
第556D章 第8条订明交通标志、订明道路标记及订明管制灯号的管制
(1)除获授权人外,任何人在没有得到地铁公司事先授权下,不得在运输交汇处上或其中任何部分竖立、展示或放置、或致使或容许竖立、展示或放置任何与订明交通标志、订明道路标记或订明管制灯号相近的道路标记、交通标志或管制灯号,而其相近的程度是任何接近该标志、标记或管制灯号的人可能会误以为它是订明交通标志、订明道路标记或订明管制灯号的。
(2)任何获授权人可藉通知或指示,要求任何在违反第(1)款情况下竖立、展示或放置、或致使或容许竖立、展示或放置任何交通标志、道路标记或管制灯号的人将该标志、标记或管制灯号移走。如该人不遵从该通知或指示,则地铁公司可安排将该交通标志、道路标记或管制灯号移走或涂去(视属何情况而定),而该标志、标记或管制灯号及其所有附属物随即由地铁公司没收和归予地铁公司,而地铁公司可作为民事债项而向该人追讨如此移走和涂去的费用,以及因该等移走或涂去而导致需要将任何财产修复的费用。
(3)除获授权人外,任何人不得以任何方式移动、损坏、掩蔽、毁损、改动、涂去或干扰任何由地铁公司在运输交汇处或其中部分竖立、展示或放置的订明交通标志、订明道路标记或订明管制灯号。
第556D章 第9条禁止修理车辆
(1)除非得到地铁公司或获授权人的批准,否则任何人不得于运输交汇处的任何部分(包括停车场)内,进行任何车辆的维修或修理,或为进行该等维修或修理而处身于运输交汇处的任何部分内。
(2)在根据第(1)款进行的任何法律程序中,如能证明该等维修或修理属性质轻微的维修或修理,并且是为了使车辆从运输交汇处驶离或移走而必需的,即为好的免责辩护。
第556D章 第10条泊车位
第III部
在停车场以外泊车
(1)任何人于运输交汇处内停车场以外的任何地方或道路─
(a)除将车辆停泊在供有关的特定类别、类型或种类的车辆或任何特定种类的人在指定时段内使用的合适泊车位停泊外,不得停泊任何车辆;
(b)不得在违反任何由获授权人所发出的合法指示下、或是在违反在泊车位内或附近所竖立、展示或放置的任何具限制作用的订明交通标志、订明道路标记或订明管制灯号下,停泊任何车辆;
(c)不得在相当可能对地铁公司或对运输交汇处内的其他人、车辆或财产构成危险或阻碍的位置、方式、状况或情形下,停泊任何车辆;
(d)(如是拖车的话,除非有关拖车连同和连接上一辆能拖动该拖车的车辆)不得停泊该拖车;或
(e)除在获得按照第16条发出的通行证的发出条件授权而停泊外,不得停泊任何车辆。(2)任何人在泊车位停泊车辆,停泊方式不得令致该车辆不必要地超越任何划定该车辆应妥为停泊的空间的界、订明交通标志或订明道路标记所示的标志或标记。
(3)任何人不得在没有合理辩解下,在泊车位鸣响警报器具。
(4)任何人不得在泊车位─
(a)吸烟;或
(b)无合理辩解而拥有任何经毁坏、污损或更改的通行证或补发的通行证。(5)任何人如无合法权限或合理辩解,不得登上、干预或干扰泊车位内的车辆。
第556D章 第11条停车场
第IV部
停车场
(1)地铁公司可拨出和指定运输交汇处内的任何地方作停车场之用,并可以其认为适合的方式将停车场内的任何泊车位或停车场的任何部分限定供任何类别的车辆或任何特定类型或种类的车辆使用,亦可将停车场内的任何泊车位或停车场的任何部分分配给任何人或任何特定种类的人使用,以及可将该项限定或分配撤销或修订。
(2)地铁公司可以其认为适合的方式,限定任何类别或任何特定类型或种类的车辆进入或使用或离开停车场的时间或日子,以及可将该项限定撤销或修订。
(3)获授权人可拒绝违反第(1)或(2)款有关使用停车场的限制的车辆进入停车场。
第556D章 第12条停车场用的交通标志、道路标记及管制灯号
地铁公司可在停车场内或外面最近处(但在运输交汇处内)竖立、展示或放置、或致使竖立、展示或放置其认为规管和指引停车场内泊车和交通所需的交通标志、道路标记或管制灯号,尤其是用以显示车辆进入和离开停车场的地方的交通标志、道路标记或管制灯号。
第556D章 第13条关闭的权力
如地铁公司于停车场关闭前藉发表通知并将通知张贴于停车场或其任何部分而关闭停车场或该部分,在关闭期间任何人不得在停车场内或该部分停泊任何车辆,或致使或容许任何车辆停泊或留在停车场内或该部分。
第556D章 第14条司机在停车场内所犯罪行
(1)停车场内车辆的司机须遵从所有由获授权人向他发出的合法指示。
(2)除第(1)款另有规定外,停车场内的司机须遵从所有依据第12条竖立、展示或放置而具限制作用的订明交通标志、订明道路标记及订明管制灯号。
(3)任何人不得在无合理理由下在停车场内鸣响警报器具。
(4)如任何人在停车场停泊车辆,停泊方式不得令致该车辆不必要地超越任何划定该车辆应妥为停泊的泊车位的界或其他标记。
(5)任何人不得将任何车辆停泊在停车场,亦不得致使或容许任何车辆停泊在停车场,除非─
(a)该车辆是在指定时段内停泊在供该特定类别、类型或种类的车辆停泊的适当泊车位的;或
(b)该车辆是在指定时段内停泊在供某特定种类的人使用的适当泊车位的。(6)任何人不得于停车场内泊车,致使其泊车位置或方式或状况或情形可能会危及或阻碍地铁公司或在运输交汇处的其他人、车辆或财产。
(7)除藉按第16条发出的通行证或停车票的条件的授权外,任何人不得在停车场泊车。
第556D章 第15条停车场内的罪行
(1)任何人没有得到获授权人的准许,不得进入停车场,但下述的人除外─
(a)正在执行职务的受雇于停车场的人;
(b)驾驶车辆进入停车场拟将车停泊、或进入停车场拟将车辆移离停车场的人;
(c)在进入停车场时,是为泊车的车辆内的乘客,或作为某车辆上的乘客而拟离开停车场的人;或
(d)任何因合理需要而进入停车场某部分的人。(2)任何人不得在停车场内─
(a)吸烟;或
(b)无合理辩解而拥有任何经毁坏、污损或更改的停车票、通行证或补发的停车票或通行证。(3)任何人无合法权限或合理辩解,不得登上停车场内的车辆,也不得干预或干扰停车场内的车辆。
(4)除根据第33条移走的车辆外,就任何车辆招致的泊车费如没有缴付,或没出示有效停车票或有效通行、或没有将该停车票或通行证插入自动设备、或没有按照本附例以其他方式使用该停车票或通行证,则获授权人可拒绝让该车辆离开停车场。
第556D章 第16条停车票及通行证的发出
第V部
停车票、通行证及许可证
地铁公司有权自行或经获委派代表地铁公司的其他人在有关发出的条件及本附例有关条文的规限下,不时就停车场及当中的泊车位的使用发出停车票,以及就运输交汇处内的泊车位的使用发出通行证。
第556D章 第17条通行证
(1)根据第16条发出的通行证,须符合地铁公司批准的格式,并须将下列资料列明于通行证上─
(a)通行证有效适用的车辆的登记号码;
(b)通行证有效适用的停车场或泊车位的识别资料;
(c)通行证有效适用的期限;及
(d)地铁公司认为适当的其他资料。(2)地铁公司可根据第16条发出由其决定期限的通行证。
(3)根据第16条就任何车辆发出的通行证,并不保证该通行证有效适用的停车场内有可供该车辆停泊的泊车位或地方。
(4)获发给通行证的车辆,可于通行证有效期的任何时间内,在拟停泊该部通行证有效适用的车辆的任何泊车位或地方停泊,但仍须受第33(2)(b)及(c)条规限。
(5)持有按第16条发出的通行证所适用车辆的司机,须于进出停车场、或在泊车位停泊、或从泊车位移走车辆时,在适用的情况下─
(a)向获授权人交出通行证以供查阅;
(b)将通行证插入用以让车辆驶进或驶离停车场、或停泊在泊车位、或从泊车位移走车辆的自动装置;
(c)在车辆的挡风玻璃当眼处张贴通行证;或
(d)按通行证的发出条件所规定的方式持有或展示通行证。
第556D章 第18条停车票
(1)按照第16条获发给有效停车票的司机,须保留该停车票,及为达到将车辆移离停车场的目的,司机或任何获司机或有关车主授权交出该停车票以移走车辆的其他人,须按照地铁公司指定的地点及方式,出示该停车票。停车票须在该地点标明出示停车票的时间及停车费用;而停车费用则按地铁公司不时订明的适当收费率由该票注明车辆的进入时间至停车票显示的出示停车票的时间计算;而该人从停车场移走车辆前,须缴付该费用。
(2)在第(1)款所提述的人按照第(1)款条文缴付有关停车费用后,有关车辆须在停车费缴付后15分钟内或在切实可行时间内(以较早的时间为准)尽快从停车场移走。
(3)如车辆没有在依据第(2)款指定的时限内从停车场移走,则不得准许司机移走该车辆,直至就该车辆超逾依据第(2)款指定的时限而停留在停车场的所有时间,按地铁公司不时订明的适当收费率所计算的额外费用缴付为止。
(4)获发给停车票的车辆,可于任何时间内,在该停车票有效适用的停车场内的任何泊车位泊车,但仍须受第33(2)(c)条的规限。
第556D章 第19条遗失停车票或通行证
如在任何时间任何人意欲从停车场或泊车位将车辆移走,而不能出示就该车辆发出的有效停车票或通行证,如他能令获授权人信纳他已得到该车辆的车主授权、或已得到获发停车票或通行证的人授权将该车辆移走,则他可将车辆移走,但须缴付补发的停车票或通行证的费用,该费用按地铁公司不时订明的适当收费率计算。
第556D章 第20条许可证
(1)地铁公司有权自行或经不时获委派代表地铁公司的其他人发出许可证,但须受发出条件及本附例有关驾驶车辆进入禁区及在禁区内驾驶、在限制区内上落客或装卸行李或货物的条文所规限。
(2)获按照第(1)款的条文发给有效许可证的车辆的司机,须于进入禁区之前或之时,或在限制区上落客或装卸行李或货物之前或之时─
(a)向获授权人交出许可证以供查阅;
(b)在车辆的挡风玻璃当眼位置张贴许可证;
(c)将许可证插入用以授权车辆内进的自动装置;或
(d)按许可证的发出条件所规定持有或展示许可证。
第556D章 第21条发出条件
(1)所有由地铁公司或代表地铁公司发出的停车票、通行证及许可证,均在本附例及发出条件规限下发出。
(2)任何人获发给或由他人代其就其车辆获发给停车票、通行证或许可证、或以其他方式取得停车票、通行证或许可证,须当作知悉并已同意遵从本附例及发出条件。
第556D章 第22条的士候客处、的士候客位及的士轮候车道
第VI部
专利巴士、公共小巴及的士
(1)特定种类、类型或类别的的士须于以订明交通标志、订明道路标记或订明管制灯号指定作该用途的的士候客处内的士候客位停车或等候出租。除获授权人另有指示外,任何其他车辆不得驶入的士候客处或的士轮候车道。
(2)的士司机须遵从所有由获授权人为的士候客处、的士候客位及的士轮候车道或其中部分有规律运作而发出的合法指示。
(3)除第(2)款另有规定外,的士司机须遵从所有为的士候客处、的士候客位及的士轮候车道或其中部分有规律运作而竖立、展示或放置的具限制作用的订明交通标志、订明道路标记及订明管制灯号。
第556D章 第23条巴士站
(1)以订明交通标志或订明道路标记指定为巴士站的道路范围,可指定供一间或多间专营公司或一条或多条指明路使用。除获授权人另有指示外,任何并非属专利巴士的车辆不得于任何巴士站停泊或上落客。
(2)有关的专营公司须按地铁公司的书面要求,在巴士站竖立及维持经署长批准的某类型的标志(并由该专营公司支付有关费用),指明有关专营公司及指明路,该标志亦须达到地铁公司满意的水平。
(3)专利巴士的司机须遵从所有由获授权人为巴士站有规律运作而发出的合法指示。
(4)除第(3)款另有规定外,专利巴士的司机须遵从为巴士站有规律运作而竖立、展示或放置的所有具限制作用的订明交通标志、订明道路标记及订明管制灯号。
第556D章 第24条公共小巴站
(1)以订明交通标志或订明道路标记指定为公共小巴站的道路范围,可指定只供一名或多名公共小巴营办商或一条或多条公共小巴路使用。除获授权人另有指示外,任何并非属公共小巴的车辆不得在任何公共小巴站内停泊或上落客。
(2)有关的公共小巴营办商须按地铁公司的书面要求在公共小巴站竖立及维持标志(并由该公共小巴营办商支付有关费用),指明有关的营办商及有关路,该标志亦须达到地铁公司满意的水平。
(3)公共小巴的司机须遵从所有由获授权人为公共小巴站有规律运作而发出的合法指示。
(4)除第(3)款另有规定外,公共小巴的司机须遵从为公共小巴站有规律运作而竖立、展示或放置的所有具限制作用的订明交通标志、订明道路标记及订明管制灯号。
第556D章 第25条上落客
(1)除在巴士站或其他由地铁公司指定或获授权人指令的地方外,专利巴士的司机不得在运输交汇处范围内停车上落客。
(2)除在公共小巴站或其他由地铁公司指定或获授权人指令的地方外,公共小巴的司机不得在运输交汇处范围内停车上落客。
(3)除在的士候客位、或在运输交汇处内不属限制区而容许作的士上落客用途的其他地方、或依据按地铁公司所指定或获授权人所指令的地方外,的士司机不得在运输交汇处内停车上落客。
第556D章 第26条在的士轮候车道、的士候客处及的士候客位的行为
(1)在指定用作的士轮候的的士轮候车道内的的士司机,须坐在其车内,并须跟随紧接在他前面的的士驶上该的士轮候车道的前方。
(2)除第(4)款另有规定外,的士司机须遵从在的士轮候车道竖立、展示或放置的所有具限制作用的订明交通标志、订明道路标记及订明管制灯号,并须有秩序地在的士轮候车道停车或驶向的士候客处,以供他人即时租用。
(3)除的士以外,任何车辆不得驶入的士轮候车道、的士候客处或的士候客位。
(4)的士司机须遵从获授权人的指令,于的士轮候车道停车,或有秩序地向的士候客处前进,以供他人即时租用。
(5)除在获授权人的指令下,的士不得从的士轮候车道的前方以外的地方驶上有空位的的士候客位。
(6)在的士轮候车道内等候或驶近的每一辆的士的司机须跟随紧接在他前面的的士将的士驶上前或从订明交通标志或订明道路标记所指定供该用途的车道,即时离开的士轮候车道。
(7)在的士候客位停车的的士不得不必要地超越订明道路标记。
(8)如有人拟租用的士─
(a)他须有秩序地、并遵从获授权人的指令,在的士候客位等候或向候客位前进;
(b)在的士候客位的的士司机须接受租用;及
(c)的士司机不得在的士候客位以外的地方接受租用。(9)除遵从第(8)(b)款在的士候客位等候外,的士司机不得以任何方式兜客或吸引或致力兜客或吸引任何人以诱使任何人使用的士。
(10)除在以订明交通标志或订明道路标记指定作为泊车位的地方外,的士司机不得将的士停泊在其他地方。但就本附例而言,须将在的士候客位停车或等候出租的的士当作为并非停泊。
第556D章 第27条禁止进入或使用
第VII部
禁区及限制区
(1)除以订明交通标志或订明道路标记豁免,或按第20(1)条获发许可证的特定类别、类型或种类的车辆外,任何车辆不得─
(a)进入以订明交通标志或订明道路标记指明的运输交汇处内的禁区或在当中驾驶;或
(b)在以订明交通标志或订明道路标记指明的运输交汇处内的限制区停车上落客或装卸行李或货物。(2)在不损害第23(2)及24(2)条的规定下,经营任何路的营办商、或任何类别、类型或种类的车辆,须按地铁公司的书面要求,在地铁公司所指定的禁区或限制区内的位置,竖立及维持指定的标志(并自行负担有关费用),指明有关营办商及有关路。
(3)车辆的司机须遵从所有由获授权人为禁区或限制区有规律运作而发出的所有合法指示。
(4)除第(3)款另有规定外,车辆的司机须遵从为禁区或限制区有规律运作而竖立、展示或放置的所有具限制作用的订明交通标志、订明道路标记及订明管制灯号。
第556D章 第28条《地下铁路附例》
第VIII部
《地下铁路附例》的应用
(1)除由第(2)款纳入本附例并按本附例明文述明或提述者外,《地下铁路附例》(第556章,附属法例)的条文不适用于运输交汇处。
(2)《地下铁路附例》(第556章,附属法例)第IV、V、VII及VIII部的适用范围,在可用及与本附例无抵触的情况下,须扩及并适用于运输交汇处内的所有地方。本附例与《地下铁路附例》(第556章,附属法例)有抵触时,则须以本附例为准。
(3)在将第(2)款所提述的《地下铁路附例》(第556章,附属法例)部分条文应用于运输交汇处时,所有“铁路处所”一词须解释为运输交汇处。
第556D章 第29条停车、交出和提供资料的义务
第IX部
权力及资料
(1)如某获授权人有理由怀疑任何人犯了本附例所订的罪行,在该获授权人的要求下,该人须─
(a)向该获授权人提供他的姓名及地址及电话号码(如有的话)的真实而正确的详情,并交出有关证明以供查阅;及
(b)在有关和适用的情况下─
(i)立即停车或按照获授权人的命令、指示或讯号,前往运输交汇处内任何地方,并在该处停车;
(ii)向该获授权人交出其驾驶执照以供查阅;及
(iii)如他并非登记车主而知悉有关车辆的登记车主的姓名或名称及地址,向该获授权人提供该等资料。(2)任何在运输交汇处内的车辆的司机须应获授权人为规管车辆或行人交通而发出的命令、指示或讯号而─
(a)立即停车;或
(b)按照命令、指示或发出的讯号前往运输交汇处内任何地方,并在该处停车。(3)任何与本附例所订的指称的罪行或与本条或第31(1)条述及的任何其他情况有关而使用的车辆的登记车主或任何怀疑是该车辆的司机的人,须于获授权人提出要求后21日之内,提供他所知悉而使地铁公司能确定在指称的罪行发生时有关车辆的司机的姓名或名称及地址的所有资料。
(4)任何人不得故意─
(a)不遵从根据第(1)(a)或(b)(iii)或(3)款所提出的要求;或
(b)在遵从或试图遵从根据第(1)(a)或(b)(iii)或(3)款提出的要求时,提供姓名或名称、地址或电话号码的虚假资料,或有关姓名或名称、地址或电话号码在要项上具误导性的资料。
第556D章 第30条陈述书的接纳
就本附例所订罪行而提出的检控中,有某份向法庭呈示的陈述书看来是已由被控人签署、并且是按照根据第29(3)条向被控人提出的要求而提交的、而该陈述书述明被控人在罪行发生时是该车辆的驾驶人,则法庭须接纳该陈述书为在该罪行发生时被控人是该车辆的驾驶人的表面证据。
第556D章 第31条检查和扣留的权力
(1)如获授权人有理由怀疑某车辆或该车辆的车主或司机运载《危险品条例》(第295章)所提述的危险品,获授权人可进入、检查和搜索该车辆及车内或车上的任何物品。
(2)每名获授权人有权扣留任何他有合理理由怀疑曾犯了本附例的罪行的人,或扣留任何他有合理理由怀疑涉及犯了本附例的罪行的车辆(如有需要,可使用合理武力达此目的),直至该人或该车辆或两者可交付警务人员羁押或保管,以按照法律处置为止;上述的扣留对按照本附例所施加的任何费用、收费或车辆的移走或锁押并无影响。
第556D章 第32条车轮上锁
地铁公司或任何获授权人可将任何违反任何具限制作用的订明交通标志、订明道路标记或订明管制灯号、或违反由获授权人发出的指示而停泊或停放在运输交汇处的车辆的车轮上锁,或以任何作此用途的机械装置使该车辆不能移动,直至不再有上述违反事宜为止;而该车辆的车主或司机有责任于车辆发还前向地铁公司缴付由该公司按第35条厘定的锁押费。
第556D章 第33条移走车辆
(1)任何获授权人可在运输交汇处内任何部分,将任何违反任何具限制作用的订明交通标志、订明道路标记或订明管制灯号、或违反由获授权人发出的指示而在运输交汇处内停泊或停放的车辆移动或从运输交汇处移走,或将地铁公司或任何获授权人认为可能对在运输交汇处内的任何人、车辆或物件构成危险、或造成障碍或危及其安全而在运输交汇处内停泊或停放的任何车辆移动或从运输交汇处移走。
(2)任何获授权人可从运输交汇处移走在运输交汇处内─
(a)违反第10(1)、(2)、14(1)、(2)、(4)、(5)、(6)或(7)条而停泊或容许停留的车辆;
(b)在停车场外的泊车位连续停泊或容许停留超过24小时的车辆;或
(c)在停车场停泊或容许停留连续超过7日的车辆,但如与停泊该车辆的停车票或通行证有关的发出条件另作准许者则除外。
第556D章 第34条扣留和处置车辆
(1)任何根据第32条或第33条在运输交汇处锁上的车辆或从运输交汇处移走的车辆可被地铁公司扣留,除非已向地铁公司缴付已招致的泊车费以及地铁公司按第35条厘定而附加的上述锁押费或移走费及该公司按照第35条厘定的存放费(而不减损该公司按本条规定扣留车辆的权力),地铁公司可扣留按第32或33条从运输交汇处上锁移走之任何车辆,该笔费用将构成该车辆的车主或司机欠地铁公司的民事债项。
(2)车辆按照第(1)款被扣留时,地铁公司如知道车主的姓名或名称及地址,则须以书面将扣留车辆一事通知车主,如车主在该车辆首次被扣留之日起3个月内没有提出申索亦没有缴付泊车费、锁押费、移走费及存放费,则地铁公司可藉公开拍卖或以其他方式出售或处置该车辆,并可运用从售卖或处置该车辆的得益(如有的话),以─
(a)缴付该车辆停泊或获容许停留在停车场期间所招致的任何泊车费;
(b)缴付任何锁押费、移走费、存放费和藉公开拍卖出售该车辆所招致的费用(如有的话);及
(c)缴付地铁公司招致的行政费、费用及开支,任何余款须付给车主。如车主未能于售卖或处置车辆的12个月期限届满前提出申索,则任何余款即成为地铁公司的财产。
第556D章 第35条厘定和收取费用
(1)地铁公司可不时厘定和更改第32及34条规定的费用、收费及开支,并且须于地铁公司认为适当及当眼的位于运输交汇处内的地方,张贴列明适用的费用、收费及开支的通知。
(2)地铁公司可厘定及更改使用停车场及其内所有泊车位的费用及收费方法。
(3)获授权人有权向有责任缴付本条规定的费用、收费或开支的人收取有关费用。
第556D章 第36条署长的批准
地铁公司须就下列事项先取得署长的批准─
(a)由指明路的专营公司在运输交汇处内指定巴士站竖立及维持的标志的类型;及
(b)根据本附例厘定或更改发还车轮遭上锁的车辆的锁押费及为发还未获授权而停泊或非法停泊而被扣留的车辆的移走费及存放费。
第556D章 第37条定额罚款
第X部
定额罚款
任何人违反附表2第II部第1栏所列明的条文,均须缴付定额罚款,款项相等于列于附表2第II部第3栏的定额罚款。
第556D章 第38条登记车主的法律责任
(1)须就第37条所指的定额罚款负上法律责任的人,为有关汽车于违例事项发生时的登记车主及触犯该违例事项的车辆司机。
(2)在追讨定额罚款的任何法律程序中─
(a)登记车主如证明在该违例事项发生时,有关汽车已在没有其同意下被并非其所雇用的司机的人取去和驾走,或已被盗去,即为好的免责辩护;
(b)除第(1)款另有规定外,以下情况不能作为免责辩护─
(i)违例事项是在登记车主不知情或在没有登记车主同意下所犯的;或
(ii)在违例事项发生时,有关汽车并非由登记车主本人驾驶或掌管。
第556D章 第39条定额罚款通知书
(1)获授权人如有合理因由相信有第37条所述的违例事项正在或已经发生,可给予有关车辆的登记车主或须负法律责任的司机一个机会,藉缴付定额罚款而解除其就该项违例事项所负的法律责任。
(2)为施行第(1)款的规定,符合附表3表格1所示格式的通知书,须面交掌管该车辆的人或固定地附于该车辆上。
(3)如定额罚款在违例事项发生之日后21日内仍未缴付,则须将一份符合附表3表格2所示格式的通知书送达须负法律责任的人,以─
(a)要求缴付定额罚款;及
(b)告知该人如他意欲就该项违例事项的法律责任提出争议,则应如此告知地铁公司。(4)尽管有第(3)款的规定─
(a)如地铁公司认为不应就该项违例事项提出进一步的法律程序;或
(b)在该项违例事项发生之日起计满6个月后,则不得根据该款送达通知书。
(5)第(3)款所指的通知书,如有地铁公司或其授权的获授权人的名称或姓名印于或签署于其上,即属有效。
(6)第(3)款所指的通知书,可以邮递方式寄往下述地址而送达─
(a)(如送予登记车主)登记车主的登记地址;或
(b)(如送予司机)司机通常工作或居住的地址。(7)第(3)款所指的通知书须符合订明的格式,并须述明须负法律责任的人须在该通知书的日期后的10日内─
(a)缴付定额罚款;或
(b)告知地铁公司他意欲就该项违例事项的法律责任提出争议。(8)任何符合附表3表格3所示格式并看来是由地铁公司或代地铁公司签署的邮递证明书,一经由申诉人向裁判官提交,即须获接纳为证据而无须再作证明,而且在相反证明成立前,须推定─
(a)该份证明书是经如此签署的;及
(b)该份证明书所关乎的第(3)款所指通知书已妥为送达。(9)尽管有第(2)款的规定,即使没有遵从该款的规定,并不影响本条或第42条的实施。
第556D章 第40条定额罚款的缴付
(1)任何人接获符合附表3表格1或2所示格式的通知书,可在该通知书所述的期限内以下列方式缴付定额罚款─
(a)以邮递方式寄交告士打道7号入境事务大楼库务署署长;或
(b)亲自或透过其代理人在下列地点缴付─
(i)通知书所指明的库务署税收组或任何库务署分署;
(ii)通知书所指明的任何裁判法院;或
(iii)通知书所指明的任何民政事务处。(2)任何人意欲按照第(1)款缴付定额罚款,须将与该项缴款有关的通知书连同缴付的款项一并交付。
(3)凡按照本条缴付任何款项,所缴付的款项须为通知书所指明的款额;如就多于1份通知书缴款,则所缴款项须为该等通知书所指明款额的总和。
(4)根据第(1)款缴付的款项,不得包括关乎并非该份或该等通知书所指明的事宜的款额,亦不得构成关乎并非该份或该等通知书所指明的事宜的款额的一部分。
(5)任何款额如非按照本条缴付,库务署署长可将款额退回付款人。
(6)除第(5)款另有规定外,库务署署长须在切实可行范围内,向缴付定额罚款的人发给收据。
(7)除第49条另有规定外,在根据第39条送达的通知书所订明的时限过后才作出的缴费,一概不予接受。
第556D章 第41条定额罚款通知书的撤回
(1)凡第39(3)条所指的通知书已送达某人,地铁公司可在就该通知书所指明的违例事项而针对该人提出的法律程序展开之前的任何时间,且不论申请第42(2)条所指的命令是否已经提出(但必须在该项命令作出之前),将该通知书撤回;地铁公司并可将一份书面通知送达该人,告知他上述的通知书已被撤回。
(2)凡第39(3)条所指的通知书已根据本条撤回,而有任何款项已依据该通知书缴付,库务署署长须应获送达该通知书的人的要求,将已如此缴付的款项付还该人。
第556D章 第42条定额罚款的追讨
(1)任何人获送达第39(3)条所指的通知书后,如已按照该通知书告知地铁公司他意欲就法律责任提出争议,则有关事宜须由裁判官于接获申诉后,按照本附例循简易程序作出裁定。
(2)任何人获送达第39(3)条所指的通知书后,如没有缴付定额罚款,亦没有按照该通知书告知地铁公司他意欲就该项违例事项的法律责任提出争议,则裁判官须应申请(该申请可在该人缺席的情况下提出),命令该人在有关此项命令的通知书送达14天内,缴付定额罚款及一项相等于定额罚款款额的附加罚款。
(3)裁判官凡根据第(2)款作出命令,须安排将有关该项命令的通知书送达该项命令所关乎的人。
(4)有关根据第(2)款作出的命令的通知书,可以邮递方式寄往下述地址而送达─
(a)(如送予登记车主)登记车主的登记地址;或
(b)(如送予司机)司机通常工作或居住的地址。(5)在第(1)或(2)款所指的法律程序中,申诉或申请须以地铁公司的名义提出,但无须签署。
(6)地铁公司可委任任何人或任何种类的人进行第(1)及(2)款所指的法律程序。
第556D章 第43条法律程序的覆核
(1)如裁判官信纳须负法律责任的人并非由于本身疏忽而没有获悉第39(3)条所述的通知书,则裁判官可应申请(而关于该项申请,地铁公司已获给予合理通知)将根据第42(2)条作出的命令撤销,并且可按以下规定处理─
(a)如该人意欲就该项违例事项的法律责任提出争议,可命令有关事宜按照第42(1)条裁定;或
(b)如该人并不意欲就法律责任提出争议,则─
(i)可命令他在命令作出10日内缴付定额罚款;及
(ii)命令如他没有在该段期间内缴付该项定额罚款,则他有法律责任立即缴付该项定额罚款及一项相等于定额罚款款额的附加罚款。(2)第(1)款所指的申请可由申请人亲自提出,亦可由大律师或律师提出,而为了确保证人出庭和概括而言为了进行法律程序,裁判官具有任何裁判官根据《裁判官条例》(第227章)聆讯申诉时所具有的一切权力。
(3)第(1)款所指的申请,须由裁判官信纳是第42(2)条所述命令所关乎的人本身最早获悉该项命令的日期14日内提出。
(4)裁判官可应地铁公司在任何时间提出的申请,基于好的因由而将任何缴付定额罚款的命令及任何其他在同一法律程序中作出的命令撤销。
(5)尽管有《裁判官条例》(第227章)第26条的规定,如裁判官根据第(1)(a)款作出命令,则法律程序可在该项命令的日期起计6个月内提出。
第556D章 第44条传票的送达
(1)尽管有《裁判官条例》(第227章)第8(2)条的规定,在第42(1)条所指的任何法律程序中发出的传票,可以邮递方式寄往下述地址而送达─
(a)(如送予登记车主)登记车主的登记地址;或
(b)(如送予司机)司机通常工作或居住的地址。(2)任何符合附表3表格4所示格式并且看来是由地铁公司或代地铁公司签署的邮递证明书,一经由申诉人向裁判官提交,即须获接纳为证据而无须再作证明,而且在相反证明成立前,须推定─
(a)该份证明书是经如此签署的;及
(b)该份证明书所关乎的第(1)款所指传票已妥为送达。
第556D章 第45条在被告人缺席的情况下进行法律程序
(1)根据第44(1)条获送达传票的人,如没有在进行有关申诉的聆讯或延期聆讯的指定时间和地点到裁判官席前应讯,则除第(2)款另有规定外,裁判官可就该宗申诉进行聆讯,并作出在各方面均完全而有效的判决,犹如该人已遵照传票亲自到他席前应讯一样。
(2)除非─
(a)根据第44(2)条证明传票已经送达;或
(b)被告人先前已出庭就该宗申诉作出答辩,否则裁判官不得在被告人缺席的情况下开始聆讯该宗申诉。
(3)为施行第(2)款,尽管有第44(2)条的规定,除非传票已在其内所指定的出庭时间前的一段裁判官认为合理的时间内送达,否则该传票须当作未曾送达。
第556D章 第46条在第42或45条所指的法律程序中的证明
即使《裁判官条例》(第227章)的任何条文另有规定,在第42(2)条所指的任何申请中,或在第45条所指的在被告人缺席的情况下进行的任何法律程序中,如申请人或申诉人向裁判官提交以下文件─
(a)根据第39(3)条送达的通知书的副本,以及该条第(8)款所指的邮递证明书;及
(b)第50条所指的证明书,则第42(2)条所指的命令即须作出,或有关申诉的实质内容即可藉此而获得证明。
第556D章 第47条申诉的聆讯
(1)被告人如出席聆讯而不承认申诉的内容属实,则须随即陈述其免责辩护的性质;如他在该阶段没有就根据第50条提交的证明书内所指称的任何事实以明示方式提出质疑以待裁决,则他日后不得就该份证明书内所载的该事实提出争议,亦不得举证否定该事实。
(2)如被告人已按照第(1)款就任何指称的事实提出质疑以待裁决,则裁判官可就该宗申诉进行聆讯和作出判决,或将法律程序延期和发出传票传召任何证人出庭。
(3)凡任何人在第42(1)条所指的法律程序中获送达传票后没有到裁判官席前应讯,或在应讯后没有提出免责辩护或提出琐屑无聊或无理缠扰的免责辩护,裁判官须命令该人缴付定额罚款及一项相等于定额罚款款额的附加罚款。
(4)凡有命令在第45条所指的法律程序中作出,裁判官须安排将关于该项命令的通知书送达被告人。
(5)在第45条所指的法律程序中作出的命令的通知书,可以邮递方式寄往下述地址而送达─
(a)(如送予登记车主)登记车主的登记地址;或
(b)(如送予司机)司机通常工作或居住的地址。
第556D章 第48条申诉的中止
申诉人在向被告人及有关的裁判官发出书面通知后,可无须裁判官的许可而在法律程序的任何阶段中止针对该被告人的申诉。
第556D章 第49条在传票发出后缴付定额罚款
(1)尽管针对某人的法律程序已经提出,而该人已按照根据第39(3)条向他送达的通知书的规定,告知地铁公司他意欲就法律责任提出争议,被告人仍可按照第(2)款缴付定额罚款及一项相等于定额罚款款额的附加罚款;如被告人同时向法院缴付第(4)款所提述的款项作为讼费,则有关法律程序即告终止。
(2)根据第(1)款缴付的款项,须不迟于传票所指明的出庭日期之前的2整个工作天,向任何裁判法院缴付;付款时须交出传票。
(3)在第(2)款中,“整个工作天”(clear working days) 一词并不包括传票所指明的被告人出庭当日以及期间当中的公众假期。
(4)为施行第(1)款而缴付作为讼费的款额,须与为施行《定额罚款(交通违例事项)条例》(第237章)第20B条而缴付作为讼费的款额相同。
第556D章 第50条以证明书作证及推定
符合附表3表格5所示格式的证明书,如述明─
(a)该证明书内所指明的人在某时间为某车辆的登记车主或司机(视属何情况而定);
(b)该证明书内所指明的地址在某时间为该人的登记地址或(如该人是司机的话)该人通常工作或居住的地方的地址;及
(c)第39(3)条所指的某份通知书内所指明的违例事项的定额罚款并没有在该证明书内所指明的日期前缴付,而且(如属第42(2)条所指的申请)该证明书内所指明的人没有在该证明书内所指明的日期前告知地铁公司他意欲就该宗违例事项的法律责任提出争议,并看来是由地铁公司或代地铁公司签署的,则该证明书一经由申诉人或申请人向裁判官交出,即须获接纳为证据而无须再作证明,而且─
(i)在相反证明成立前,须推定该证明书是经如此签署的;
(ii)证明书即为其内所述事实的表面证据。
第556D章 第51条在法律程序结束时作出的其他法庭命令
(1)如在法律程序结束时申诉被驳回,裁判官可同时命令申诉人缴付讼费,款额为第(9)款所提述者。
(2)如裁判官在法律程序结束时作出缴付定额罚款的命令,则不论是否同时规定缴付附加罚款,该裁判官─
(a)可同时命令被告人缴付讼费,款额为第(9)款所提述者;及
(b)须同时作出一项命令,指示署长在被告人缴付被判决须付的款项之前─
(i)须拒绝向被告人发出驾驶执照或拒绝将其驾驶执照续期;及
(ii)(就该被告人为登记车主的任何汽车而言)不得在接获该汽车的任何过户通知书时根据《道路交通(车辆登记及领牌)规例》(第374章,附属法例)第17(3)、(4)、(4A)或(5)条采取行动,而须拒绝根据上述规例第21(3)、(5)或(6)条发牌予该汽车。(3)根据第(2)(a)款作出的命令须指明─
(a)被告人的姓名或名称;
(b)被判决须付的款项。(4)裁判官凡根据第(2)(b)款作出命令,而被判决须付的款项没有在该项命令作出后24小时内缴付,该裁判官须安排将关于该项命令的通知书送交署长。
(5)如被告人向署长交出收据或其他证据,证明被判决须付的款项已经缴付,则第(2)(b)款所指的命令即告失效。
(6)如被告人将有关汽车出售或以其他方式处置该汽车,而该汽车的新车主在根据《道路交通(车辆登记及领牌)规例》(第374章,附属法例)第17条交付过户通知书时,管有一份符合署长不时订明的格式并由署长发出的有效证明书,证明在署长就该汽车的纪录中,并没有记录根据第(2)(b)(ii)款而作出有关一项有效命令的通知书,则第(2)(b)(ii)款所指的命令即告失效。
(7)如申请第(6)款所指的证明书,须向署长提出,而申请书须符合署长不时订明的格式。
(8)根据第(6)款发出的证明书的有效期,由发出时起计不多于72小时。
(9)裁判官为施行第(1)及(2)(a)款而可命令缴付的讼费的款额,与裁判官为各别施行《定额罚款(交通违例事项)条例》(第237章)第22(1)及(2)(a)条而可命令缴付的讼费的款额相同。
第556D章 第52条因欠缴款项而作出的财物扣押
(1)如任何被命令缴付被判决须付的款项的人没有在该项命令的日期起计1个月内缴付该笔款项,则向裁判官申请颁发下述命令的申请,可在该人缺席的情况下提出,该命令为指示以扣押该人的任何财物及实产和出售该等财物及实产的方式征取─
(a)该笔被判决须付的款项,或如根据本条要求颁发命令的申请关乎多于一笔被判决须付的款项者,则为该等款项的总和;
(b)根据第(2)款须缴付的任何附加款项;及
(c)在法律程序中随后的讼费,包括根据本条申请颁发命令的讼费,或如根据本条申请颁发的命令关乎多于一笔被判决须付的款项者,则为在所有法律程序中随后讼费的总和。(2)凡根据第(1)款向裁判官提出申请,须不经进一步法律程序而命令该项申请所关乎的人缴付一笔附加款项作为讼费,款额不少于$50但亦不多于定额罚款的款额;就第51(2)(b)条而言,该笔款项须视为犹如包括在被判决须付的款项内一样。
(3)根据第(1)款提出的申请须以地铁公司的名义提出;地铁公司可委任任何人或任何种类的人提出该项申请。
第556D章 第53条登记车主追讨已缴款项
登记车主在缴付定额罚款、附加罚款或讼费后,可将该等定额罚款、附加罚款或讼费作为民事债项而循简易程序向在违例事项发生时驾驶或掌管有关汽车的人追讨。
第556D章 第54条自行承担进入的风险

免除及限制
(1)在不抵触第57条的情况下,任何人(不论是否在车辆之内)进入运输交汇处的任何部分及留在该处,须自行承担风险,并且是明确地以地铁公司无须对任何扣留、损失或损害承担法律责任为条件,不论该扣留、损失或损害属何种类,在何处及以何种方式发生,以及由何人引致,亦不论该扣留、损失或损害是否关乎或对该人或属于该人或由该人携带、携同或为该人而携带的任何行李、财产、货物、财物、物品、车辆、物体或东西而发生的。
(2)本附例中的任何条文或任何其他情况并不在地铁公司与任何人(包括将车辆停泊在停车场内或任何泊车位的有关车辆的司机或车主)之间引起委托保管、保管或信托关系。
第556D章 第55条自行承担停留的风险
在不抵触第57条的情况下,所有留在停车场或泊车位内的车辆,其风险全由车辆的车主及司机承担,而上述车主及司机须负责将车辆锁上及保持车辆安全稳妥,以免遭受盗窃或其他危险。
第556D章 第56条法律责任的限制
在不抵触第57条的情况下,地铁公司无须就下列事项负责,亦无须就下列事项承担任何法律责任─
(a)对正进入或正处于运输交汇处任何部分或在停车场或泊车位内的车辆造成任何损害,或对根据第32条车轮正被上锁或根据第33条已从停车场或运输交汇处移走的车辆造成的任何损害;或
(b)就车辆或车辆之内的东西或附于、载上或载入车辆的东西的损失或损害而提出的任何申索,但地铁公司须已就有关的运输交汇处或在地铁公司移走上述车辆一事上运用合理的谨慎。
第556D章 第57条限制法律责任的范围
(1)尽管有《管制免责条款条例》(第71章)第18(1)(a)条的规定,如根据该条例的条文,某项法律责任的免除或局限是无效或失效的,则本部的任何条文不得免除或当作免除或局限地铁公司在此范围内的任何法律责任;而地铁公司须承担因上述条例的实施而施加于地铁公司的法律责任的范围之内(但不超过该范围)的法律责任。
(2)为施行第(1)款,须将第54、55及56条视作为犹如《管制免责条款条例》(第71章)所指的合约条款或告示一样。

(a)在运输交汇处任何部分之内或之上使用或应用的任何机器或设备或其任何部分;
(b)在运输交汇处使用或应用或与运输交汇处有关而使用或应用的任何车辆、车厢、车卡或其他运输工具或其上的任何设备;
(c)在运输交汇处任何部分之内或之上使用或应用的任何电力装置或其他形式的电力装备或不论属何性质的设备。
第556D章 第59条放置厌恶性物体
任何人不得容许或任由任何污物、污水或其他厌恶性物体流入或进入或放置于运输交汇处的任何部分。
第556D章 第60条抛弃厌恶性物体
任何人不得将或致使任何玻璃物、石块、投射物或任何垃圾或其他厌恶性物体或废物弃于或抛于、弃在或抛在运输交汇处,或从运输交汇处内抛出或弃之于运输交汇处之外。
第556D章 第61条紧急设备
除非得到地铁公司特准,否则任何人不得启动运输交汇处内的紧急或安全器件,但为设置该等器件的明示目的及按照其上印有的指令而使用者,则属例外。

Cap 556D s 1 Interpretation
PART I
PRELIMINARY
In this Bylaw, unless the context otherwise requires-
'authorized person' (获授权人) means a person authorized by the Corporation to act on behalf of the Corporation for the purposes of this Bylaw;
'bus stop' (巴士站) means an area of road designated as a bus stop within which a franchised bus may be parked or stop to pick up or set down passengers;
'car park' (停车场) means such part or parts of a transport interchange set aside and designated by the Corporation containing parking spaces for the purpose of parking vehicles in accordance with section 11;
'carriageway' (车路) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'central reservation' (中央分道带) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'crossing' (过路处、行人线) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'conditions of issue' (发出条件) means the conditions of issue of any ticket, pass or permit for use of any car park or parking space, for driving into or within a prohibited zone or for picking-up or setting-down passengers or for loading or unloading luggage or goods within a restricted zone published from time to time by or on behalf of or with the acknowledgement or consent of the Corporation and posted at the car park, parking space, restricted zone, prohibited zone or the relevant part thereof;
'contravention' (违例事项) means a contravention of any of the sections as listed out in Part II of Schedule 2;
'driver' (司机), in relation to a vehicle, means any person who is in charge of or assisting in the control of it;
'fixed penalty' (定额罚款) means the penalty prescribed by section 37;
'franchised bus' (专利巴士) means a bus in respect of which a franchise is in force under the Public Bus Services Ordinance (Cap 230);
'grantee' (专营公司) has the same meaning as in the Public Bus Services Ordinance (Cap 230);
'light signal' (管制灯号) means an illuminated signal to control vehicular traffic or pedestrians, including the yellow globe prescribed in Schedule 4 to the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'light signal crossing' (管制灯号控制的过路处) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'motor vehicle' (汽车) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'owner' (车主) includes the person in whose name a vehicle is registered and the person by whom the vehicle is kept and used and, in relation to a vehicle which is the subject of a hiring agreement or hire purchase agreement, means the person in possession of the vehicle under that agreement;
'parking' (泊车、停泊) has the same meaning as in the Road Traffic (Parking) Regulations (Cap 374 sub. leg.);
'parking space' (泊车位) means a space designated by the Corporation by prescribed traffic signs or prescribed road markings within a transport interchange for the parking of a vehicle;
'pass' (通行证) means a pass issued by the Corporation or other person authorized by the Corporation in that behalf for the purpose of authorizing parking of a vehicle at a parking space;
'pedestrian refuge' (行人安全岛) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'permit' (许可证) means a permit or an authorization issued by the Corporation or other person authorized by the Corporation in that behalf to enable a vehicle to pick up or set down passengers or to load or unload luggage or goods in a restricted zone or to be driven into or within a prohibited zone in a transport interchange;
'prescribed light signal' (订明管制灯号) means a light signal of the design, size, colour and type prescribed in Schedule 1 or as prescribed in Schedule 3 to the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) and includes the yellow globe prescribed in Schedule 4 thereto;
'prescribed road marking' (订明道路标记) means a road marking of the design, size, colour and type prescribed in Schedule 1 or as prescribed under the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) or the Road Traffic (Public Service Vehicles) Regulations (Cap 374 sub. leg.);
'prescribed traffic sign' (订明交通标志) means a traffic sign of the design, size, colour and type prescribed in Schedule 1 or as prescribed under the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) or the Road Traffic (Public Service Vehicles) Regulations (Cap 374 sub. leg.);
'proceeding' (法律程序) means proceedings before a magistrate under section 42 or 45;
'prohibited zone' (禁区) means any area in the transport interchange designated by the Corporation by prescribed traffic signs or prescribed road markings into which and within which driving of any vehicle or any specified class or description of vehicle on specified days, during specified hours on any day, or during specified hours on any specified days are prohibited;
'public light bus' (公共小巴) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'public light bus stand' (公共小巴站) means an area of road designated as a public light bus stand within which a public light bus may be parked or stand for the purpose of picking-up or setting-down of passengers;
'registered address' (登记地址) means the address of a registered owner which appears, in respect of any motor vehicle registered in his name, in the register of vehicles maintained by the Commissioner under regulation 4(1) of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.);
'registered owner' (登记车主) means-
(a) the person in whose name a motor vehicle is registered in accordance with the Road Traffic Ordinance (Cap 374); and
(b) in relation to a motor vehicle to which a trade plate or permit issued under the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.) is affixed, the person to whom the relevant trade licence or permit is issued under those Regulations;'regulatory' (限制、具限制作用的) means, in relation to a prescribed traffic sign, prescribed road marking or prescribed light signal-
(a) that which is contained in Schedule 1; or
(b) that which the non-compliance thereof amounts to the commission of an offence under the Road Traffic Ordinance (Cap 374), the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.) or the Road Traffic (Public Service Vehicles) Regulations (Cap 374 sub. leg.);'restricted zone' (限制区) means any area in the transport interchange designated by the Corporation by prescribed traffic signs or prescribed road markings within which the driver of any vehicle or any specified class or description of vehicle is prohibited from-
(a) picking-up or setting-down passengers; or
(b) loading or unloading luggage or goods,on specified days, during specified hours on any day, or during specified hours on any specified days;'road marking' (道路标记) means a line, word, mark or device placed on, or set into, the surface of a road for conveying to persons using the road any warning, information, requirement, restriction, prohibition or direction and includes a road hump;
'specified route' (指明路线) has the same meaning as in the Public Bus Services Ordinance (Cap 230);
'sum adjudged to be paid' (被判决须付的款项) means any sum ordered by a magistrate to be paid in any proceedings and any costs awarded against the defendant under section 51(2)(a);
'taxi' (的士) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'taxi bay' (的士候客位) means a single-occupancy bay within a taxi rank designated by prescribed traffic signs or prescribed road markings in which a taxi may stand or ply for hire or set down passengers;
'taxi queue lane' (的士轮候车道) means a traffic lane designated by prescribed traffic signs, prescribed road markings or prescribed light signals in which taxis may queue-up for entry to a taxi rank;
'taxi rank' (的士候客处) means an area comprising one or more taxi bays designated by prescribed traffic signs, prescribed road markings or prescribed light signals;
'ticket' (停车票) means a ticket or card of any nature and description which is issued by or on behalf of or with the acknowledgement or consent of the Corporation for the purpose of use of a parking space in a car park;
'traffic sign' (交通标志) means a sign, object or device for conveying to persons using a road any warning, information, requirement, restriction, prohibition or direction;
'vehicle' (车辆) has the same meaning as in the Road Traffic Ordinance (Cap 374);
'zebra controlled area' (斑马线控制区) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.);
'zebra crossing' (斑马线) means a crossing for pedestrians established on any road, the presence and limits of which are indicated in accordance with Schedule 4 to the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.).
Cap 556D s 2 Application
(1) This Bylaw applies to all persons and vehicles within a transport interchange the boundaries of which are delineated in certified plans deposited in the Land Registry in accordance with section 31 of the Ordinance. (13 of 2000 s. 64)
(2) The Corporation shall place or cause to be placed an appropriate prescribed traffic sign of the type shown in-
(a) Figure No. 1 in Schedule 1 at each vehicular entrance of the transport interchange; and
(b) Figure No. 2 in Schedule 1 at each vehicular exit from the transport interchange.(3) Any vehicle or thing which is partly within the transport interchange shall, for the purposes of this Bylaw, be deemed to be within the transport interchange.
Cap 556D s 3 Exemption from restrictions
Nothing in this Bylaw shall apply-
(a) so as to restrict the safe and convenient use of any vehicle in connection with any building operation, demolition, or excavation; the removal of any obstruction to traffic; the maintenance, improvement or reconstruction of any road; or the installation, alteration or repair of any sewer or any main, pipe or apparatus for the supply of gas, water or electricity, or of any telephone or wires, cables, parts or supports provided that the Corporation has approved the use of the vehicle for such purposes as aforesaid; or
(b) to fire services vehicles, ambulances, police vehicles, custom and excise vehicles, immigration vehicles or vehicles used by the armed forces when any such vehicles are being used in the performance of their functions.
Cap 556D s 4 Control of traffic
PART II
TRAFFIC CONTROL
(1) The Corporation shall at all times, subject to this Bylaw and the payment by users of car parks, allow members of the public and all types of vehicles to enter and have access to the transport interchange for all lawful purposes freely and without payment.
(2) All persons within the transport interchange are subject to the control and direction of any authorized person.
Cap 556D s 5 Directions of authorized persons
All persons within a transport interchange shall comply with any reasonable order, signal, requirement, instruction or direction given or made by an authorized person.
Cap 556D s 6 Prescribed traffic sign, prescribed road marking and prescribed light signal
(1) Unless otherwise directed by an authorized person, all persons within a transport interchange shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals erected, displayed or placed therein which are regulatory.
(2) A prescribed traffic sign, prescribed road marking or prescribed light signal erected, displayed or placed in any part of the transport interchange shall cease to have any force, effect or validity under this Bylaw upon the same being covered, obliterated or removed by an authorized person.
Cap 556D s 7 Pedestrians and safety
(1) No person shall drive or cause or permit to be driven or cause to remain, a vehicle which will or is likely to endanger any person, vehicle or property within the transport interchange.
(2) No pedestrian within a transport interchange shall-
(a) cross a road-
(i) within a zebra controlled area, otherwise than on a zebra crossing;
(ii) within 15 metres of a light signal crossing otherwise than at the crossing where such lights operate; or
(iii) in contravention of any direction given by an authorized person;(b) remain on a crossing longer than is necessary to pass over the crossing; or
(c) climb over or through any kerbside fence or central reservation on to a carriageway.(3) Every pedestrian on a zebra crossing shall have precedence while on it over any vehicle and, if a pedestrian is on the zebra crossing before the vehicle or any part of it has come on to or over the zebra crossing, the driver of the vehicle shall accord precedence to such pedestrian:
Provided that in the case of a zebra crossing on which there is a pedestrian refuge or central reservation the parts of the zebra crossing which are situated on each side of the pedestrian refuge or central reservation shall each be treated as a separate zebra crossing.
(4) (a) The driver of a vehicle (hereinafter in this subsection referred to as the 'approaching vehicle') while the vehicle or any part of it is in a zebra controlled area and is proceeding towards the zebra crossing shall not cause the approaching vehicle, or any part of it-
(i) to pass ahead of the foremost part of another moving vehicle, being a vehicle proceeding in the same direction wholly or partly within that area; or
(ii) to pass ahead of the foremost part of a stationary vehicle in the same part of the zebra controlled area as the approaching vehicle, which stationary vehicle is stopped wholly or partly within that area for the purpose of complying with subsection (3),
unless he so passes to conform with a direction given by an authorized person.
(b) For the purposes of this subsection-
(i) the reference to another moving vehicle is, in a case where only one other vehicle is proceeding in the same direction in a zebra controlled area, a reference to that vehicle, and, in a case where more than one other vehicle is so proceeding, a reference to such one of those vehicles as is nearest to the zebra crossing;
(ii) the reference to a stationary vehicle is, in a case where only one other vehicle is stopped for the purpose of complying with subsection (3), a reference to that vehicle and, in a case where more than one other vehicle is stopped for the purpose of complying with that subsection, a reference to such one of those vehicle as is nearest to the zebra crossing.(c) For the purposes of this subsection, in the case of a zebra crossing which is on a one way street, and on which there is a pedestrian refuge or central reservation, the parts of the zebra crossing which are situated on each side of the pedestrian refuge or central reservation shall each be treated as a separate zebra crossing.
Cap 556D s 8 Control of prescribed traffic sign, prescribed road marking and prescribed light signal
(1) No person, other than an authorized person, shall without the prior authorization of the Corporation erect, display or place or cause or permit to be erected, displayed or placed in any part of a transport interchange, any road marking, traffic sign or light signal which is of such similarity to a prescribed traffic sign, prescribed road marking or prescribed light signal that any person approaching it might reasonably mistake it for such.
(2) Any authorized person may by notice or direction require any person who has erected, displayed or placed or caused or permitted to be erected, displayed or placed any traffic sign, road marking or light signal in contravention of subsection (1) to remove it and, if such person fails to comply with such notice or direction, the Corporation may cause the traffic sign, road marking or light signal to be removed or obliterated, as the case may be, and thereupon the sign, signal or marking and every attachment thereto shall be forfeited to the Corporation and the Corporation may recover from such person as a civil debt the cost of the removal or obliteration of the same and also the cost of any reinstatement of any property necessitated by such removal or obliteration.
(3) No person, other than an authorized person, shall move, damage, obscure, deface, alter, obliterate or interfere in any manner with any prescribed traffic sign, prescribed road marking or prescribed light signal erected or displayed or placed by the Corporation within a transport interchange or part thereof.
Cap 556D s 9 Repair of vehicles prohibited
(1) No person shall in any part of a transport interchange (including in a car park) carry out on any vehicle any maintenance or repair, or be in any part of a transport interchange for the purposes of carrying out such maintenance or repair except with the approval of the Corporation or an authorized person.
(2) It shall be a good defence to any proceedings under subsection (1) to prove that such maintenance or repair was of a minor nature and was necessary to enable the vehicle to be driven or removed from the transport interchange.
Cap 556D s 10 Parking space
PART III
PARKING OUTSIDE CAR PARK
(1) No person shall park any vehicle in any place or on any road within a transport interchange outside a car park-
(a) other than in an appropriate parking space for use by that particular description, type or class of vehicle or for the use of a person or persons of any particular class during the specified period of time;
(b) in contravention of any lawful directions given to him by an authorized person, or any prescribed traffic sign, prescribed road marking or prescribed light signal which is regulatory and erected, displayed or placed at or near the parking space;
(c) in such a position or in such manner or in such condition or in such circumstances as to be likely to cause danger or obstruction to the Corporation or to other persons, vehicles or property within the transport interchange;
(d) in the case of a trailer, unless the trailer is accompanied by and attached to a vehicle capable of drawing the trailer; or
(e) other than as authorized by the conditions of issue of a pass issued in accordance with section 16.(2) No person shall park a vehicle in a parking space in such a manner that the vehicle unnecessarily projects over any line, sign or mark of a prescribed traffic sign or prescribed road marking which delineates the space in which the vehicle should properly be parked.
(3) No person shall without reasonable excuse sound a warning instrument in a parking space.
(4) No person in a parking space shall-
(a) smoke; or
(b) without reasonable excuse be in possession of any pass or replacement pass which is mutilated, defaced or altered.(5) No person shall, without lawful authority or reasonable excuse, get on to a vehicle, tamper with or interfere with a vehicle in a parking space.
Cap 556D s 11 Car park
PART IV
CAR PARK
(1) The Corporation may set aside and designate any place within a transport interchange for use as a car park and may in such manner as it thinks fit limit the use of any parking space in a car park or any part of a car park to vehicles of any description or of any particular type or class or allocate any parking space in a car park or any part of a car park for the use of any person or persons of any particular class and revoke or amend any such limitation or allocation.
(2) The Corporation may, in such manner as it thinks fit, limit the hours or days during which vehicles of any description or of any particular type or class may enter or use or leave a car park and revoke or amend any such limitation.
(3) An authorized person may refuse to allow any vehicle to enter a car park in contravention of any limitation imposed under subsection (1) or (2) as to the use of the car park.
Cap 556D s 12 Traffic sign, road marking and light signal for car park
The Corporation may erect, display or place or cause to be erected, displayed or placed at, on, within or immediately outside a car park but within the transport interchange such traffic signs, road markings or light signals as it considers necessary for the regulation and the guidance of parking and traffic therein, and in particular such traffic signs, road markings or light signals indicating the place where vehicles and persons may enter and leave the car park.
Cap 556D s 13 Power of closure
No person shall park any vehicle or cause or permit any vehicle to be parked or to remain in a car park or the relevant part thereof during any time when the car park or any part thereof is closed by a notice published by the Corporation and posted at the car park or the relevant part thereof prior to such closure.
Cap 556D s 14 Offences by drivers inside car park
(1) The driver of a vehicle in a car park shall comply with all lawful directions given to him by an authorized person.
(2) Subject to subsection (1), the driver of a vehicle in a car park shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals erected, displayed or placed pursuant to section 12 which are regulatory.
(3) No person shall without reasonable excuse sound a warning instrument in a car park.
(4) No person shall park a vehicle in a car park in such a manner that the vehicle unnecessarily projects over any line or mark which delineates the parking space in which the vehicle should properly be parked.
(5) No person shall park any vehicle or cause or permit any vehicle to be parked in a car park other than-
(a) in an appropriate parking space for the parking of that particular description, type or class of vehicle during the specified period of time; or
(b) in an appropriate parking space for the use of a person or persons of any particular class during the specified period of time.(6) No person shall park a vehicle in a car park in such a position or in such manner or in such condition or in such circumstances as to be likely to cause danger or obstruction to the Corporation or to other persons, vehicles or property within the transport interchange.
(7) No person shall park a vehicle in a car park other than as authorized by the conditions of a pass or ticket issued in accordance with section 16.
Cap 556D s 15 Offences inside car park
(1) No person other than-
(a) a person employed at a car park in the course of his duties;
(b) a person driving a vehicle into a car park intending to park or a person entering a car park intending to remove a vehicle therefrom;
(c) a passenger inside a vehicle which enters a car park for the purpose of parking or a person intending to leave the car park as a passenger in a vehicle; or
(d) a person who reasonably requires to go to any part of a car park, shall enter a car park without the permission of an authorized person.
(2) No person in a car park shall-
(a) smoke; or
(b) without reasonable excuse be in possession of any ticket or pass or replacement ticket or pass which is mutilated, defaced or altered.(3) No person shall, without lawful authority or reasonable excuse, get on to a vehicle, tamper with or interfere with a vehicle in a car park.
(4) Except where a vehicle is removed under section 33, an authorized person may refuse to allow any vehicle to leave a car park if the parking fee incurred in respect of the vehicle is not paid, or if a valid ticket or a valid pass is not presented or inserted in the automatic equipment or otherwise used in accordance with this Bylaw.
Cap 556D s 16 Issue of tickets and passes
PART V
TICKETS, PASSES AND PERMITS
The Corporation shall have power either by itself or through other persons appointed by the Corporation on its behalf from time to time to issue tickets in connection with the use of car parks and parking spaces therein, and issue passes in connection with the use of parking spaces in the transport interchange, subject to such conditions of issue and this Bylaw in connection therewith.
Cap 556D s 17 Pass
(1) A pass issued under section 16 shall be in a form approved by the Corporation and there shall be entered in or on the pass-
(a) the registration mark of the vehicle in respect of which it is valid for use;
(b) the identification of the car park or the parking space in respect of which it is valid;
(c) the period for which it is valid for use; and
(d) such other particulars as the Corporation may think fit.(2) The Corporation may issue a pass under section 16 for such period as it may determine.
(3) The issue of a pass under section 16 in respect of a vehicle shall not provide any guarantee that a parking space or any place intended for the parking of the vehicle in the car park in respect of which the pass is valid shall be available.
(4) A vehicle in respect of which a pass is issued may be parked in any parking space or place intended for the parking of the vehicle in respect of which the pass is valid at any time during the period for which the pass shall remain valid but subject always to section 33(2)(b) and (c).
(5) The driver of a vehicle in respect of which a valid pass has been issued in accordance with section 16 shall upon entry to and exit from the car park or parking at or removal of the vehicle from the parking space, where applicable-
(a) produce the pass to an authorized person for inspection;
(b) insert the pass in any automatic equipment used for the admittance of a vehicle to and exit from the car park or for parking at or removal of the vehicle from the parking space;
(c) exhibit the pass in a prominent location in the windscreen of the vehicle; or
(d) hold or display the pass in such manner as may be required by the conditions of issue of the pass.
Cap 556D s 18 Ticket
(1) The driver, to whom a valid ticket has been issued in accordance with section 16, shall retain the ticket and for the purpose of removal of the vehicle from the car park, the driver, or any other person who produces the ticket with the authorization of the driver or the owner thereof to remove the vehicle, shall present the ticket at such place and in such manner as shall be designated by the Corporation, at which place the ticket shall be marked with the time of presentation and the parking fee, calculated at the appropriate rate as may be prescribed by the Corporation from time to time, incurred between that time of presentation and the time of entry of the vehicle marked on the ticket and such person shall pay such fee before removing the vehicle from the car park.
(2) After the person referred to in subsection (1) has paid the parking fee in accordance with the provisions of subsection (1), the vehicle shall be removed from the car park within 15 minutes after payment of the parking fee or as soon as is practicable thereafter, whichever is earlier.
(3) If the vehicle is not removed from the car park within such period of the time pursuant to subsection (2), the driver shall not be permitted to remove the vehicle until a further payment at the appropriate rate prescribed by the Corporation from time to time shall have been paid in respect of all time in excess of such period of time pursuant to subsection (2) during which the vehicle has remained in the car park.
(4) A vehicle in respect of which a ticket is issued may be parked in any parking space in a car park in respect of which the ticket is valid at any time but subject always to section 33(2)(c).
Cap 556D s 19 Loss of ticket or pass
If at any time a person wishes to remove a vehicle from a car park or parking space but is unable to produce a valid ticket or pass issued in respect of such vehicle, he may remove such vehicle if he satisfies an authorized person that he is authorized by the owner of the vehicle or by the person to whom the ticket or pass was issued to remove the vehicle, provided that he shall pay the fee for a replacement ticket or pass calculated at the appropriate rate as may be prescribed by the Corporation from time to time.
Cap 556D s 20 Permit
(1) The Corporation shall have power, either by itself or through other persons appointed by the Corporation on its behalf from time to time, to issue permits subject to such conditions of issue and this Bylaw in connection with the driving of vehicles into and within prohibited zones, picking-up or setting- down passengers or loading or unloading luggage or goods in restricted zones.
(2) The driver of a vehicle in respect of which a valid permit has been issued in accordance with the provisions of subsection (1) shall prior to or upon entry into a prohibited zone or picking-up or setting-down passengers or loading or unloading luggage or goods in a restricted zone-
(a) produce the permit to an authorized person for inspection;
(b) exhibit the permit in a prominent location in the windscreen of the vehicle;
(c) insert the permit in automatic equipment used for authorizing driving of the vehicle therein; or
(d) hold or display the permit in such manner as may be required by the conditions of issue of the permit.
Cap 556D s 21 Conditions of issue
(1) All tickets, passes and permits issued by or on behalf of the Corporation are issued subject to this Bylaw and to the conditions of issue.
(2) Any person to whom or on whose behalf a ticket, pass or permit is issued in respect of his vehicle or who otherwise acquires a ticket, pass or permit for a vehicle shall be deemed to have knowledge of and to have agreed to abide by this Bylaw and to the conditions of issue.
Cap 556D s 22 Taxi rank, taxi bay and taxi queue lane
PART VI
FRANCHISED BUSES, PUBLIC LIGHT BUSES AND TAXIS
(1) A taxi of a particular class, type or description may stand or ply for hire at a taxi bay within a taxi rank designated for that purpose by prescribed traffic signs, prescribed road markings or prescribed light signals. Unless otherwise directed by an authorized person, no other vehicle shall be driven into a taxi rank or taxi queue lane.
(2) The driver of a taxi shall comply with all lawful directions given by an authorized person for the orderly operation of a taxi rank, taxi bay and taxi queue lane or any part thereof.
(3) Subject to subsection (2), the driver of a taxi shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals which are regulatory and erected, displayed or placed for the orderly operation of a taxi rank, taxi bay and taxi queue lane or any part thereof.
Cap 556D s 23 Bus stop
(1) The area of road designated by prescribed traffic signs or prescribed road markings to be a bus stop may be restricted to a grantee or grantees or a specified route or routes. Unless otherwise directed by an authorized person, no vehicle other than a franchised bus may be parked at, set down or pick up passengers at any bus stop.
(2) A grantee shall at the written request of the Corporation erect and maintain at its expense a sign, of a type approved by the Commissioner, at a bus stop to the satisfaction of the Corporation specifying the grantee and the relevant specified route or routes.
(3) The driver of a franchised bus shall comply with all lawful directions given by an authorized person for the orderly operation of a bus stop.
(4) Subject to subsection (3), the driver of a franchised bus shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals which are regulatory and erected, displayed or placed for the orderly operation of a bus stop.
Cap 556D s 24 Public light bus stand
(1) The area of road designated by prescribed traffic signs or prescribed road markings to be a public light bus stand may be restricted to a public light bus operator or operators or a public light bus route or routes. Unless otherwise directed by an authorized person, no vehicle other than a public light bus may be parked at, set down or pick up passengers at any public light bus stand.
(2) A public light bus operator shall at the written request of the Corporation erect and maintain at its expense a sign at a public light bus stand to the satisfaction of the Corporation specifying the operator and the relevant route or routes.
(3) The driver of a public light bus shall comply with all lawful directions given by an authorized person for the orderly operation of a public light bus stand.
(4) Subject to subsection (3), the driver of a public light bus shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals which are regulatory and erected, displayed or placed for the orderly operation of a public light bus stand.
Cap 556D s 25 Picking-up and setting-down of passengers
(1) The driver of a franchised bus shall not stop to pick up or set down passengers within a transport interchange except at a bus stop or such other areas as may be designated by the Corporation or instructed by an authorized person.
(2) The driver of a public light bus shall not stop to pick up or set down passengers within a transport interchange except at a public light bus stand or such other areas as may be designated by the Corporation or instructed by an authorized person.
(3) The driver of a taxi shall not stop to pick up or set down passengers within a transport interchange except at a taxi bay or such other areas outside the restricted zones in the transport interchange permitted for those purposes or such other areas as may be designated by the Corporation or instructed by an authorized person.
Cap 556D s 26 Conduct in taxi queue lane and at taxi rank and taxi bay
(1) The driver of a taxi in a taxi queue lane designated for that purpose shall remain in his taxi and shall follow the taxi immediately preceding him to move to the front of such taxi queue lane.
(2) Subject to subsection (4), the driver of a taxi shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals which are regulatory and erected, displayed or placed in the taxi queue lane, and shall stop in a taxi queue lane or move forward to the taxi rank in an orderly manner to be ready for hire immediately by any person.
(3) No vehicle other than a taxi shall be driven into a taxi queue lane, taxi rank or taxi bay.
(4) The driver of a taxi shall comply with the instructions of an authorized person to stop in the taxi queue lane or move forward to the taxi rank in an orderly manner to be ready for hire immediately by any person.
(5) Unless instructed by an authorized person, a taxi shall not enter a vacant taxi bay other than from the front of a taxi queue lane.
(6) The driver of every taxi waiting in or approaching a taxi queue lane shall move his taxi forward following the taxi immediately preceding him or otherwise leave the taxi queue lane immediately by such lane as may be provided for that purpose by prescribed traffic signs or prescribed road markings.
(7) A taxi stopping at a taxi bay shall not unnecessarily project beyond the prescribed road markings.
(8) If a person wishes to hire a taxi-
(a) the person shall wait at or approach a taxi bay in an orderly manner and in accordance with such instructions as may be given by an authorized person;
(b) the driver of a taxi at a taxi bay shall accept the hire; and
(c) the driver of a taxi shall not accept the hire other than at a taxi bay.(9) The driver of a taxi shall not in any manner solicit, attract or endeavour to solicit or attract any person in order to induce such person to make use of the taxi other than by waiting at a taxi bay in compliance with subsection (8)(b).
(10) The driver of a taxi shall not park his vehicle anywhere other than in a parking space designated by prescribed traffic signs or prescribed road markings for that purpose, provided that a taxi shall be deemed not to be parked for the purposes of this Bylaw when it is standing or plying for hire at a taxi bay.
Cap 556D s 27 Restrictions on entry or use
PART VII
PROHIBITED ZONES AND RESTRICTED ZONES
(1) No vehicle other than one of a particular description, type, or class, specifically exempted by prescribed traffic signs or prescribed road markings or issued with a permit under section 20(1), may-
(a) drive into or within a prohibited zone in the transport interchange designated by prescribed traffic signs or prescribed road markings; or
(b) stop to pick up or set down passengers, or loading or unloading luggage or goods in a restricted zone in the transport interchange designated by prescribed traffic signs or prescribed road markings.(2) Without prejudice to sections 23(2) and 24(2), an operator of any route or routes, vehicle or vehicles of particular description, type or class at a prohibited zone or restricted zone shall at the written request of the Corporation erect and maintain at its expense a sign as specified by the Corporation at the designated location in a prohibited zone or restricted zone specifying the relevant operator or operators and the relevant route or routes.
(3) The driver of a vehicle shall comply with all lawful directions given by an authorized person for the orderly operation of a prohibited zone or restricted zone.
(4) Subject to subsection (3), the driver of vehicle shall comply with all prescribed traffic signs, prescribed road markings and prescribed light signals which are regulatory and erected, displayed or placed for the orderly operation of a prohibited zone or a restricted zone.
Cap 556D s 28 Mass Transit Railway By-laws
PART VIII
APPLICATION OF MASS TRANSIT RAILWAY BY-LAWS
(1) The Mass Transit Railway By-laws (Cap 556 sub. leg.) shall not apply to the transport interchange except to the extent as is expressly stated or referred to and incorporated by subsection (2).
(2) Parts IV, V, VII and VIII of the Mass Transit Railway By-laws (Cap 556 sub. leg.) shall be extended and shall, in so far as they are applicable and are not in conflict with this Bylaw, apply to all areas of a transport interchange. In the event of any conflict between this Bylaw and the Mass Transit Railway By-laws (Cap 556 sub. leg.), this Bylaw shall prevail.
(3) In application of the parts of the Mass Transit Railway By-laws (Cap 556 sub. leg.) to the transport interchange referred to in subsection (2), the expression 'railway premises' shall be construed to mean transport interchange whenever it appears.
Cap 556D s 29 Obligation to stop, produce and supply information
PART IX
POWERS AND INFORMATION
(1) Any person who is reasonably suspected by an authorized person of committing or having committed any offence prescribed in this Bylaw shall when requested to do so by such authorized person-
(a) give to that authorized person true and correct particulars of his name and address and of his telephone number, if any, and produce proof to that effect for inspection; and
(b) where relevant and applicable-
(i) stop the vehicle forthwith, or proceed to any place within the transport interchange so ordered, directed or signalled by the authorized person and to stop thereat;
(ii) produce to that authorized person his driving licence for inspection; and
(iii) give the name and address of the registered owner of the vehicle to that authorized person where he is not the registered owner if that information is within his knowledge.(2) Any driver of a vehicle within a transport interchange shall upon the order, direction or signal of an authorized person given for the purpose of regulating vehicular and pedestrian traffic-
(a) stop the vehicle forthwith; or
(b) proceed to any place within a transport interchange so ordered, directed or signalled and to stop thereat.(3) The registered owner or any person suspected of being the driver of a vehicle which is used in connection with an alleged offence under this Bylaw or any other circumstances mentioned in this section or section 31(1), shall upon a request made by an authorized person, within 21 days after the date of the request, supply all information within his knowledge which will enable the Corporation to ascertain the name and address of the driver of the vehicle at the time of the alleged offence.
(4) No person shall wilfully-
(a) fail to comply with a requirement under subsection (1)(a) or (b)(iii) or (3); or
(b) in complying or attempting to comply with a request under subsection (1)(a) or (b)(iii) or (3), give false particulars of the name, address or telephone number or particulars of the name, address or telephone number that are misleading in a material particular.
Cap 556D s 30 Admission of statement
If, in a prosecution for an offence under this Bylaw, there is produced to the court a statement which purports to have been signed by the accused person, was furnished in accordance with a request made to him under section 29(3) and states that the accused person was the driver of the vehicle at the time of the offence, the court shall admit the statement as prima facie evidence that the accused person was the driver of the vehicle at the time of the offence.
Cap 556D s 31 Powers to inspect and detain
(1) An authorized person may enter, examine and search a vehicle and anything therein or thereon if the authorized person reasonably suspects that vehicle or the owner or driver thereof is carrying dangerous goods referred to in the Dangerous Goods Ordinance (Cap 295).
(2) Every authorized person shall have the power to detain (if necessary by the use of reasonable force) any person whom he reasonably suspects of having committed any offence of this Bylaw, or any vehicle which he reasonably suspects of having been involved in the commission of any offence of this Bylaw, without prejudice to any fee, charge or the removal or impounding of vehicle which may be imposed in accordance with this Bylaw, until he or it or both can be delivered into the custody of a police officer to be dealt with according to law.
Cap 556D s 32 Wheel clamping of vehicles
The Corporation or any authorized person may cause any vehicle which is parked or left in a transport interchange in contravention of any prescribed traffic sign, prescribed road marking or prescribed light signal which is regulatory or any direction given by an authorized person to be wheel-clamped or render immobilized by any mechanical device for that purpose until the contravention is removed and the owner or driver of the vehicle shall be liable to pay to the Corporation an impounding charge as may be determined in accordance with section 35 by the Corporation before release of the vehicle.
Cap 556D s 33 Removal of vehicle
(1) Any authorized person may move within any part or parts of a transport interchange or remove from a transport interchange any vehicle parked or left in a transport interchange which is in contravention of any prescribed traffic sign, prescribed road marking, or prescribed light signal which is regulatory or direction given by an authorized person or which in the opinion of the Corporation or of any authorized person constitutes a danger or an obstruction or renders it unsafe to any person, vehicle or thing within a transport interchange.
(2) An authorized person may remove from a transport interchange any vehicle which has been parked or allowed to remain within the transport interchange-
(a) in contravention of section 10(1), (2), 14(1), (2), (4), (5), (6) or (7);
(b) in a parking space outside a car park for a continuous period of more than 24 hours; or
(c) in a car park for a continuous period of more than 7 days unless the conditions of issue relevant to the ticket or pass for parking the vehicle otherwise allow.
Cap 556D s 34 Detention and disposal of vehicle
(1) Any vehicle which has been wheel-clamped or removed from a transport interchange under section 32 or section 33 may be detained by the Corporation unless there is paid to the Corporation in addition to any parking fee incurred an impounding charge aforesaid or a removal charge in such amount as the Corporation may determine in accordance with section 35 and a storage charge in such amount as the Corporation shall, without prejudice to the Corporation's right of detention in this section, determine in accordance with section 35 which shall amount to a civil debt due from the owner or driver of the vehicle to the Corporation.
(2) When a vehicle is detained in accordance with subsection (1), the Corporation shall, if the name and address of its owner is known to it, give notice in writing to the owner of the detained vehicle, and if the vehicle is not claimed and the parking fee, impounding charge, removal charge and storage charge are not paid by the owner within three months of the date of its first detention, the Corporation may sell or dispose of the vehicle by public auction or otherwise and apply the proceeds, if any, from the sale or disposal of the vehicle-
(a) in payment of any parking fees incurred in respect of the period during which the vehicle was parked or allowed to remain in a car park;
(b) in payment of any impounding charge, removal charge, storage charge and cost, if any, incurred in respect of the sale by public auction of the vehicle; and
(c) in payment of any administrative charges, costs and expenses as may be incurred by the Corporation, and any remaining balance shall be paid to the owner of the vehicle. If the owner does not make a claim before the expiry of 12 months from the date of the sale or disposal, any balance shall become the property of the Corporation.
Cap 556D s 35 Determination and collection of charges
(1) The Corporation may determine and vary from time to time the rate or rates of fees, charges and expenses provided for in sections 32 and 34 and shall display notices setting out the applicable fees, charges and expenses at an appropriate and prominent location or locations in the transport interchange as may be determined by the Corporation.
(2) The Corporation may determine and vary the fees for using the car park and all the parking spaces therein and the charging method.
(3) An authorized person shall have the power to collect from the person liable to any payment of fee, charge or expense provided for in this section.
Cap 556D s 36 Approval of the Commissioner
The Corporation shall obtain the prior approval of the Commissioner for the-
(a) type of sign for erecting and maintaining by the grantee of a specified route or routes at the respective designated bus stop within a transport interchange; and
(b) determining or varying impounding charges for the release of wheel-clamped vehicles and removal charges and storage charges for the release of unauthorized or illegally parked vehicles detained under this Bylaw.
Cap 556D s 37 Fixed penalty
PART X
FIXED PENALTY
A person who contravenes a section or subsection set out in column 1 in Part II of Schedule 2 is liable to pay a fixed penalty which shall be a sum equal to the fixed penalty set out in column 3 in Part II of Schedule 2.
Cap 556D s 38 Liability of registered owner
(1) The person liable for the fixed penalty under section 37 shall be the registered owner for the time being of the motor vehicle when the contravention is committed and the driver of the vehicle who commits the contravention.
(2) In any proceedings for recovery of the fixed penalty-
(a) it shall be a good defence for the registered owner to prove that, at the time the contravention was committed, the motor vehicle was taken and driven away without his consent by a person other than a driver employed by him or was stolen;
(b) subject to subsection (1), it shall be no defence-
(i) that the contravention was committed without the knowledge or consent of the registered owner; or
(ii) that at the time the contravention was committed the motor vehicle was driven by or was in the charge of a person other than the registered owner.
Cap 556D s 39 Notice of fixed penalty
(1) If an authorized person has reasonable cause to believe that a contravention mentioned in section 37 is being or has been committed, he may give the registered owner of the vehicle concerned or the driver liable an opportunity to discharge his liability in respect of that contravention by payment of a fixed penalty.
(2) For the purposes of subsection (1), notice in accordance with Form 1 of Schedule 3 shall be delivered personally to the person in charge of the vehicle or fixed on the vehicle.
(3) If the fixed penalty is not paid within 21 days after the date in which a contravention is committed a notice in accordance with Form 2 of Schedule 3 shall be served on the person liable-
(a) demanding payment of the fixed penalty; and
(b) informing the person that if he wishes to dispute liability for the contravention he should so notify the Corporation.(4) Notwithstanding subsection (3), no notice shall be served under that subsection-
(a) if the Corporation is of the opinion that no further proceedings should be taken in respect of the contravention; or
(b) after the expiry of 6 months from the date of the commission of the contravention.(5) A notice under subsection (3) shall be valid if the name of the Corporation or an authorized person authorized by him is printed or signed thereon.
(6) A notice under subsection (3) may be served by sending it by post-
(a) where it is directed to a registered owner, to his registered address; or
(b) where it is directed to a driver to the address where the driver normally works or resides.(7) A notice under subsection (3) shall be in such form as may be prescribed and shall state that the person liable is required-
(a) to pay the fixed penalty; or
(b) to notify the Corporation that he wishes to dispute liability for the contravention,within 10 days after the date of the notice.
(8) A certificate of posting in accordance with Form 3 of Schedule 3 purporting to be signed by or for the Corporation shall be admitted in evidence without further proof on its production to the magistrate by the complainant and until the contrary is proved, it shall be presumed that-
(a) the certificate is so signed; and
(b) the notice under subsection (3) to which the certificate relates was duly served.(9) Notwithstanding subsection (2), the operation of this section or section 42 shall not be affected by a failure to comply with that subsection.
Cap 556D s 40 Payment of fixed penalty
(1) A person who receives a notice in Form 1 or 2 of Schedule 3 may pay the fixed penalty within the period of time stated in the notice-
(a) by post, to the Director of Accounting Services, the Treasury, Immigration Tower, 7 Gloucester Road; or
(b) personally or through his agent-
(i) at the Revenue Branch of the Treasury or at any sub-treasury;
(ii) at any magistracy; or
(iii) at any District Office,
specified in the notice.(2) A person who wishes to pay the fixed penalty in accordance with subsection (1) shall deliver the notice to which the payment relates together with the payment.
(3) When any payment is made in accordance with this section, it shall be of the amount specified in the notice or, where payment is made in respect of more than 1 notice, of the total amounts specified in the notices.
(4) A payment under subsection (1) shall not include, or form part of, an amount in respect of a matter other than a matter specified in the notice or notices.
(5) Where any amount is paid otherwise than in accordance with this section, the Director of Accounting Services may return it to the payer.
(6) Subject to subsection (5), the Director of Accounting Services shall, whenever practicable to do so, send to the person paying a fixed penalty a receipt for the payment.
(7) Subject to section 49, no payment shall be accepted after the time prescribed in the notice served under section 39.
Cap 556D s 41 Withdrawal of notice of fixed penalty
(1) Where a notice under section 39(3) has been served on any person, the Corporation may, at any time before the commencement of any proceedings against that person in respect of the contravention specified in the notice and whether or not an order under section 42(2) has been applied for, but before such order is made, withdraw that notice, and may serve on that person a notice in writing informing him that the notice has been withdrawn.
(2) Where a notice under section 39(3) had been withdrawn under this section and any sum of money has been paid pursuant to the notice, the Director of Accounting Services shall, on demand by the person on whom the notice was served, repay to that person the sum so paid.
Cap 556D s 42 Recovery of fixed penalty
(1) Where a person on whom a notice under section 39(3) has been served has notified the Corporation, in accordance with that notice, that he wishes to dispute liability, the matter shall be determined by a magistrate on complaint, in a summary way, in accordance with this Bylaw.
(2) Where a person on whom a notice under section 39(3) has been served has not paid the fixed penalty and has not notified the Corporation, in accordance with that notice, that he wishes to dispute liability for the contravention, a magistrate shall, on an application which may be made in the absence of that person, order him to pay the fixed penalty, together with an additional penalty equal to the amount of the fixed penalty, within 14 days of being served with notice of the order.
(3) Where an order is made under subsection (2), the magistrate shall cause notice of the order to be served on the person to whom it relates.
(4) Notice of the order made under subsection (2) may be served by sending it by post-
(a) where it is directed to a registered owner, to his registered address; or
(b) where it is directed to a driver to the address where the driver normally works or resides.(5) In proceedings under subsection (1) or (2), the complaint or application shall be in the name of the Corporation but need not be signed.
(6) The Corporation may appoint any person or class of persons to conduct the proceedings under subsections (1) and (2).
Cap 556D s 43 Review of proceedings
(1) Where a magistrate is satisfied that the notice mentioned in section 39(3) has not come to the personal notice of the person liable without any neglect by that person, the magistrate may, on an application of which reasonable notice has been given to the Corporation, rescind the order made under section 42(2) and-
(a) if that person wishes to dispute liability for the contravention, order that the matter be determined in accordance with section 42(1); or
(b) if he does not wish to dispute liability-
(i) order him to pay the fixed penalty within 10 days of the order; and
(ii) order that, if he fails to pay that fixed penalty within that period, he shall be liable to pay immediately that fixed penalty, together with an additional penalty equal to the amount of the fixed penalty.(2) An application under subsection (1) may be made in person or by counsel or solicitor and the magistrate, for the purpose of securing the attendance of witnesses and generally for conducting the proceedings, shall have all the powers of a magistrate hearing a complaint under the Magistrates Ordinance (Cap 227).
(3) An application under subsection (1) shall be made within 14 days of the date which the magistrate is satisfied is the earliest date on which the order mentioned in section 42(2) came to the personal notice of the person to whom that order relates.
(4) A magistrate may for good cause, on an application by the Corporation at any time, rescind any order for the payment of a fixed penalty and any other order made in the same proceedings.
(5) Where a magistrate makes an order under subsection (1)(a), proceedings may be taken, notwithstanding section 26 of the Magistrates Ordinance (Cap 227), within 6 months from the date of that order.
Cap 556D s 44 Service of summons
(1) A summons issued in any proceedings under section 42(1) may, notwithstanding section 8(2) of the Magistrates Ordinance (Cap 227), be served by sending it by post-
(a) where it is directed to a registered owner, to his registered address; or
(b) where it is directed to a driver, to the address where the driver normally works or resides.(2) A certificate of posting in accordance with Form 4 of Schedule 3 purporting to be signed by or for the Corporation shall be admitted in evidence without further proof on its production to the magistrate by the complainant and, until the contrary is proved, it shall be presumed that-
(a) the certificate is so signed; and
(b) the summons under subsection (1) to which the certificate relates was duly served.
Cap 556D s 45 Proceedings in the absence of the defendant
(1) Where at the time and place appointed for the hearing or adjourned hearing of a complaint a person served with a summons under section 44(1) does not appear before the magistrate, the magistrate may, subject to subsection (2), proceed to the hearing of the complaint and adjudicate thereon as fully and effectually to all intents and purposes as if such person had personally appeared before him in obedience to the summons.
(2) The magistrate shall not begin to hear the complaint in the absence of the defendant unless-
(a) service is proved under section 44(2); or
(b) the defendant has appeared on a previous occasion to answer to the complaint.(3) Notwithstanding section 44(2), for the purposes of subsection (2) a summons shall be deemed not to have been served unless service was effected within what is deemed by a magistrate to be a reasonable time before the time appointed in the summons for appearing thereto.
Cap 556D s 46 Proof in proceedings under section 42 or 45
Notwithstanding any provisions of the Magistrates Ordinance (Cap 227), in any application under section 42(2) or in any proceedings under section 45 in the absence of the defendant, an order under section 42(2) shall be made upon, or the substance of the complaint may be proved by, the production by the applicant or complainant to the magistrate of-
(a) a copy of the notice served under section 39(3) together with a certificate of posting under subsection (8) of that section; and
(b) a certificate under section 50.
Cap 556D s 47 Hearing of complaint
(1) A defendant shall, if he is present at a hearing and does not admit the truth of a complaint, be forthwith required to state the nature of his defence and if he does not at that stage expressly put in issue any allegation of fact contained in a certificate produced under section 50 he shall not thereafter be permitted to dispute or adduce evidence to contradict any such fact contained in the certificate.
(2) If a defendant has put in issue any allegation of fact in accordance with subsection (1), a magistrate may proceed to the hearing of the complaint and adjudicate thereon or may adjourn the proceedings and may issue a summons for the appearance of any witness.
(3) Where a person served with a summons in proceedings under section 42(1) does not appear before the magistrate or, having appeared, offers no defence or a defence which is frivolous or vexatious, the magistrate shall order that person to pay the fixed penalty together with an additional penalty equal to the amount of the fixed penalty.
(4) Where an order is made in proceedings under section 45, the magistrate shall cause notice of the order to be served on the defendant.
(5) Notice of the order made in any proceedings under section 45 may be served by sending it by post-
(a) where it is directed to a registered owner, to his registered address; or
(b) where it is directed to a driver, to the address where the driver normally works or resides.
Cap 556D s 48 Discontinuance of complaint
The complainant may, without the leave of the magistrate, discontinue a complaint against a defendant at any stage of the proceedings on giving notice in writing to the defendant and to the magistrate concerned.
Cap 556D s 49 Payment of fixed penalty after issue of summons
(1) Notwithstanding that proceedings have been instituted against a person who has notified the Corporation in accordance with the notice served on him under section 39(3), that he wishes to dispute liability, the defendant may pay the fixed penalty together with an additional penalty equal to the amount of the fixed penalty in accordance with subsection (2), and, if at the same time the defendant also pays to the court the sum referred to in subsection (4) by way of costs, the proceedings shall thereupon terminate.
(2) Payment under subsection (1) shall be made to any magistracy not later than 2 clear working days before the day specified in the summons for his appearance, and the summons shall be produced at the time of payment.
(3) In subsection (2) the expression 'clear working days' excludes the day specified in the summons for the appearance of the defendant and intervening public holidays.
(4) The sum to be paid by way of costs for the purpose of subsection (1) shall be the same as the sum to be paid by way of costs for the purpose of section 20B of the Fixed Penalty (Traffic Contraventions) Ordinance (Cap 237).
Cap 556D s 50 Evidence by certificate and presumptions
A certificate in accordance with Form 5 of Schedule 3 stating-
(a) that the person specified in it was at any particular time the registered owner or the driver, as the case may be of a particular vehicle;
(b) that the address specified in it was at any particular time the registered address of such person or, in the case of a driver, the address where he normally worked or resided; and
(c) that payment of the fixed penalty in respect of the contravention specified in any particular notice under section 39(3) was not made before the date specified in the certificate and, in the case of an application under section 42(2), that the person specified in it had not, before the date specified in the certificate, notified the Corporation that he wished to dispute liability for the contravention,and purporting to be signed by or for the Corporation shall be admitted in evidence without further proof on its production to the magistrate by the complainant or applicant and-
(i) until the contrary is proved, it shall be presumed that the certificate is so signed;
(ii) the certificate shall be prima facie evidence of the facts stated therein.
Cap 556D s 51 Other court orders at conclusion of proceedings
(1) If at the conclusion of any proceedings a complaint is dismissed, the magistrate may at the same time make an order for the payment of costs by the complainant of a sum as referred to in subsection (9).
(2) If at the conclusion of any proceedings an order for payment of the fixed penalty either with or without an additional penalty is made, the magistrate-
(a) may at the same time make an order for the payment of costs by the defendant of a sum as referred to in subsection (9); and
(b) shall at the same time make an order directing the Commissioner, for so long as the defendant fails to pay the sum adjudged to be paid-
(i) to refuse to issue a driving licence to the defendant or to refuse to renew his driving licence; and
(ii) in respect of any motor vehicle of which the defendant is the registered owner, to take no action under regulation 17(3), (4), (4A) or (5) of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.) on receipt of any notice of transfer of ownership of the motor vehicle and to refuse to license the motor vehicle under regulation 21(3), (5) or (6) of those Regulations.(3) An order under subsection (2)(a) shall specify-
(a) the name of the defendant;
(b) the sum adjudged to be paid.(4) Where an order under subsection (2)(b) is made, the magistrate shall cause notice of the order to be sent to the Commissioner if the sum adjudged to be paid is not paid within 24 hours of the making of the order.
(5) An order under subsection (2)(b) shall cease to have effect if the defendant produces to the Commissioner a receipt or other evidence to prove that the sum adjudged to be paid has been paid.
(6) An order under subsection (2)(b)(ii) shall cease to have effect if the defendant sells or otherwise disposes of the motor vehicle and the new owner of the motor vehicle is, at the time of delivery of notice of transfer of ownership under regulation 17 of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.), in possession of a valid certificate issued by the Commissioner in accordance with the form prescribed by the Commissioner from time to time to the effect that no notice of a valid order under subsection (2)(b)(ii) appears in the records of the Commissioner in respect of the motor vehicle.
(7) An application for a certificate under subsection (6) shall be made to the Commissioner and shall be in accordance with the form prescribed by the Commissioner from time to time.
(8) A certificate issued under subsection (6) shall be valid for not more than 72 hours from the time of issue;
(9) The sums which may be ordered by the magistrate for the payment of costs for the purpose of subsections (1) and (2)(a) shall be the same as the sums which may be ordered by a magistrate for the payment of costs for the purpose of section 22(1) and (2)(a) of the Fixed Penalty (Traffic Contraventions) Ordinance (Cap 237) respectively.
Cap 556D s 52 Distress in cases of default
(1) If a person who has been ordered to pay any sum adjudged to be paid fails within 1 month of the date of the order to so pay, an application may be made in the absence of that person to a magistrate for an order directing that-
(a) the sum adjudged to be paid, or where the application for an order under this section is in respect of more than one sum adjudged to be paid, the total of such sums;
(b) any additional sum payable under subsection (2); and
(c) any subsequent costs in the proceedings including the costs of an application under this section, or where an application for an order under this section is in respect of more than one sum adjudged to be paid, the total of the subsequent costs in all the proceedings,be levied on any goods and chattels of the person by distress and sale thereof.
(2) Where an application is made to a magistrate under subsection (1), the person to whom the application relates shall, without any further proceedings, be ordered to pay an additional sum by way of costs of not less than $50 or more than an amount equal to the fixed penalty, which, for the purposes of section 51(2)(b), shall be treated as if it were included in the sum adjudged to be paid.
(3) An application under subsection (1) shall be in the name of the Corporation, who may appoint any person or class of person to make the application.
Cap 556D s 53 Recovery of sums paid by registered owner
When a registered owner has paid a fixed penalty, an additional penalty or costs, such fixed penalty, additional penalty or costs may be recovered summarily as a civil debt by the registered owner from the person who was driving or in charge of the motor vehicle at the time the contravention was committed.

PART XI
EXCLUSIONS AND LIMITATIONS
(1) Subject to section 57, a person who, whether or not inside a vehicle, enters upon any part of a transport interchange and remains thereon does so at his own risk and on the express condition that the Corporation shall not be liable for any detention, loss or damage of whatever kind and wheresoever occurring howsoever and by whomsoever caused and whether or not it is in respect of or to such person or any baggage, property, goods, effects, articles, vehicles, matters or things belonging to or carried by, with, or for such person.
(2) Nothing in this Bylaw or otherwise shall give rise to a relationship of bailment, custody or trust between the Corporation and any person including the driver or owner of a vehicle who parks his vehicle in a car park or in any parking space.
Cap 556D s 55 Stay at own risk
Subject to section 57, all vehicles are left at any car park or in any parking space at the sole risk of the owner and driver thereof who shall be responsible for locking up and keeping the vehicle safe and secure from theft or other hazards.
Cap 556D s 56 Limitation of liability
Subject to section 57, the Corporation shall not be responsible for nor shall accept any liability in respect of-
(a) any damage caused to a vehicle entering or being in any part of a transport interchange or in a car park or parking space or caused to a vehicle which is being wheel-clamped under section 32 or which has been removed from a car park or from a transport interchange under section 33; or
(b) any claim for loss of or damage to vehicle, or thing inside or attached to or loaded on or in a vehicle,provided that reasonable care shall have been exercised by the Corporation in respect of the transport interchange or the removal of the vehicle by the Corporation.
Cap 556D s 57 Extent of limitation of liability
(1) Notwithstanding section 18(1)(a) of the Control of Exemption Clauses Ordinance (Cap 71), nothing in this part shall exclude or be deemed to exclude or restrict any liability of the Corporation to the extent that any such exclusion or restriction is void or invalid under the provisions of that Ordinance, and the Corporation accepts such liability up to, but not beyond, the extent of the liability imposed upon it as a result of the operation of such Ordinance.
(2) For the purpose of subsection (1), sections 54, 55 and 56 shall be treated as if they were contract terms or notices under the Control of Exemption Clauses Ordinance (Cap 71).
Cap 556D s 58 Damage to property
PART XII
OTHER OFFENCES
No person shall improperly touch, use, meddle, damage or otherwise interfere with-
(a) any machine or equipment, or any part thereof, used or employed in or upon any part of the transport interchange;
(b) any vehicle, carriage, truck or any other conveyance or any equipment thereon used or employed on or in connection with the transport interchange;
(c) any electrical plant, or other form of electrical installation or equipment of any nature whatsoever used or employed in or upon any part of the transport interchange.
Cap 556D s 59 Placing of offensive matter
No person shall permit or suffer any sewage, drainage or other offensive matter to flow onto or enter or be placed on any part of the transport interchange.
Cap 556D s 60 Throwing offensive matter
No person shall deposit or throw, or cause to be deposited or thrown at, on or from the transport interchange any glass, stone, missile or any rubbish or other offensive or waste matter.
Cap 556D s 61 Emergency equipment
No person, unless otherwise authorized by the Corporation, shall activate any emergency or safety device in the transport interchange save for the express purpose for which the same is provided and in accordance with the instructions printed thereon.

PENALTIES AND SAVING
Any person who contravenes a section or subsection set out in column 1 in Part I of Schedule 2 commits an offence and is liable on conviction to the maximum penalty set out in column 3 of Part I of Schedule 2.
Cap 556D s 63 Saving
Nothing in this Bylaw shall be taken to restrict, derogate from or otherwise interfere with any power conferred or duty imposed by or under any law upon any person in the service of the Government of the Hong Kong Special Administrative Region or upon the Corporation or its employees.

1. You may notify me, if you wish to dispute liability for the contravention, by signing the form appended below and delivering it to me on or before the last date for notification of dispute.
2. If you notify me that you wish to dispute liability for the contravention, the matter will be determined by a magistrate on complaint in accordance with the Bylaw and you will be served with a summons in due course.
3. If having notified me that you wish to dispute liability for the contravention, you do not appear in court to answer the summons or, having appeared, you offer no defence or a defence which is frivolous or vexatious, you are liable to the Fixed Penalty, an additional penalty equal to the Fixed Penalty and costs.
