本条例旨在设立一项名为“在囚人士教育信托基金”的信托基金,并就该基金的妥善管理及相关事宜作出规定。

第467章 第1条简称
(1)本条例可引称为《在囚人士教育信托基金条例》。

第467章 第2条释义
在本条例中,除文意另有所指外─
“在囚人士”(prisoner) 指被惩教署羁押的任何被判有罪的人;
“受托人”(trustee) 指作为基金受托人的署长;
“委员会”(committee) 指第6条设立的委员会;
“基金”(fund) 指第3条设立的基金;
“教育”(education) 指小学修业后的教育,或任何不低于小学修业后的教育程度而属专业、技术、学术或其他性质的教育;
“署长”(Commissioner) 指惩教署署长;
“归属日期”(vesting day) 指本条例生效日期。

第467章 第3条基金的设立
(1)现设立一项基金,名为“在囚人士教育信托基金”。
(2)受托人须以信托形式持有基金,并须受本条例的条文规限。
(3)基金由下列各项组成─
(a)在归属日期前为该基金的目的而向署长捐赠的所有款项;
(b)在归属日期前署长藉运用(a)段所提述的款项而获取的所有资产;
(c)不时向基金作出的捐赠;
(d)受托人不时为该基金的目的而获取的其他款项、资产或财产,包括基金的任何累积收入。

第467章 第4条信托基金的宗旨
受托人须以信托形式持有及持续管有基金,并须按照委员会所指示的方式及在委员会所指示的范围及限度内加以运用,以向个别在囚人士在其致力获得教育方面应其申请而提供经济援助,及为在囚人士提供教育设施。

第467章 第5条署长成为受托人法团
(1)为本条例的施行,署长是基金的受托人,并属单一法团(在本条内称为“该法团”),名为“在囚人士教育信托基金受托人”,并以该名义永久延续及可在任何法院起诉及被起诉。
(2)该法团须具有一法团印章,凡盖上该印章,须由受托人签署认证。
(3)任何看来是用该法团的印章妥为签立的文书,在没有相反证据的情况下,须当作为如此签立的文书。

第467章 第6条委员会的设立
(1)为就基金的宗旨及基金款项的投资向受托人作出指示,现设立一委员会,名为“在囚人士教育信托基金管理委员会”。
(2)委员会由下列人士组成─
(a)由保安局局长委任不属公职人员的主席一名,其任期为在其委任书上所指明者,但可再获委任; (由1997年第362号法律公告修订)
(b)由保安局局长委任不属公职人员的委员一名,其任期为3年,但可再获委任; (由1997年第362号法律公告修订)
(c)署长为当然委员,或由署长委任一人作为其代表;
(d)惩教署犯人福利组主管;
(e)惩教署教育组主管。(3)委员会在会议中处理事务所需的法定人数为3名委员。
(4)委员会程序的有效性,并不因委员中出现空缺,或因任何委员的委任有不妥善之处而受影响。
(5)委员会可订立常规─
(a)管限其处理事务的程序;
(b)维持其会议的良好秩序;及
(c)概括地对与其职责的执行有关的事宜,作出规定。(6)保安局局长可对委员会常规作出拒准、更改或修订。 (由1997年第362号法律公告修订)
(7)在委员会会议中所产生的所有问题,须以出席委员的多数票为取决,如票数均等,则主席除有权投其原有的一票外,还有权投决定票。

第467章 第7条帐目
附注:
具追溯力的修订-见1999年第15号第3条
(1)受托人须按库务署署长的规定安排为基金的所有往来项目备存帐目,并须就于每年3月31日终结的每段为期12个月的期间安排制备有关基金的帐目报表,而该报表须包括收支帐目及资产负债表,并须在其所关乎的财政年度终结后的3个月内由受托人签署。
(2)基金的帐目及已签署的帐目报表,均须由审计署署长审计,而该报表须由审计署署长核证,他可在他认为适合的报告(如有的话)的规限下核证该报表。 (由1997年第362号法律公告修订)
(3)一份经签署及审计的帐目报表连同核数师报告(如有的话),以及受托人于审计帐目所涵盖期间就基金管理所作的报告,连同受托人认为适合的其他报告,须在受托人从核数师取得该经签署及审计的帐目报表后3个月内提交立法会省览。 (由1999年第15号第3条修订)

第467章 第8条投资顾问委员会
(1)为就基金款项的投资提供意见,现设立一顾问委员会,名为“投资顾问委员会”。
(2)保安局局长须以有关人士具备的银行业、投资及财经事宜知识及经验为理由委任不少于3名但不超过5名人士组成投资顾问委员会。 (由1997年第362号法律公告修订)
(3)投资顾问委员会委员任期3年,但可再获委任。
(4)保安局局长须委任一名投资顾问委员会委员为主席。 (由1997年第362号法律公告修订)
(5)在投资顾问委员会会议中所产生的所有问题,须以出席委员的多数票为取决,如票数均等,则主席除有权投其原有的一票外,还有权投决定票。

第467章 第9条款项的投资
(1)受托人可将基金的任何款项投资于投资顾问委员会建议的及经在囚人士教育信托基金管理委员会批准的信托投资项目。
(2)在第(1)款内,“信托投资项目”(trust investments) 指《受托人条例》(第29章)附表2所指明的投资项目。

Cap 467 s 1 Short title
(1) This Ordinance may be cited as the Prisoners' Education Trust Fund Ordinance.

Cap 467 s 2 Interpretation
In this Ordinance, unless the context otherwise requires-
'Commissioner' (署长) means the Commissioner of Correctional Services;
'committee' (委员会) means the committee established by section 6;
'fund' (基金) means the fund established by section 3;
'education' (教育) means post-primary education or any education of a professional, technological, academic or other nature not below the standard of post-primary education;
'prisoner' (在囚人士) means any convicted person kept in the custody of the Correctional Services Department;
'trustee' (受讬人) means the Commissioner as trustee of the fund;
'vesting day' (归属日期) means the day of commencement of this Ordinance.

Cap 467 s 3 Establishment of fund
(1) There is hereby established a fund called the Prisoners' Education Trust Fund.
(2) The trustee shall hold the fund on the trusts and subject to the provisions contained in this Ordinance.
(3) The fund shall consist of-
(a) all moneys donated to the Commissioner prior to the vesting day for the purposes of the fund;
(b) all assets acquired by the Commissioner prior to the vesting day by the use of moneys referred to in paragraph (a);
(c) such donations as may be made to the fund from time to time;
(d) such other moneys, assets or property as may be acquired by the trustee for the purposes of the fund from time to time, including any accumulated income of the fund.

Cap 467 s 4 Objects of the trust
The trustee shall hold and stand possessed of the fund upon trust to apply the same in such manner and to such extent as the committee may direct for the purposes of providing financial assistance to individual prisoners, on application, in their efforts to obtain education and providing educational facilities for prisoners.

Cap 467 s 5 Incorporation of Commissioner as trustee
(1) For the purposes of this Ordinance the Commissioner shall be the trustee of the fund and shall be a corporation sole (in this section referred to as 'the corporation') and shall have the name of 'The Trustee of the Prisoners' Education Trust Fund', and in that name shall have perpetual succession and may sue and be sued in any court.
(2) The corporation shall have a common seal and the affixing of the seal shall be authenticated by the signature of the trustee.
(3) Any instrument purporting to be an instrument duly executed under the seal of the corporation shall, in the absence of evidence to the contrary, be deemed to be an instrument so executed.

Cap 467 s 6 Establishment of committee
(1) For the purpose of directing the trustee with regard to the objects of the fund and with regard to the investment of fund moneys, there shall be established a committee to be known as the 'Prisoners' Education Trust Fund Committee'.
(2) The committee shall consist of-
(a) a chairman, who shall not be a public officer, appointed by the Secretary for Security, who shall hold office for such period as shall be specified in his letter of appointment, but who shall be eligible for reappointment;
(b) a member, who shall not be a public officer, appointed by the Secretary for Security, who shall hold office for 3 years, but who shall be eligible for reappointment;
(c) the Commissioner as an ex officio member or a person appointed by the Commissioner to represent him;
(d) the officer in charge of the Prisoners' Welfare Section of the Correctional Services Department;
(e) the officer in charge of the Education Section of the Correctional Services Department.(3) The quorum necessary for the transaction of business by the committee at a meeting shall be 3 members.
(4) The validity of any proceedings of the committee shall not be affected by any vacancy among the members thereof or by any defect in the appointment thereto of any member.
(5) The committee may make standing orders-
(a) governing their procedure in the transaction of business;
(b) for the maintenance of good order at their meetings; and
(c) generally for matters relating to the discharge of their duties.(6) The standing orders shall be subject to disallowance, alteration or amendment by the Secretary for Security.
(7) All questions arising at any meeting of the committee shall be decided by a majority of votes of members present and, in the case of an equality of votes, the chairman shall have a casting vote in addition to his original vote.

Cap 467 s 7 Accounts
(1) The trustee shall cause such accounts to be kept of all transactions of the fund as the Director of Accounting Services may require and shall cause to be prepared, for every period of 12 months ending on 31 March in each year, a statement of the accounts of the fund, which statement shall include an income and expenditure account and balance sheet and shall be signed by the trustee within 3 months of the end of the financial year to which they relate.
(2) The accounts of the fund and the signed statement of accounts shall be audited by the Director of Audit who shall certify the statement subject to such report, if any, as he may think fit.
(3) A copy of the signed and audited statement of accounts together with the auditor's report, if any, and a report by the trustee on the administration of the fund during the period covered by the audited accounts together with such other report as the trustee may see fit to make shall be laid on the table of the Legislative Council within 3 months of the receipt by the trustee of the signed and audited statement of accounts from the auditor.

Cap 467 s 8 Investment Advisory Committee
(1) For the purposes of advising on the investment of fund moneys, there shall be established an advisory committee to be known as the 'Investment Advisory Committee'.
(2) The Investment Advisory Committee shall consist of not less than 3 and not more than 5 persons appointed by the Secretary for Security by reason of their knowledge and experience of banking, investment and financial matters.
(3) Members of the Investment Advisory Committee shall hold office for 3 years but shall be eligible for reappointment.
(4) The Secretary for Security shall appoint one member of the Investment Advisory Committee to be chairman.
(5) All questions arising at any meeting of the Investment Advisory Committee shall be decided by a majority of votes of the members present and, in the case of an equality of votes, the chairman shall have a casting vote in addition to his original vote.

Cap 467 s 9 Investment of moneys
(1) The trustee may invest any moneys of the fund in such trust investments as may be recommended by the Investment Advisory Committee and approved by the Prisoners' Education Trust Fund Committee.
(2) In subsection (1), 'trust investments' (信讬投资项目) means investment specified in the Second Schedule to the Trustee Ordinance (Cap 29).

Cap 467 s 10 Cost of administration of the fund
The cost of the administration of the fund shall be a charge on the general revenue.
