第1100章弁言
鉴于─
(a)国际难民年英国委员会*给予政府一笔$2200000.00的款项,以创立基金,运用于为社会工作者及意欲成为社会工作者的人提供训练设施;
(b)在上述$2200000.00的款项中,已为上述目的支用一笔$19939.06的款项,剩下一笔$2180060.94的结余;及
(c)现认为适宜将上述$2180060.94的结余归属作为受托人的社会福利署署长法团,并就由一个为此而委出的委员会管理上述结余及任何添加于上述结余的其他款项订定条文:___________________________________________________________________________

第1100章 第1条简称
本条例可引称为《社会工作训练基金条例》。
第1100章 第2条释义
在本条例中,除文意另有所指外─
“受托人”(trustee) 指作为基金受托人的社会福利署署长法团;
“委员会”(committee) 指由第5条设立的社会工作训练基金委员会;
“社会工作”(social work) 指委员会认为涉及维持或改善在香港居住的人的社会及个人福利、康乐或生活情况的任何活动,但不包括为根据《牙医注册条例》(第156章)、《医生注册条例》(第161章)、《助产士注册条例》(第162章)、《护士注册条例》(第164章)或《教育条例》(第279章)的条文获得注册而需要的训练或活动;(由1988年第15号第4条修订)
“社会工作者”(social worker) 指曾受社会工作训练、受雇于社会工作或从事社会工作的人;
“秘书”(secretary) 指根据第7条委任的委员会秘书;
“基金”(fund)指由第3条设立的社会工作训练基金。
第1100章 第3条基金的设立和归属
(1)现设立一个信托基金,名为社会工作训练基金,并归属作为受托人的社会福利署署长法团,而该法团是根据并凭借《社会福利署署长法团条例》(第1096章)成立为法团的法人团体。
(2)基金由以下各项组成─
(a)$2180060.94,即国际难民年英国委员会*给予政府的款项的结余,连同该笔结余截至本条例生效日期为止的利息;及
(b)在任何时间向基金作出并获委员会接受的任何其他捐赠或遗赠。___________________________________________________________________________

第1100章 第4条基金的宗旨

(1)受托人须在本条例所规定的委员会指示及管辖的规限下,并在符合和按照本条例的条文下,以信托形式持有和继续管有基金,而且须运用基金的收益和在符合下文的规定下运用基金的资本,藉以─
(a)就作为社会工作者的研修及训练向个人作出资助,包括支付旅费、交通费及生活津贴,以及其他附带开支;
(b)改善社会工作者的现有训练设施;
(c)为社会工作者举办课程,并支付任何与此相关的所需开支;
(d)在香港训练社会工作人才和取得关于上述训练的意见;及
(e)达致任何其他与此相关并计拟改善香港社会工作者的训练及技能的目的。 (由1988年第15号第4条修订)(2)受托人可在符合委员会的指示下,为上述目的而运用基金的任何收益及藉累积过往一年收益所得的基金资本,但如未经行政长官事先同意,则不得为任何上述目的而运用基金资本的任何其他部分。 (由1999年第18号第3条修订)
第1100章 第5条委员会的设立
(1)为管理基金,现设立一个委员会,名为社会工作训练基金委员会,成员如下─
(a)社会福利署署长,并由他出任委员会主席;
(b)(由1988年第15号第2条废除)
(c)教育统筹局常任秘书长或其代名人;及 (由2003年第3号第41条修订)
(d)由行政长官委任的其他成员不超过3名。(2)由行政长官委任的成员,任期为3年或行政长官所规定的较短期间,由获委任的日期起计,并可由行政长官酌情重新委任或免任。
(3)如根据第(1)(d)款获委任的成员不在香港,行政长官可在该成员不在香港期间委任另一人代替该成员。 (由1988年第15号第4条修订)
(4)委员会处理事务所需的法定人数,可由根据第6条订立的常规订定,而除非有如此订定,否则法定人数为3名成员。 (由1988年第15号第2条修订)

第1100章 第6条委员会常规

(1)委员会可就以下事宜,订立常规─
(a)管限委员会处理事务的程序;
(b)维持委员会会议的秩序良好;及
(c)概括而言,与基金的行政和管理及履行委员会的职责有关的事宜。(2)根据第(1)款订立的每一项常规的文本,须提交政务司司长,而每一项常规得由行政长官拒准。 (由1976年第226号法律公告修订;由1997年第362号法律公告修订;由1999年第18号第3条修订)
(3)在委员会的任何会议上出现的所有问题,须由出席的成员表决,并以过半数票取决,如票数均等,则主席除其原有一票外,有权投决定票。
第1100章 第7条秘书

(2)秘书须于有需要时召集委员会会议,并须就该会议向委员会的每名成员发出不少于7天通知及议程。

第1100章 第8条征求和接受捐赠及遗赠的权力
委员会可代表受托人征求和接受对基金的捐赠及遗赠。
第1100章 第9条借入款项权力

受托人可按委员会指示的利率及条款或条件借入委员会指示的款项,以贯彻第4条指明的任何目的,并可在行政长官事先同意下,将基金的资本及资产押记,作为偿还借入款项的保证。

第1100章 第10条帐目

(1)受托人须安排为基金的一切交易备存妥善的帐目,并须安排为每段截至每年3月31日为止的12个月期间,拟备基金帐目报表,其中包括收支帐及资产负债表,而该等报表须由受托人签署。
(2)基金的帐目及经签署的帐目报表,须由行政长官委任的核数师审计,而该核数师须核证帐目报表,但可按其认为适合的报告(如有的话)予以规限。
(3)一份经签署和审计的帐目报表,连同核数师报告(如有的话),以及受托人就经审计的帐目所涵盖期间内的基金管理作出的报告,须不迟于上述期间终结后第一个12月31日呈交立法会会议席上省览,或在行政长官凭其绝对酌情决定权而容许的较后日期呈交立法会会议席上省览。 (由1988年第15号第3条修订)

第1100章 第11条投资项目

受托人可将任何款项投资在委员会指示的投资项目,而不论该等投资项目是否信托投资项目,但如投资项目并非信托投资项目,则须获财政司司长的事先批准。

管理基金的费用须从
香港政府一般收入中拨款支付:
但财政司司长可指示从基金收益中,征收一项监管年费,以拨入

To establish a trust fund for the training of social workers.

Cap 1100 Preamble
WHEREAS-
(a) The United Kingdom Committee For World Refugee Year has given to the Government the sum of $2200000.00 to inaugurate a fund to be applied in the provision of training facilities for social workers and for persons desirous of becoming social workers;
(b) of the said sum of $2200000.00, the sum of $19939.06 has been expended for such purpose, leaving a balance of $2180060.94; and
(c) it is considered expedient to vest the said balance of $2180060.94 in the Director of Social Welfare Incorporated as trustee and to provide for the administration, by a committee appointed for that purpose, of the said balance and of any further sums added thereto:
Cap 1100 s 1 Short title
This Ordinance may be cited as the Social Work Training Fund Ordinance.
Cap 1100 s 2 Interpretation
In this Ordinance, unless the context otherwise requires-
'committee' (委员会) means the Social Work Training Fund Committee established by section 5;
'fund' (基金) means the Social Work Training Fund established by section 3;
'secretary' (秘书) means the secretary of the committee appointed under section 7;
'social work' (社会工作) means any activity which, in the opinion of the committee, is concerned with the maintenance or improvement of the social and personal well-being, recreation or conditions of living of persons resident in Hong Kong but does not include any training or activity necessary for the purpose of obtaining registration under the provisions of the Dentists Registration Ordinance (Cap 156), the Medical Registration Ordinance (Cap 161), the Midwives Registration Ordinance (Cap 162), the Nurses Registration Ordinance (Cap 164), or the Education Ordinance (Cap 279); (Amended 15 of 1988 s. 4)
'social worker' (社会工作者) means a person who is trained for or employed in or engaged in any social work;
'trustee' (受讬人) means the Director of Social Welfare Incorporated as trustee of the fund.
Cap 1100 s 3 Establishment and vesting of fund
(1) There is hereby established a trust fund to be known as the Social Work Training Fund which is hereby vested in the Director of Social Welfare Incorporated, a body corporate incorporated under and by virtue of the Director of Social Welfare Incorporation Ordinance (Cap 1096), as trustee.
(2) The fund shall consist of-
(a) the sum of $2180060.94 being the balance of the sum paid to the Government by The United Kingdom Committee For World Refugee Year, together with any interest thereon up to the date of coming into operation of this Ordinance; and
(b) any further donations or bequests at any time made to the fund and accepted by the committee.
Cap 1100 s 4 Objects of the fund

(1) The trustee shall hold and stand possessed of the fund subject to such direction and control by the committee as is provided in this Ordinance and subject to and in accordance with the provisions of this Ordinance upon trust to apply the income thereof and, subject as is hereinafter provided, to apply the capital thereof-
(a) in making grants to individuals for the purpose of study and training as social workers, including payment of passages, travel and subsistence allowances and other incidental expenses;
(b) in improving existing training facilities for social workers;
(c) in running of courses for social workers and payment of any necessary expenses in connection therewith;
(d) in the training of persons for social work in Hong Kong and in obtaining advice about such training; and
(e) for any other purpose connected therewith, designed to improve the training and skill of social workers in Hong Kong. (Amended 15 of 1988 s. 4)(2) The trustee, subject to the direction of the committee, may apply for such purposes any income of the fund and any capital of the fund which has been obtained by the accumulation of income in any previous year but may not apply any other part of the capital of the fund for any such purpose without the prior consent of the Chief Executive. Cap 1100 s 5 Establishment of committee
(1) For the management of the fund, there shall be established a committee to be known as the Social Work Training Fund Committee which shall consist of-
(a) the Director of Social Welfare who shall be the Chairman of the committee;
(b) (Repealed 15 of 1988 s. 2)
(c) the Permanent Secretary for Education and Manpower or his nominee; and (Amended 3 of 2003 s. 41)
(d) such other members not exceeding 3 as may be appointed by the Chief Executive.(2) A member appointed by the Chief Executive shall hold office for 3 years or such lesser period as may be stipulated by the Chief Executive from the date of his appointment and may be reappointed or removed at the discretion of the Chief Executive.
(3) If a member appointed under subsection (1)(d) is absent from Hong Kong, the Chief Executive may appoint another person to replace such member during his absence. (Amended 15 of 1988 s. 4)
(4) The quorum necessary for the transaction of business by the committee may be fixed by standing orders made under section 6 and unless so fixed shall be 3 members. (Amended 15 of 1988 s. 2)

Cap 1100 s 6 Standing orders of committee

(1) The committee may make standing orders-
(a) governing the procedure of the committee in the transaction of business;
(b) for the maintenance of good order at meetings of the committee; and
(c) generally for matters relating to the administration and management of the fund and the discharge of the duties of the committee.(2) A copy of every standing order made under subsection (1) shall be furnished to the Chief Secretary for Administration and every standing order shall be subject to disallowance by the Chief Executive. (3) All questions arising at any meeting of the committee shall be decided by a majority of votes of members present and, in the case of an equality of votes, the Chairman shall have a casting vote in addition to his original vote.
Cap 1100 s 7 Secretary

(1) There shall be a secretary to the committee who shall be appointed by the Chief Executive. (Amended 18 of 1999 s. 3)
(2) The secretary shall summon such meetings of the committee as may be required of which he shall give to each member thereof not less than 7 days' notice with an agenda.
(3) The secretary shall maintain minutes of each meeting of the committee.
Cap 1100 s 8 Power to solicit and take donations and bequests
The committee may solicit and accept on behalf of the trustee donations and bequests to the fund.
Cap 1100 s 9 Borrowing powers

The trustee may borrow such sums of money at such rates of interest and subject to such terms or conditions as the committee may direct for the furtherance of any of the purposes specified in section 4, and, with the prior consent of the Chief Executive, may charge the capital and assets of the fund as security for the repayment thereof.

Cap 1100 s 10 Accounts

(1) The trustee shall cause proper accounts to be kept of all transactions of the fund and shall cause to be prepared for every period of 12 months ending on 31 March in each year, a statement of the accounts of the fund, which statement shall include an income and expenditure account and balance sheet and shall be signed by the trustee.
(2) The accounts of the fund and the signed statement of the accounts shall be audited by an auditor appointed by the Chief Executive and the auditor shall certify such statement subject to such report, if any, as he may think fit.
(3) A copy of the signed and audited statement of accounts together with the auditor's report, if any, and a report by the trustee on the administration of the fund during the period covered by the audited accounts shall be laid upon the table of the Legislative Council not later than 31 December next following the end of such period or so soon thereafter as the Chief Executive in his absolute discretion may allow. Cap 1100 s 11 Investments

The trustee may invest any moneys in such investments, whether or not such investments are trust investments, as the committee may direct subject, in the case of investments which are not trust investments, to the prior approval of the Financial Secretary.

Cap 1100 s 12 Cost of administration
The cost of the administration of the fund shall be a charge on the general revenue of Hong Kong:
Provided that the Financial Secretary may direct that an annual supervision fee to be determined by him shall be charged against the income of the fund and paid into the general revenue of Hong Kong.

Nothing in this Ordinance shall affect or be deemed to affect the rights of the Central Authorities or the Government of the Hong Kong Special Administrative Region under the Basic Law and other laws, or the rights of any body politic or corporate or of any other persons except such as are mentioned in this Ordinance and those claiming by, from or under them.
